Item 8Case No. ZA18-0049 S T A F F R E P O R T December 28, 2018 CASE NO: ZA18-0049 PROJECT: Site Plan for Chick-fil-A Canopies EXECUTIVE SUMMARY: On behalf of Chick-fil-A, Inc., Escencia is requesting approval of a Site Plan for Chick- fil-A to add two canopies over the existing drive-through on property described as Lot 4, Block 1, Perry/Allen Addition, an addition to the City of Southlake, Tarrant County, Texas and located at 2301 E. Southlake Blvd., Southlake, Texas. Current Zoning: “C-3” General Commercial District. SPIN Neighborhood # 8. DETAILS: This project is located at the southeast corner of E. Southlake Blvd. and S. Kimball Ave. The purpose of this request is to seek approval of a Site Plan to allow two freestanding canopies over the existing drive-through lane at Chick-fil-A. The canopy on the west side of the building is proposed to be fabric on a metal frame with a masonry wrap on the columns to match the brick on the building. It will be used for face to face ordering where the store employee goes outside to the vehicle to take orders. The canopy on the east side of the building is proposed to be metal with a masonry wrap on the columns to match the brick on the building. It will be used for meal delivery where the store employee goes outside to deliver orders. Both canopies will include LED lighting, heaters and fans. VARIANCES REQUESTED: The following two variances are requested to the Corridor Overlay District: 1) Zoning Ord. No. 480, as amended, Section 43.9.c.1.b prohibits membrane-type roofs which are visible from adjacent public rights of way. A variance is requested to allow the fabric canopy material as shown on the elevations and material sample board. 2) Zoning Ord. No. 480 (II) Corridor Overlay Zone. Section 43.9.c.1.e requires exposed structural support columns to be constructed of, or clad in, the same masonry material as the principal structure. A variance is requested to allow the top portion of the columns to be metal support columns as shown on the elevations. Southlake Blvd. LEGAL DESCRIPTION: Lot 4, Block 1, Perry/Allen Addition LAND USE CATEGORY: Retail Commercial CURRENT ZONING: “C-3” General Commercial District HISTORY: - On November 2, 1999, City Council approved (7-0) the existing Site Plan, denying the request for an accessory building. (ZA99-087). - A final plat for Lot 4, Block 1, Perry/Allen Addition was filed December 10, 1999 (ZA99-088). - On February 14, 2008, the Zoning Board of Adjustment approved (4-0) a variance to allow an accessory building having a permanent foundation within 5 feet of the property line subject to roof and masonry materials matching the existing Chick-fil-A building (ZBA-537). The Zoning Ordinance requires a minimum 10-foot setback for accessory buildings having a permanent foundation and allows up to a 5-foot setback for accessory buildings on a non-permanent foundation. - A revised site plan to allow a storage building (ZA07-123) was tabled at the March 4, 2008 and April 1, 2008 City Council meetings. - On August 5, 2008, City Council passed Ordinance No. 480-VVV, which included an amendment to allow accessory buildings enclosing equipment or activities in conjunction with the principal uses in zoning districts CS, O- 1, O-2, C-1, C-2, C-3, C-4, HC, B-1, B-2, I-1, I-2 with approval of a Specific Use Permit. (Zoning Ordinance No. 480, Sections 45.1(44) and 45.16). - The revised site plan to allow a storage building (ZA07-123) was withdrawn April 25, 2008 and an application for a Specific Use Permit was submitted. - On October 7, 2008, City Council approved a Specific Use Permit for a storage building (ZA08-082). - On February 19, 2013, City Council approved a Specific Use Permit for a storage building (ZA13-015), granting variances for the roofline on the accessory building and the setback at 5’. Case No. Attachment A ZA18-0049 Page 3 SOUTHLAKE 2030/2035 PLAN Consolidated Land Use Plan The underlying land use designation of this property is “Retail Commercial”. The current restaurant use is within the recommended uses of the Retail Commercial land use designation. Pathways Master Plan & Sidewalk Plan This project is not subject to any sidewalk requirements since the floor area or number of parking spaces is not increasing by twenty (20) percent or more. TRANSPORTATION ASSESSMENT: No changes to the existing driveways are proposed. UTILITIES: No changes to existing City water or sewer service are proposed. TREE PRESERVATION: No trees are to be affected by this project. CITIZEN INPUT/ BOARD REVIEW: A SPIN meeting was held on December 11, 2018. Please see the SPIN report for that meeting. The color of the fabric canopy on sheet G-1 is “Hemp” and the color on sheet A-3 is “Beige”. Please revise the elevations or the material samples so that the color is the same on both sheets. c.
