1995-04-20CITY OF SOUTHLAKE JOINT PLANNING AND ZONING COMMISSION AND PARK AND RECREATION BOARD MEETING APRIL 20, 1995 MINUTES Commission Present: Members: Nick McGarity, Randy Arnold, Ernest Johnson, Lanny Tate and Arthur Hobbs. Board Present: Members: Vicki Johnson, Bethann Scratchard, Frank M. Doer, Becci Rollins, and Marjorie Zielke. City Staff Present: Planner, Tom Elgin; Zoning Administrator, Karen Gandy; Park Project Manager, Kim McAdams; Assistant City Manager, Shana Yelverton; and Community Development Secretary, Bobbye Shire. The meeting was called to order by Vice -Chairman Tate at 6:30 p.m. Agenda Item: Adoption of Trail System Master Plan Planning and Zoning Commission Vice -Chairman, Lanny Tate, turned the meeting over to Kim McAdams, Park Project Manager. Ms. McAdams explained that a citizen survey had been conducted and one of the priorities of Southlake citizens was to have a trail system throughout the City. As a result, the urban and development planning firm of Newman, Jackson, Bieberstein, Inc. was hired in October 1994 to work on the Trails Master Plan. Ms. McAdams introduced Karl Bieberstein and Michael Carr. Mr. Bieberstein presented and explained exhibits listing the components of the hike and bike multi- use trail system. These components included off road trails utilizing green space, on street bicycle routes, and equestrian trails. He discussed the Keller and North Richland Hills trail systems and the possibility of connecting these systems to the proposed Southlake trail system. He stressed the system as being a multi -use system to be compatible with bicyclists, pedestrians, tricycles, skateboards, roller blades and pets on leashes. Michael Carr presented exhibits and discussed security/safety issues. He said trail use displaces crime activities, the trail will be 12' wide and will accommodate emergency vehicles and there will be 3' grass shoulders on each side of the 12' of concrete trail. He explained federal highway funded programs such as ISTEA are available to fund approximately 80% of the project. Mr. Bieberstein commented the system would be developed in phases with a breakdown of major priorities. Priorities for construction are 1) portions of the trail system that will not require lengthy land acquisition and which can utilize right-of-way land along major thoroughfares; 2) trails within the Big Bear Creek corridor; 3) trails to be developed in conjunction with implementation of the Thoroughfare Plan; and 4) public and private development of large tracts of land and open space coming on line. g: \wpt\mtg\min\parks. wpd Joint Planning and Zoning Commission and Park and Recreation Board Meeting April 20, 1995 Page 2 Mr. Carr emphasized that this plan is not a final plan. It is a long term project that will require much more input. Ms. McAdams opened the Public Hearing. Larry Samartin, 1211 Timber S., said the City should not consider new trails until it upgrades the old ones; he would like to see the City fix culverts that cause roads to flood instead of considering this plan; when heavy rains occur, Bear Creek floods and carries large debris downstream - cleanup of trails will be substantial; Bear Creek is the only green area left in Southlake and if it is disturbed, the wildlife will be affected; he purchased his property which lies along Bear Creek for its privacy, and he does not want people walking in his back yard; and he believes it is wrong to take private land and turn it into public land and he will fight to keep the City from doing this. Richard W. Ressler, 3320 Crescent Dr., said he purchased his property for its privacy; he commented on the petition signed by every member of three subdivisions who are against this proposed plan and said this should be enough to show that the trail system is not wanted; all who signed the petition will do whatever needs to be done to keep the trail system from coming through their neighborhoods. Pat Nolan, 1207 Timber Ct., said he owns property which backs up to Bear Creek and anyone entering his property from the back cannot be seen from the street, which is a grave safety concern. He is not in favor of connecting the trail systems of neighboring cities. He does not agree with the consultant's comment that crime in Southlake will be reduced with implementation of the trail system since crime is Southlake is already 0%. When Bear Creek floods the creek goes from 30' to 300' wide with two acres being under water which is another major safety concern. Robert Castro, 1209 Timber Ct., is also opposed to people having access to Bear Creek behind his home. To impose this on homeowners by taking private land is wrong and he will fight to keep this from happening. Mike O'Brien, 3360 Hillside Dr., agrees with the concerns voiced by the previous speakers. Mr. O'Brien commented that the City has already purchased West Beach property which has access to the Corps property that could be utilized. He said 65 homes in these neighborhoods do not want this trail system and if 160 citizens don't want it, how can the consultants say it is good for the citizens of Southlake. Adequate notification of these meetings was commented on and the fact that notifications go out with water bills. This causes a problem for citizens who are not on city water to be aware of what is happening. Putting trails along the Corps property will lead to trash on streets and horse trailers being left on streets as the people filter in and out of the trails system area. Another comment made by Mr. O'Brien was the plan will provide a 12' trail to citizens, yet the blacktop street leading to his home is not even 12' wide. g: \wpf\mtg\min\parks. wpd Joint Planning and Zoning Commission and Park and Recreation Board Meeting April 20, 1995 Page 3 Tony Scamardo, 3159 Southlake Park, asked if a soil test has been done. He commented that the soil bogs down after a rain and he is concerned that a concrete trail put on soil that cannot handle it will be a mistake. He also commented on the terminology given by the City of "critical access across his property" and asked what does "critical" mean. Linda Stewart, 2920 Burney, said residents of her neighborhood are already having problems behind their homes with teenagers going onto the Corps property doing whatever it is that teenagers do in secluded areas. To open the area with 12' trails will only elevate problems that are already occurring. She is adamantly opposed to this. Bob Dow, 315 Hilltop, said there are already unimproved trails that can be used. He commented the property behind his home floods regularly and the area should not be opened up and civilized with 12' trails. Diane Packard, 875 Harbor Ct., stated the proposed bike trail will go through her front yard. She does not like this idea as she moved to Southlake to have the open space between homes. She feels all trails should be placed in highly visible areas as a solution to the concerns addressed here tonight. Jim Giffin, 3002 Briar Lane, said he has not heard any objections from citizens other than those along the green area of Bear Creek and along the Corps property. He suggested that the consultants investigate and reconsider certain portions of their proposed plan. John Kelly, 3360 Southlake Park Rd., asked if the police supported this plan and if there was increased budget to allow for more law enforcement and protection, should this plan be implemented. Rodney Clipper, 3240 Crescent Dr., commented the needs of the City need to be reevaluated and if a trail system is needed, the City as a unit should work to find the best possible locations on public property that is available. Parking, restrooms, law enforcement and general maintenance should be considered. Trying to force a plan on citizens who simply do not want it is not in the best interest of the citizens of Southlake. Vice -Chairman, Lanny Tate, advised the Board, Commission and members of the audience that comments from anyone who had not had a chance to speak at this Joint meeting can stay and have the opportunity to voice their concerns at the Planning and Zoning Commission meeting scheduled to begin in a few minutes.
