In November 2008 White's Chapel UMC signed a mineral rights lease with XTO. The Administrative Board of White's Chapel United Methodist Church has met and adopted a resolution in support of drilling the proposed gas wells on the Milner property. The Administrative Board obviously cannot speak for all the individual members of the church, however the Church Board is in support of all reasonable efforts to recover the minerals under the rights granted to XTO. Ralph Evans, Administrative Board Chairperson January 4, 2011 These comments are submitted to request that the City Council to promptly approve the pending XTO application cited above, related to the Milner drilling site. My wife and I are 17-year residents of Southlake, and we believe that this proposal will benefit the City, CISD, and the residents of our City. We own a rent house at 320 West Highland west of the Milner property, and we reside at 600 Llano Court in Southridge Lakes. I work professionally as an environmental consultant. I attended a number of the early 2008 meetings in which the Council work group developed the City's current gas regulations. In these meetings, our council persons reported on their visits to Barnett well locations in other area cities and their questioning of many responsible people about their experience with Barnett wells and its related production activities. I listened (supportively) as our City repeatedly wrote the most restrictive requirements into our rules. I developed a high level of confidence that this process resulted in a protective local ordinance. Ordinance 880-A wisely provides for frequent and detailed inspections to ensure compliance, with no less than 78 uses of the term to emphasize the City's intention to see the provisions enforced. Further, the Ordinance permits the City to back -charge XTO for its inspection costs, so there should ample resources for the City to carefully oversee these gas operations. Some are publicly urging deferral or rejection of this proposal on a sort of global theme that there may be unknown risks that should be avoided by not granting this permit. For the reasons stated below, I would suggest that the geological unknowns are really quite few and small with respect to Barnett well drilling and production. The major unknown — whether XTO will properly operate the site — has been anticipated and can be well controlled through the Ordinance's inspection and oversight provisions. When any human activity is done repetitively over and over again, the risks associated with the activity become increasingly well understood, and ways of mitigating these uncertainties are developed, implemented, and proven. At this time, give or take, there are more than 14,000 Barnett gas in North Texas, spread across more than 3,000 well locations. The substantive variations in regional geology, reservoir conditions, gas quality, casing and cementing requirements, etc. have all been encountered at this point. The Barnett gas can be accessed and produced safely under our Ordinance, and this was the basis for our City's 2008 Ordinance. Some have recently argued, in particular, that hydraulic fracturing presents unknown or unappreciated environmental risks. However, the technology has been successfully used in over one million wells (including over 14,000 regionally proximate Barnett gas wells) in the 60+ years since it was first developed. The current issue of the Journal of Petroleum Technology contains an excellent summary of the developmental history of hydraulic fracturing. I believe that one reason Tarrant County has not felt the Great Recession to the same degree as the rest of the country is because of the economic benefits related to the Barnett development. These benefits have included local spending by the companies involved, royalties paid to local property owners that have been spent, increased property tax bases, royalties paid to local governments and schools, etc. To appreciate this impact, one only has to look at the potential impact of the proposed Milner site. Using standard assumptions, one can project this single drill site to generate approximately $20 million in future royalties to CISD (lease expiring 3/2/11) and $130 million to other local property owners (including the City). Over time, much of this money will be spent locally and will generate sales tax revenue, and the related property valuation increases will improve local and school property tax revenues. The application requests a Variance from the gas emissions or burning restriction. Coupled with the compression prohibition of Sec. 9.5-243(k), it is unclear that an operator can feasibly perform the testing that is required after a new well is drilled. If this is not possible, then I would ask the City to find a compromise with the applicant that would permit a tightly controlled and enforceable window (some small number of hours, for example) during which this testing can feasibly be performed. We Southlake residents are fortunate to be represented by a Council that is so committed to the future of our City, and councilpersons who are willing to commit so much of their lives to addressing the many issues faced by the City.
