Item 6ECase No. ZA19-0028 S T A F F R E P O R T May 28, 2019 CASE NO: ZA19-0028 PROJECT: Specific Use Permit for Oktoberfest EXECUTIVE SUMMARY: The Southlake Chamber of Commerce is requesting approval of a Specific Use Permit for a Mass Gathering Event for Oktoberfest on property described as Phases I-IV, Southlake Town Square, City of Southlake, Tarrant County, Texas and located between E. Southlake Boulevard, E. SH 114 and N. Carroll Avenue, Southlake, Texas. Current Zoning: “DT” Downtown District. SPIN Neighborhood #8. DETAILS: The Southlake Chamber of Commerce is requesting approval of a specific use permit (SUP) for a mass gathering event for Oktoberfest. The previously approved SUP will expire June 3, 2019. The 2019 event space will encompass the same boundary used in previous years. The attendance is expected to remain the same as the 2018 event which reached 100,000 over the course of three days. This will be the 18th year for this Southlake Chamber of Commerce hosted event. All activities and entertainment are consistent with the 2018 event. The applicant is requesting to continue to have the ability to access the park property on the Thursday prior to the event at 9 a.m. in order to load in and set up the large tent in the middle of the park. General parking and traffic flow will not be impacted. The entire set up is anticipated to be completed by midnight on that Thursday. The expanded hours on Friday and Sunday will provide additional opportunities for community partners to participate as well as give attendees additional time to experience the food, unique vendors and entertainment of Oktoberfest. The 2019 Event Schedule is as follows: Friday, October 4 12 p.m. (previously 5 p.m.) – 11 p.m. Saturday, October 5 10 a.m. – 11 p.m. Sunday, October 6 12 p.m. – 8 p.m. (previously 5 p.m.) This event has been held annually since 2002. The previous approval by City Council on June 3, 2014 allowed the event to be held for five (5) consecutive years with the Director of Planning & Development Services having the ability to review conditions and provide revocability at their discretion. Due to the many years of experience by the event organizers and the stability and maturity of the event, the applicant is respectfully requesting that the event be permitted in perpetuity. The event is typically held the first Friday, Saturday, and Sunday of October. August 20, 2002 – City Council approved (7-0) SUP’s for Special Events (Southlake Town Square NRPUD) and the Sale of Alcoholic Beverages for Oktoberfest for a period of one (1) year (ZA02-069 & ZA02-072). August 5, 2003 – City Council approved (5-0) SUP’s for Special Events (Southlake Town Square NRPUD) and the Sale of Alcoholic Beverages for Oktoberfest for a period of one (1) year (ZA03-046 & ZA03-047). August 3, 2004 – City Council approved (5-0) SUP’s for Mass Gathering Event (Southlake Town Square DT) and the Sale of Alcoholic Beverages for Oktoberfest for a period of three (3) years (ZA04-052 & ZA04-053). August 21, 2007 – City Council approved (7-0) SUP for Mass Gathering Event (Southlake Town Square DT) for Oktoberfest for a period of three (3) years (ZA07-096). The SUP requirement for Sale of Alcoholic Beverages had been eliminated. March 2, 2010 – City Council approved (7-0) SUP for Mass Gathering Event (Southlake Town Square DT) for Oktoberfest for a period of three (3) years (ZA10-005). June 21, 2011 – City Council approved (6-0) SUP for Mass Gathering Event (Southlake Town Square DT) for Oktoberfest for a period of three (3) years (ZA11-024). Renewal was necessary due to expansion of the event boundary for the Sport Zone, on the west side of Main Street. June 3, 2014 – City Council approved (7-0) SUP for Mass Gathering Event (Southlake Town Square DT) for Oktoberfest for a period of five (5) years, allowing Senior Director of Planning & Development Services the ability to review conditions and provide revocability at his/her discretion (ZA14-048). Other mass gathering events in Southlake Town Square: • Art in the Square; held annually since May 2000. Current approved SUP is valid in perpetuity. • Stars & Stripes; held annually since October 1999. (5-year approval) PLANNING & ZONING COMMISSION: May 23, 2019; Approved (6-0) in perpetuity subject to the Staff Report dated May 17, 2019 and as presented. STAFF COMMENTS: Due to the limited scope of this request, a staff review summary was not generated. The following items have been discussed with the applicant: • Promotional signage approval and permits by appropriate City staff for the pavilion banner and small directional signs is required; and by the property owner for the banners hung across Main Street; and, TxDOT for the electronic message boards on S.H. 114. • The applicant understands that the small directional signs cannot be placed in the public right of way. The applicant shall pursue permission from the City Engineer to place signs in the median along Carroll Avenue at Federal Way and at Main Street. Pursuant to Section 5.2.5 of Sign Ordinance 704, as amended, permission may be granted by the City for public purposes. These signs are intended to direct traffic to parking areas. • Each year, a current confirmation from the property owner will need to be submitted to the city prior to that year’s event. • Any necessary sign and/or tent permits will need to be renewed annually at least 30 days prior to that year’s event. CARROLL AVENUE, SOUTHLAKE, TEXAS, BEING DESCRIBED AS PHASE I-IV, SOUTHLAKE TOWN SQUARE, MORE FULLY AND COMPLETELY DESCRIBED IN EXHIBIT “A”, AND AS DEPICTED ON THE APPROVED SITE PLAN ATTACHED HERETO AND INCORPORATED HEREIN AS EXHIBIT “B” AND PROVIDING AN EFFECTIVE DATE. WHEREAS, a Specific Use Permit for a mass gathering for Oktoberfest has been requested by a person or corporation having a proprietary interest in the property zoned as “DT” Downtown District; and, WHEREAS, in accordance with the requirements of Section 45.1 (36) of the City’s Comprehensive Zoning Ordinance, the Planning and Zoning Commission and the City Council have given the requisite notices by publication and otherwise, and have afforded the persons interested and situated in the affected area and in the vicinity thereof; and, WHEREAS, the City Council does hereby find and determine that the granting of such Specific Use Permit is in the best interest of the public health, safety, morals and general welfare of the City. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS: SECTION 1. A Specific Use Permit is hereby granted for a mass gathering for Oktoberfest, on property within the City Of Southlake, Texas, located between E. Southlake Boulevard, E. S.H. 114 and N. Carroll Avenue, Southlake, Texas, location being described as Phase I-IV, Southlake Town Square, an addition to the City of Southlake, Tarrant County, Texas, more fully and completely described in Exhibit “A”, and as depicted on the approved Site Plan attached hereto and incorporated herein as Exhibit “B” and providing an effective date, subject to the provisions contained in the comprehensive zoning ordinance and the restrictions set forth herein.
