RESOLUTION NO. 19-021 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS, GRANTING A SPECIFIC USE PERMIT FOR A MASS GATHERING FOR OKTOBERFEST LOCATED BETWEEN E. SOUTHLAKE BOULEVARD, E. S.H. 114 AND N. CARROLL AVENUE, SOUTHLAKE, TEXAS, BEING DESCRIBED AS PHASE I-IV, SOUTHLAKE TOWN SQUARE, MORE FULLY AND COMPLETELY DESCRIBED IN EXHIBIT "A", AND AS DEPICTED ON THE APPROVED SITE PLAN ATTACHED HERETO AND INCORPORATED HEREIN AS EXHIBIT "B" AND PROVIDING AN EFFECTIVE DATE. WHEREAS, a Specific Use Permit for a mass gathering for Oktoberfest has been requested by a person or corporation having a proprietary interest in the property zoned as "DT" Downtown District; and, WHEREAS, in accordance with the requirements of Section 45.1 (36) of the City's Comprehensive Zoning Ordinance, the Planning and Zoning Commission and the City Council have given the requisite notices by publication and otherwise, and have afforded the persons interested and situated in the affected area and in the vicinity thereof; and, WHEREAS, the City Council does hereby find and determine that the granting of such Specific Use Permit is in the best interest of the public health, safety, morals and general welfare of the City. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS: SECTION 1. A Specific Use Permit is hereby granted for a mass gathering for Oktoberfest, on property within the City Of Southlake, Texas, located between E. Southlake Boulevard, E. S.H. 114 and N. Carroll Avenue, Southlake, Texas, location being described as Phase I-IV, Southlake Town Square, an addition to the City of Southlake, Tarrant County, Texas, more fully and completely described in Exhibit "A", and as depicted on the approved Site Plan attached hereto and incorporated herein as Exhibit"B"and providing an effective date, subject to the provisions contained in the comprehensive zoning ordinance and the restrictions set forth herein. The following specific requirements and special conditions shall be applicable to the granting of this Specific Use Permit: Approved subject to the Staff Report dated May 28, 2019; noting the approval is for the Resolution No. 19-021 Page 1 2019 event schedule hours as presented (see details in Exhibit B) with the condition that RPAI approves of those hours and noting the approval is for a period of five (5) years. Expiration date June 4, 2024. SECTION 2. This resolution shall become effective on the date of approval by the City Council. PASSED AND APPROVED THIS 4th DAY OF JUNE, 2019. October 6 12 p.m.-8 p.m. -ItTown Hall 4,0 f R t t 1 7 n■j 6 d dsaG • gliC 1k01 i3 • . �,..... _ • ,' •• O t O f S © �,SOUTH LAKE Music Stage .1.713 Site Plan & Event Schedule If the applicant does NOT receive RPAI approval for the increase in hours, the event will adhere to the following schedule: Friday 12 p.m. — 5 p.m. Saturday 10 a.m. — 11 p.m. Sunday 12 p.m. — 5 p.m. • Promotional signage approval and permits by appropriate City staff for the pavilion banner and small directional signs is required; and by the property owner for the banners hung across Main Street; and, TxDOT for the electronic message boards on S.H. 114. • The applicant understands that the small directional signs cannot be placed in the public right of way. The applicant shall pursue permission from the City Engineer to place signs in the median along Carroll Avenue at Federal Way and at Main Street. Pursuant to Section 5.2.5 of Sign Ordinance 704, as amended, permission may be granted by the City for public purposes. These signs are intended to direct traffic to parking areas. • Each year, a current confirmation from the property owner will need to be submitted to the city prior to that year's event. • Any necessary sign and/or tent permits will need to be renewed annually at least 30 days prior to that year's event.
