Description of Permanent Easement Area: See Exhibit "A" and Exhibit "Boo attached hereto and by reference made a part hereof. Permanent Easement Purpose: The Pennanent Easement is made and accepted for the following purposes: Constructing, reconstructing, repairing, and perpetually maintaining one 24' water line (the "Water Line") upon and across the Pennanent Easement Area; together with the right of Grantee, its agents, employees, workmen and representatives to have ingress and egress upon and across the Pennanent Easement Area for the purpose of constructing, reconstructing, repairing, and maintaining the Water Line or any part thereof. Temporary Easement Purpose: The Temporary Easement is made and accepted, for a period of one year from the date of this instrument, for the following purposes: Constructing the Water Line upon and across the Pennanent Easement Area; together with the right of Grantee, its agents, employees, workmen and representatives to have ingress and egress upon and across the Temporary Easement Area for the purpose of constructing, reconstructing, repairing, and maintaining the Water Line or any part thereof. Conveyance: Grantor conveys to Grantee, for benefit of the public, an easement and right-of-way along, over and under the Pennanent Easement Area, and, for the tenn specified above, over and along the Temporary Easement Area, in each case for the respective purposes pennitted above but none other; TO HAVE AND TO HOLD, unto Grantee, and its pennitted successors and assigns. Grantor binds Grantor and Grantor's heirs executors, administrators, successors and assigns, to warrant and defend title to the Pennanent Easement Area and Temporary Easement Area in favor of Grantee and Grantee's heirs, executors, administrators, successors, and assigns against every person whomsoever lawfully claiming or to claim the same or any part thereof; but this conveyance is made and accepted subject to all encumbrances, covenants, easements and other matters recorded in the Real Property Records of Tarrant County and Denton County, Texas. Terms and Conditions of this Easement: This Easement is made and accepted on the following tenns and conditions: 1 . Grantee shall promptly commence construction of the Water Line, and thereafter Grantee shall diligently prosecute construction to completion. Upon completion of construction, Grantee shall replace any pre-existing fences or other improvements affected by such construction, without cost to Grantor, and shall promptly restore (as closely as possible) the Permanent Easement Area and Temporary Easement Area, and the adjacent land (and all improvements located thereon) to its condition prior to construction. 2. Grantee shall maintain in good condition the Water Line and other facilities associated with the Water Line that are installed in the Permanent Easement Area. 3.
