Subject: Approve a contract with Fugro Consultants, Inc. for construction
materials engineering, testing, and inspection services for the
MARQ Southlake Champions Club and Indoor Courts in an amount
not to exceed $100,000.
Action
Requested: Approve a contract with Fugro Consultants, Inc. for construction
materials engineering, testing, and inspection services for the
MARQ Southlake Champions Club and Indoor Courts in an amount
not to exceed $100,000.
Background
Information: Fugro Consultants, Inc. has provided third party construction
materials engineering, testing, and inspection services for the
MARQ Southlake Champions Club and Tennis Center projects.
The continuity of services is necessary in accordance with Title 10
of the State Government Code. The State Government Code Title
10, Chapter 2269.058(a) requires third party testing services to be
performed as follows: “Contracting and Delivery Procedures for
Construction Projects – Use of Other Professional Services” states:
Independently of the contractor, construction manager-at- risk, or
design-build firm, the governmental entity shall provide or contract
for the construction materials engineering, testing, and inspection
services and the verification testing services necessary for
acceptance of the facility by the governmental entity.”
Previous testing services associated with Champions Club were
underestimated. Additional services are necessary for oversight
during the last part of the project when the contractor begins to
install hardscape (concrete drive approach, concrete curb, concrete
driveway, concrete sidewalks, etc) elements. These work elements
have always been part of the original project.

The additional services will also include observations of pier drilling
and soils samples, concrete tests and inspections during the steel
erection phase of the project.
Financial
Considerations: These services are to be paid from existing contingency funds
within the approved project budgets. This request will not result in
any increases to the respective project’s budget.
Strategic Link: The award of this contract links to the City’s strategy map relative to
the focus areas of Infrastructure. The specific corporate objectives
that are met by this contract are F2 invest to provide and maintain
high quality public assets.
