SPECIAL WARRANTY DEED
FOR A FEE SIMPLE DETERMINABLE

Grantor, International Business Machines Corporation, a New
York corporation, for the consideration and subject to the
reservations and exceptions to conveyance and warranty set forth
hereinafter, hereby GRANTS, SELLS AND CONVEYS to Grantee, the
City of Southlake, the 1.5 acre described in the attached Exhibit
"A" together with all and singular the rights and appurtenances
thereto in anywise belonging, to have and to hold to Grantee, its
successors and assigns forever. Grantor binds itself and its
successors and assigns to warrant and forever defend all and
singular the property to Grantee, its successors and assigns,
against every person whomsoever lawfully claiming or to or claim
the same or any part thereof by, through, or under Grantor, but
not otherwise, except as to the reservations from and exceptions
to conveyance and warranty set forth herein and subject to the
reversionary interest created hereby. This conveyance and
warranty is made subject to any and all easements, encumbrances,
restrictions, roads, rights-of-way, or other matters that would
be disclosed by a review of the real property records of Tarrant
County, Texas or by an on-the-ground inspection of the property
conveyed hereby.
This conveyance is of a fee simple determinable. This
property is expressly conveyed by Grantor to Grantee at no charge
with the express understanding that Grantee will construct a fire
station on this property within five (5) years from the date of
this conveyance. If Grantee shall (i) fair to construct and
maintain a fire station on this property within five (5) years of
the date hereof, or (ii) use this property for anything other
than a fire station during the twenty-five (25) years after the
date of this conveyance, then title shall, immediately and
without further action by Grantor, revert and revert in Grantor.

particularly described by metes and bounds as follorn:
BEGINNING at an iron rod found for the southwest corner of ~
that certain 4.974 acres described in Volume 8017, page 1037,
Deed Records, Tarrant County, Texas, same being the northwest
corner of a called 4.000 acre tract described in Volume 5141,
Page 273, Deed Records, Tarant County, Texas, said rod being
called North 0°31' West, 773.2 feet from the north line of
Dove Road; ,•
THENCE North 00°31'00" West, with the west line of said
4.974 acres, 291.86 feet to a set iron rad;
