Special Warranty of Title:
Grantor binds Grantor and Grantor's heirs, executors, administrators, and successors to
warrant and forever defend all and singular the title to the Property Conveyed, together
with, all and singular, the rights and appurtenances thereto in anywise belonging, on
behalf of Grantee and Grantee's successors and assigns forever, against every person
whomsoever lawfully claiming the Property Conveyed or any part or interest therein by,
through or under Grantor, but not otherwise, subject to the Reservations from
Conveyance and Warranty.
Purposes for Conveyance:
The purpose of this conveyance is to allow Grantee full use of the Property Conveyed for
use as a public right-of-way, including use for public roads, streets, and all public and
franchise utilities, including but not limited to water, sanitary sewer, stormwater
drainage. However, this provision shall not limit or restrict Grantee's title or use of the

property for other purposes deemed by Grantee to be consistent with other governmental
and public purposes.
Reservations from Conveyance and Warranty:
Grantor reserves to Grantor, and Grantor's heirs, successors and assigns, and does not
include in this conveyance any of Grantor's interest in any or all of the oil, gas, and other
minerals of every kind located in, on, and under the Property Conveyed, including any
rights, royalty interests and other interests in any existing mineral leases.
Waiver of Right to Use Surface:
Grantor hereby forever waives and releases any and all rights of Grantor, and Grantor's
heirs, successor or assigns, to enter upon or use the surface of the Property Conveyed in
any manner whatsoever. Neither Grantor nor Grantor's heirs, successor or assigns shall
ever explore for, mine for, drill for or otherwise produce the oil, gas or any other minerals
reserved herein from or on the surface of the Property Conveyed; rather, Grantor and
Grantor's heirs, successor or assigns shall have the right to exploit, explore for, develop,
mine, or produce any oil, gas, and other minerals with wells, mines, shafts or excavations
drilled or commenced on the surface of lands other than the Property Conveyed,
including, but not limited to, directional or horizontal wells bottomed beneath or drilled
through any part of the Property Conveyed or by pooling of interests in oil, gas, and other
minerals with lands adjoining the Property Conveyed in accordance with the laws and
regulations of the State of Texas, so long as such activities do not damage the surface of
the Property Conveyed or interfere with the surface or subsurface support of any
improvements constructed or to be constructed on the Property Conveyed.
Acknowledgement and Acceptance of Access Limitations:
Grantor acknowledges that access to Grantor's remaining property shall be subject to
applicable governmental regulations, including but not limited to all city zoning, platting,
public safety, street and roadway design, and permitting ordinances and all Texas
Department of Transportation policies and regulations. Grantor accepts such restrictions
on Grantor's access in the interest of public safety.
Conveyance:
For and in consideration of the sum of Ten Dollars and no cents ($10.00) and for other
good and valuable consideration, the receipt and sufficiency of which are hereby
acknowledged, Grantor does hereby dedicate, assign and convey unto the Grantee, and its
successors and assigns, the Property Conveyed, as described above and in the attached
Exhibit A.
