A-29 (PJRD) (2) \~' " OFFICIAL RECORD CITY OF SOUTHLAKE TEMPORARY CONSTRUCTION EASEMENT _n, ;::>- ; J ,- THE STATE OF TEXAS ~ § § r i ,'¡'¡ COUNTY OF TARRANT .' . , . , C~l --I rq -,...: » (j) - ,'" , ) That PJRD Development Co., Inc., a Texas corporation, GRANTOR herein, for and in consideration of the sum often ($10.00) Dollars and other good and valuable consideration in hand paid by the CITY OF SOUTHLAKE, a home rule municipal corporation in Tarrant County and Denton County, Texas, GRANTEE herein, the receipt and sufficiency of which is hereby acknO\vledged and confessed, do hereby grant, sell and convey to GRANTEE a temporary construction easement for the purpose of water utilities installation on that land in Tarrant/Denton County, Texas, described and shown on Exhibit "A" (the "Property"), said temporary construction easement being immediately adjacent to the Property, and more particularly described and shown on Exhibit "B" attached hereto and incorporated herein. The temporary construction easement shall commence within 90 days following the notice to proceed date given to the contractor on the water line project, and shall tenninate 30 days after completion ofthe water line on GRANTOR's property, except that notwithstanding anything herein to the contrary, if not already terminated, this temporary easement shall tenninate six months following the contractor's commencement of construction on GRANTOR's property. The temporary construction easement shall include the right to excavate and fill upon the temporary easement, but GRANTEE shall replace any fences or other fixtures upon the temporary easement without cost to GRANTOR, and shall restore the property which is subject to the temporary easement as closely as possible to its condition prior to entry thereon. TO HAVE AND TO HOLD the above described temporary construction easement with the right ofingress and egress thereto, together with all and singular the rights and appurtenances thereto in any wise belonging unto GRANTEE, its successors and assigns, for the term described, and GRANTOR does hereby bind itself, its heirs, successors and assigns to warrant and forever defend, all and singular, the said premises unto the GRANTEE, its successors and assigns, against every person whomsoever lawfully claiming or to claim the same or any part thereof. /7 IN WITNESS WHEREOF, this instrument is executed this f-i?/t'Y<:"- , 2004. F. ALLEN SURVEY, Abstract No. 29, Keller, Tarrant County, Texas, and crossing the Tract of land conveyed to PJRD Development Co. by the deed recorded in Volume 12840, Page 616 or the Deed Records of Tarrant County, Texas.
