EXECUTIVE
SUMMARY: James Johnson of Champion Cheer is requesting approval of a Specific Use
Permit for a Commercial school, including trade school to allow a cheerleading
training facility on property located at 375 Commerce Street, Suite 200,
Southlake, Texas. The current zoning is “SP-1”” Detailed Site Plan District.

REQUEST
DETAILS: The subject property in located approximately 760 feet south of the E.
Southlake Blvd. and Commerce Street intersection
The applicant is requesting approval of a Specific Use Permit for a
Commercial school, including trade school to allow a cheerleading training
facility on property located at 375 Commerce Street, Suite 200 in the in
Commerce Business Park. The applicant has requested that the proposed
specific use permit would be tied to the initial 5-year lease with an option for a
5-year renewal of the lease.
The existing commercial building has approximately 31,490 total square feet.
The tenant in Suite 100 of the building is a commercial warehouse with
approximately15,254 square feet (+6,087 sq. ft. office and +9,338 sq. ft.
warehouse). The Suite 200 tenant space is approximately 16,000 square feet,
approximately 13,000 square feet of open space and approximately 3,000
square feet of existing rooms and offices . The applicant will utilize the existing
floor plan from the previous tenant, Jump for Fun. According to the applicant,
the facility will be utilized for training only and will not hold any special events
or competitions at this property. There are 53 existing parking spaces at this
site shared by both tenants.
The applicant has provided the class schedule for the cheerleading training
facility:

Monday- Friday 4:00 pm – 9:30 pm
Saturday 9:00 am – 4:00 pm
Sunday 1:00 pm – 7:00 pm
Busiest hours are 7:00 pm – 8:30 pm weekdays.

Based on the current tenant mix, the site has enough available parking for the
86 students at the peak time of day. The required parking for the facility is 29
spaces.
No variances are being requested with this specific use permit.
45.19 IN CONSIDERING WHETHER TO GRANT A SPECIFIC USE
PERMIT FOR COMMERCIAL SCHOOL, INCLUDING TRADE SCHOOL,
THE CITY COUNCIL SHALL CONSIDER THE FOLLOWING:
1) Safe access for the ingress and egress of students, pedestrian,
parking and vehicular traffic, including the identification of student
drop-off areas.
2) Adequate illumination will be provided at night to protect the safety
of those persons entering and exiting the site.

HISTORY: Commerce Business Park was annexed into the City of Southlake in 1986,
with the Light Industrial Zoning (Ordinance No. 333).
September 2, 1986; a Final Plat for Commerce Business Park was approved
by City Council on.
September 5, 1989; the property was given the “I-1” Light Industrial Zoning
with the adoption of the Zoning Ordinance No. 480 .
March 18, 2008; City Council approved a zoning change and site plan from “I -
1” Light Industrial District to “SP-1” Detailed Site Plan District to add certain
retail uses and limited indoor enterta inment uses to the existing “I-1” light

TRANSPORTATION
ASSESSMENT: Parking Analysis
The existing 31,980 square foot building has 53 parking spaces at this site.
Suite 100 of the building is an approximately 15,425 square foot office (+6,087
sf) and warehouse (+9,338 sf) and will require 31 spaces during business
hours. The proposed cheerleading training facility will be parked according to
the ratio for Business, Trade or Craft School, which requires 1 space per each
3 students in attendance at peak time of day. The classes will be at off-hours
for the existing tenant in Suite 100. The applicant has indicated that there will
be a maximum of 86 students in classes at one time. Based on 86 students at
peak time of day, this tenant requires 29 spaces. Based on the current tenant
mix, the site has enough available parking for 86 students at peak time of day
(7:00 pm – 8:30 pm).
PLANNING AND
ZONING COMMISSION: June 7, 2018; Approved (6-0) subject to the Staff Report dated June, 1, 2018
and the Specific Use Permit review Summary #2 dated June 1, 2018; the term
of the specific use permit shall be tied to a 5 -year lease and tied to a 5-year
lease option; noting the applicant’s willingness to add exterior lighting up to the
limits of the ordinance as appropriate; and also noting the applicant’s

willingness to work with staff for the appropriate wayfinding signage for the
pick-up and drop-off traffic flow.

45.1 GENERAL PROVISIONS - The uses listed in this section are prohibited in the City of Southlake
unless and until a specific use permit is granted for such use by the City Council in accordance with the
requirements and procedures set forth in this Section. A specific use permit shall be required for the
following uses (as amended by Ordinance No. 480-D):
48. Commercial school, including trade school, subject to the requirements set forth in
Section 45.18 protect the residential neighborhoods, in so far as practicable, from the

RESOLUTION NO. 18-021
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTHLAKE,
TEXAS, GRANTING A SPECIFIC USE PERMIT FOR COMMERCIAL
SCHOOL, INCLUDING TRADE SCHOOL ON PROPERTY DESCRIBED AS
LOT 4, COMMERCE BUSINESS PARK ADDITION, CITY OF SOUTHLAKE,
TARRANT COUNTY, TEXAS, LOCATED AT 375 COMMERCE STREET,
SOUTHLAKE, TEXAS. MORE FULLY AND COMPLETELY DESCRIBED IN
EXHIBIT “A”, AND AS DEPICTED ON THE APPROVED PLAN ATTACHED
HERETO AND INCORPORATED HEREIN AS EXHIBIT “B” AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, a Specific Use Permit for commercial school, including trade school has been requested
by a person or corporation having a proprietary interest in the property zoned as “SP-1” Detailed Site Plan
District; and,
WHEREAS, in accordance with the requirements of Sections 45.1(48) and 45.1 8 of the City’s
Comprehensive Zoning Ordinance, the Planning and Zoning Commission and the City Council have given the
requisite notices by publication and otherwise, and have afforded the persons interested and situated in the
affected area and in the vicinity thereof; and,
WHEREAS, the City Council does hereby find and determine that the granting of such Specific Use
Permit is in the best interest of the public health, safety, morals and general welfare of the City.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE,
TEXAS:
SECTION 1.
A Specific Use Permit is hereby granted to allow commercial school, including trade sch ool on property within
the City of Southlake, Texas, more fully and completely described in Exhibit “A”, and as depicted on the
approved plan attached hereto and incorporated herein as Exhibit “B” and providing an effective date, subject
to the provisions contained in the comprehensive zoning ordinance and the restrictions set forth herein. The
following specific requirements and special conditions shall be applicable to the granting of this Specific Use
Permit:
