White Chapel Boulevard, Southlake, Texas. Current Zoning: CS – Community Service Zoning District. SPIN Neighborhood #9. PUBLIC HEARING Staff presented ZA12-006, ZA12-016 and ZA12-017 together. Comments and discussion were made together. Brent Kline, Jacobs & Associates, 3737 Mapleshade Lane, Plano, TX came forward. Mr. Kline stated that the project would be divided into 4 phases and is part of the church’s master plan. Phase 1 is the construction of a new Administration Building and replacement of a portion of the existing building. Phase 2 is the construction of a new Fellowship Hall and the removal of the existing portables. Phase 3 is the construction of the Columbarium and Phase 4 is the addition to the Administration Building in Phase 1. Commissioner Springer asked what the time frame of each phase was. Mr. Kline stated that Phase 1 would start in May 2012 and would last about 6-8 months. Phase 2 would start early 2013 and completed by the end of the year. There is currently not a time frame for the remaining phases. Commissioner Parrish asked how big the columbarium would be. Mr. Kline stated that the columbarium would hold up to 800 cinerary urns with seating areas and water features. Commissioner Springer questioned on whether or not the existing retaining wall would remain and the columbarium would be built up around it. Mr. Kline stated that is correct. Commissioner Springer asked if there would be in lighting on the structure. Mr. Kline stated no. Chairman Faglie asked about the time frame for the columbarium. Mr. Kline stated that a time frame had not been calculated yet. The time frame would be determined by fundraising within the church. Chairman Faglie asked the applicant if they considered tabling the SUP for the columbarium. Greg Standerfer, 1130 N. Carroll Ave, Ste. 100, Southlake came forward. Mr. Standerfer stated that based on the definition of a columbarium and city/state ordinances, Mr. Standerfer doesn’t believe an SUP is required. However, the applicant will agree to table the item for further discussion. This would allow the Site Plan to move forward and the SUP to stand alone at a later date. Dennis Killough stated the Site Plan would move forward and all items under the Site Plan with the exception of the columbarium would be considered. The columbarium, including the placement on the property would be considered with the SUP separately. Mr. Kline and Mr. Standerfer inquired as to whom made the decision that the columbarium needed an SUP and if the City Attorney had aided in that decision. Mr. Killough stated that Ken Baker, Director of Planning and Development Services made the decision to require an SUP and no information was taken forward to the City Attorney. Commissioner Parrish and Commissioner Williamson added that SPIN is a good program for citizen feedback regarding large items such as this. SPIN is also considered a “brain storming” session for both the applicant and staff. Commissioner Hamel asked about the time frame for the sidewalk. Mr. Kline stated that the sidewalk will be done during Phase 2. Commissioner Forman asked if the applicant was aware of the drainage concerns regarding the church’s neighbors to the south. Mr. Kline stated yes. Mr. Kline has spoken with the neighbors and their contractor regarding the drainage. The communication will remain open in order to resolve the drainage issues. Chairman Faglie read aloud the Public Comment Forms: “Do not wish to speak” – opposition. Keith and Lisa Davis, 101 Londonberry Terr.; John Shea, 211 Pine Dr. “Do not wish to speak” – support. Gerald and Connie Montague, 706 Nettleton Dr.; John McKeller, 185 S. White Chapel Blvd.; Connie Robertson, 1225 Ridgewood Cir.; Todd Renner, 1612 Heather Ln.; Dick Rawlins, 3531 Marsh Ln. Cheryl Stewart, 201 Pine Dr., Southlake came forward. Ms. Stewart has communicated with the church regarding the flooding of her property and driveway. Ms. Stewart passed out additional pictures of her property showing the flooding that occurs. Ms. Stewart is opposed to anything else being built on the church’s property until the drainage issues are addressed. Ms. Stewart has personally worked to alleviate some of the flooding but is asking for assistance from the church. Commissioner Parrish and Commissioner Forman asked Staff to clarify the driveway and how many houses the driveway serviced. Mr. Killough stated that the driveway is a concrete utility easement that also serves as an access driveway to 201 Pine Dr. Commissioner Springer asked Ms. Stewart what has been done so far to alleviate the flooding. Ms. Stewart stated that some trenching has been done and installed piping to move the water to the City easement. Commissioner Springer asked Ms. Stewart where she believes the water is coming from, whether it was from the detention pond or the parking lot. Ms. Stewart stated the parking lot. Commissioner Williamson asked Staff what will be the surface percentage change. Daniel Cortez stated 6%. Neil Gigammatteo, 909 S. Main St., Grapevine, Ms. Stewart’s contractor, came forward. Mr. Gigammatteo explained the process he was taking to alleviate some of Ms. Stewart’s flooding. Chairman Faglie asked Mr. Gigammatteo where the pipes were being carried. Mr. Gigammatteo explained that they were being carried across the property to the drainage easement. Commissioner Hudson asked Mr. Gigammatteo to clarify where the water is coming from. Mr. Gigammatteo explained that the majority of the water comes from the main driveway and parking lot. Commissioner Springer asked if they are also putting in any inlets. Mr. Gigammatteo stated yes. Chairman Faglie closed the public hearing. Commissioner Williamson and Commissioner Hudson agreed that the drainage problem shouldn’t affect the Site Plan moving forward and the church has a willingness to assist their neighbors. Chairman Faglie agreed. Commissioner Parrish asked the applicant to clarify where the fence is located that the variance is being requested. Mr. Kline clarified that the fence is located along the southern portion of the property. Mr. Kline added that currently there is a wrought iron fence there with an abundance of vegetation. Commissioner Hudson addressed the Mass Gathering and their request for perpetuity. Commissioner Hudson believes that 3 years is a fair amount of time. Made a motion to approve ZA12-006, the White Chapel’s United Methodist Church Site Plan for the construction of a new Administration Building, addition to the Fellowship Hall, and the area for the Columbarium noting the applicants willingness to table the discussion of the Columbarium until the March 22, 2012 Planning and Zoning Meeting; Also making this motion to grant the variance to Section 39.6.a Screening & Fencing of the City’s Zoning Ordinance for the project sites southern boundary; Granting the variance to Section 43.9.c.1.b Overlay Zones of the City’s Zoning Ordinance; Granting the variance to Section 3.4 Parking Lot Landscape Requirements of the City’s Landscape Ordinance No. 544-B; Subject to the site plan review summary #2, dated February 17, 2012. Motion: Hudson Second: Springer Ayes: Forman, Parrish, Hudson, Springer, Hamel, Williamson and Faglie Nays: None Abstain: None Approved: 7-0 Agenda Item No. 11 - Ordinance No. 1022, Consolidated Future Land Use Plan, a component of the Southlake 2030 Comprehensive Plan. PUBLIC HEARING Daniel Cortez, Planner I, presented Ordinance No. 1022. Chairman Faglie opened the public hearing. Lisa Farnsworth, 1655 Royal Oaks Ct., Southlake, came forward. Ms. Farnsworth expressed concerns regarding the lack of AG use on the map. AG use allows for farming and the reduction of a carbon footprint. Bob Seebeck, 480 W. Highland St., Southlake, came forward. Mr. Seebeck asked for clarification of what RC means. Commissioner Hudson stated that RC stands for Rural Conservation. Mr. Seebeck asked if that area is low density now, will it remain low density. Mr. Killough stated that it is an optional land use designation that allows development and request for zoning that fits in the rural conservation district. It is a zoning category that clusters home sites and preserving larger amounts of open space and conservation area in lieu of a little denser housing. Chairman Faglie closed the public hearing. Commissioner Hudson addressed Ms. Farnsworth’s concerns regarding AG uses. There are uses that are associated with AG that can be done in other zonings. Made a motion to approve Ordinance No.1022, Consolidated Future Land Use Plan, a component of the Southlake 2030 Comprehensive Plan as presented. Amend motion to include a recommended change to the low density residential to the public, semi - public for the entirety of the lot that is currently occupied as the White Chapel’s United Methodist Church.
