Gerald Don Whigham and Joan Whigham, GRANTORs herein, for and in consideration of the sum of Ten ($10.00) Dollars and other good and valuable consideration in hand paid by the CITY OF SOUTHLAKE, a home rule municipal corporation in Tarrant County and Denton County, Texas, GRANTEE herein, the receipt and sufficiency of which is hereby acknowledged and confessed, do hereby grant, sell and convey to GRANTEE a temporary construction easement for the purpose of water utilities installation on that land in Tarrant/Denton County, Texas, described and shown on Exhibit "A" (the "Property"), said temporary construction easement being immediately adjacent to the Property, and more particularly described and shown on Exhibit "B" attached hereto and ìncorporated herein. The temporary construction easement shall terminate 30 days after completion of the construction of 42" water distribution line. The temporary construction easement shall include the right to excavate and fill upon the temporary easement, but GRANTEE shall replace any fences or other fixtures upon the temporary easement without cost to GRANTOR, and shall restore the property which is subject to the temporary easement as closely as possible to its condition prior to entry thereon.
