UNDERGROUND UTILITY EASEMENT DEDICATION

KNOW ALL MEN BY THESE PRESENTS:
That the City of South lake, Texas ("Dedicator"), a municipal corporation located in
Tarrant County, Texas, as the owner of that certain tract of land in Tarrant County, Texas,
described in Exhibit "A" attached hereto and incorporated herein for all purposes of this
dedication, acting through its duly authorized Mayor, Gary Fickes, does hereby dedicate
for the use and benefit of the PUBLIC as a permanent and perpetual easement for the
purpose of installing, repairing, maintaining, altering, replacing, relocating and operating
underground electrical utilities in, upon, across and under that land in Tarrant County,
Texas, described as follows, to-wit: permanent, ten (10) foot underground utility easement
(see attached Exhibit "A" for a metes and bounds description and graphic description),
together with the right of ingress and egress as necessary for such purposes. Said easement
may he used for all purposes to which an underground electrical utility easement is
commonly used, including the right to excavate upon such easement, provided that any
fences, improvements or other fixtures upon said easement shall be replaced and restored
without cost to the City of Southlake or the current owner thereof, and the property shall
he restored as nearly as possible to its condition prior to entry thereon.
TO HAVE AND TO HOLD said easement unto the PUBLIC and Dedicator hereby
binds itself, its successors and assigns, to warrant and forever defend all and singular, said
premises unto the PUBLIC against any person whomsoever lawfully claiming or to claim
the same or any part thereof.
The terms of this dedication shall run with the land and shall be binding upon and
inure to the benefit of the PUBLIC
