SB Item 4 - Lone StarCase No. SV18-0009 S T A F F R E P O R T January 11, 2019 CASE NO: SV18-0009 PROJECT: Sign Variance for Lone Star Endoscopy EXECUTIVE SUMMARY: Priority Signs and Graphics, on behalf of Lone Star Endoscopy, is requesting approval of a variance to Sign Ordinance No. 704, as amended, to allow a monument sign to be located at 505 S. Nolen Drive, Southlake, Texas. DETAILS: Lone Star Endoscopy is located along the east side of S. Nolen Drive, generally at the southeast corner of S. Nolen Drive and Silicon Court, behind the Texas Digestive Disease Consultants (TDDC) building. In February 2012, MedCore Realty Group received approval for a sign variance that allowed TDDC to have an attached building sign that exceeded the maximum letter height regulation (SV12-003). A stipulation of the approval prohibited any monument signs on the site. Lone Star Endoscopy is located within the same subdivision as TDDC, however, has limited visibility from S. Nolen Drive. TDDC is not requesting any signage on the proposed Lone Star monument sign. A business monument sign may identify the name of the site or development or may identify the occupants within the site or development. The proposed monument sign meets all other sign ordinance criteria. Nolen Drive (proposed sign location); 515 S. Nolen Drive (Lone Star Endoscopy location) LEGAL DESCRIPTION: Lot 5R1, Block 5, Cornerstone Business Park Addition CURRENT ZONING: “S-P-2” Generalized Site Plan District HISTORY: -A zoning change from “AG” to “O-1” and “I-1” on the west portion of this property as well as a Preliminary Plat were approved by the City in May of 1997. -A Final Plat (ZA97-114) was approved by the City on September 4, 1997. -City Council approved a zoning change (ZA02-018) from “O-1” and “I- 1” to “S-P-2” with “I-1” uses on the western portion of the property and an associated concept plan on July 16, 2002. -A zoning change and concept plan (ZA04-021) from “AG” Agricultural District and “S-P-2” General Site Plan District to “S-P-2” General Site Plan District with “C-2” Local Retail Commercial District and “I-1” Light Industrial District uses was approved by City Council on June 15, 2004. - A plat revision (ZA04-065) was approved by City Council on October 15, 2004. -A zoning change and site plan (ZA10-065) for Lot 5R1 (Texas Digestive Disease Consultants) from “S-P-2” General Site Plan District to “S-P-2” General Site Plan District was approved by City Council on January 18, 2011. -A zoning change and Concept/Site Plan (ZA11-027) for from “S-P-2” General Site Plan District to “S-P-2” General Site Plan District to add 15 parking spaces and to reconfigure driveways on Lots 1R, 2R1R, 3R, 4R and 5R1, Block 5, Cornerstone Business Park. The Concept/Site Plan was revised to remove the shared parking and common access drives that connected Lot 1R with Lot 2R1R on the existing concept plan to create a stand-alone lot. The approved plan allows the development of Lot 1R without installing a drainage pipe and covering the existing ditch. The zoning change was approved by Council on October 18, 2011. -A zoning change and Concept/Site Plan (ZA16-044) for from “S-P-2” General Site Plan District to “S-P-2” General Site Plan District to allow “O-1” Office District uses to include an ambulatory surgery center as a permitted use on Lot 4R and to seek approval of a Concept/Site Plan for an approximately 11,000 square foot, one-story ambulatory surgery center on approximately 1.558 acres was approved September 1, 2016. Case No. Attachment A ZA18-0009 Page 2 -A zoning change and Concept/Site Plan (ZA17-044) for from “S-P-2” General Site Plan District to “S-P-2” General Site Plan District to amend the elevations for the TDDC ambulatory surgery center on Lot 4R was approved August 15, 2017. -A sign variance was approved allowing TDDC and attached building sign with 30 inch letter height. The approval allowed only one attached sign on the building and no monument signs to be located on the site. (SV12-003) STAFF COMMENTS: City Council approval of the request does not eliminate the requirement for an appropriate sign application submittal prior to sign installation. Variance Criteria: 9.6.2 VARIANCES a. Variance Authorized. The City Council may authorize variances to any restriction set forth in this ordinance, including but not limited to the number, type, area, height, or setback of signs, or any other aspect involved in the sign permitting process. b. Approval Standards. In granting any variance, City Council shall consider the following criteria: (i) Special conditions exist which are peculiar to the land, structure or building involved and are not applicable to other lands, buildings or structures in the same zone. The City may attach such conditions to granting all or a portion of any variance necessary to achieve the purpose of this ordinance, and; (ii) The strict interpretation of the provisions of the ordinance would deprive the applicant of rights commonly enjoyed by other properties in the same zone under the terms of the ordinance, and; (iii) The special conditions and circumstances do not result from the actions of the applicant and such conditions and circumstances do not merely constitute pecuniary hardship or inconveniences, and; (iv) Granting the variance will meet the objectives of the ordinance and not be injurious to the adjoining property owners or otherwise detrimental to the public welfare, and; (v) The request will be the minimum variance necessary to alleviate the special hardship or practical difficulties faced by the applicant in meeting the requirements of this ordinance; and; (vi) Granting of the variance will be in harmony with the spirit and purpose of this sign ordinance. (vii) Granting of a variance shall be specific to the subject sign(s). Any modification of the signage approved by the variance or the installation of new or replacement signage that does not Case No. Attachment A ZA18-0009 Page 3 meet the specific requirements of the City Council variance approval is prohibited and will be deemed non-compliant. Application Process. Any request for a variance shall be made to the Administrative Official and be accompanied by a completed application and a non-refundable filing fee in the amount specified in the current fee schedule adopted by City Council. The sign variance will be considered by the City Council following a recommendation by the Sign Board. The Sign Board’s recommendation will be forwarded to the City Council for their consideration.
