THE STATE OF TEXAS
That we. Gerald Don Whigham and Joan Whigham, GRANTORs herein, for and in
consideration of the sum of Ten ($10.00) Dollars and other good and valuable
consideration in hand paid by the CITY OF SOUTHLAKE, a home rule municipal
corporation in Tarrant County and Denton County, Texas, GRANTEE herein, the receipt
and sufficiency of which is hereby acknowledged and confessed, do hereby grant, sell and
convey to GRANTEE a temporary construction easement for the purpose of water utilities
installation on that land in Tarrant/Denton County, Texas, described and shown on Exhibit
"A" (the "Property"), said temporary construction easement being immediately adjacent to
the Property, and more particularly described and shown on Exhibit "B" attached hereto
and ìncorporated herein.
The temporary construction easement shall terminate 30 days after completion of the
construction of 42" water distribution line. The temporary construction easement shall
include the right to excavate and fill upon the temporary easement, but GRANTEE shall
replace any fences or other fixtures upon the temporary easement without cost to
GRANTOR, and shall restore the property which is subject to the temporary easement
as closely as possible to its condition prior to entry thereon.
TO HAVE AND TO HOLD the above described temporary construction easement
with the right of ingress and egress thereto, together with all and singular the rights and
appurtenances thereto in anywise belonging unto GRANTEE, its successors and assigns,
for the term described, and GRANTORs does hereby bind himself, his heirs, successors
and assigns to warrant and forever defend, all and singular, the said premises unto the
GRANTEE, its successors and assigns, against every person whomsoever lawfully
claiming or to claim the same or any part thereof,

TEMPORARY CONSTRUCTION EASEMENT
BEING a 50 foot wide strip of land located in the R. F. ALLEN SURVEY,
Abstract No. 29, Kellerr Tarrant CountYr Texas, and crossing the Tract of
land conveyed to Serey S. Teng by the deed recorded in Volume 14646, Page
327 of the Deed Records of Tarrant County, Texas. Said 50 foot wide
strip of land being more particularly described by metes and bounds, as
follows:
BEGINNING at a point in the South boundary line of said Teng Tract! being
located N 880 35' 05" E 40.55 feet, from the Southwest corner of
said Teng Tract;
THENCE NORTHEASTERLY 375.77 feet, along a line 40 feet East of
and parallel to the West boundary line of said Teng Tract, and the
East right-of-way line of U.S. Highway No. 377, with a curve to the
right having a radius of 3,719.30 feet, a central angle of 05047'
16", and a chord bearing N 000 09' 37'1 E 375.61 feet, to a point
in the North boundary line of said Teng Tract;
