Grantor, for the consideration and subject to the reservations from and exceptions to
conveyance and warranty, grants, sells, and conveys to Grantee the property, together with all and
singular the rights and appurtenances thereto in any wise belonging, to have and hold it to Grantee,
Grantee's successors, and assigns forever. Grantor hereby binds Grantor and Grantor's successors
and assigns to warrant and forever defend all and singular the property to Grantee and Grantee's
successors and assigns, against every person whomsoever lawfully claiming or to claim the same
or any part hereof, except as to the reservations from and exceptions to conveyance and warranty,
when the claim is by, through, or under Grantor but not otherwise.
Grantor makes no warranty, express or implied, as to the condition or state of repair of the
Property, or any portion thereof, and there are no implied warranties of merchantability or fitness
for a particular purpose as to the Property or any portion thereof. Grantee acknowledges that
delivery of the Property is "AS IS" and `WITH ALL FAULTS", and that Grantor has disclaimed any
implied warranties with respect to the Property.

This deed is executed to correct the deed dated July 29, 1998, and recorded in Volume 13344,
page 0102, of the Deed Records of Tarrant County, Texas, from EPIPD-Crossroads Square, L.P.,
a Texas limited partnership, as Grantor, to the City of Southlake, Texas, a Municipal Corporation,
as Grantee, in which the property was incorrectly described as a 1.6794 acre trace of land, more or
less. In all other respects, the prior deed is confirmed.
