Item 6DCase No. ZA18-0009 S T A F F R E P O R T June 12, 2018 CASE NO: ZA18-0009 PROJECT: Site Plan for ISIS Papyrus America Pergola EXECUTIVE SUMMARY: Accent Builders Inc., on behalf of the ISIS Papyrus America Inc. is requesting approval of a Site Plan on property described as Lot 10, Block A, Southlake Bank Place Addition, an addition to the City of Southlake, Tarrant County, Southlake, Texas and located at 301 Bank Street, Southlake, Texas. Current Zoning: “C-3” General Commercial District. SPIN Neighborhood #8. DETAILS: The project is generally located in the east side of Bank Street, approximately 400 feet south of E. Southlake Blvd. The purpose of the proposed Site Plan is to allow the construction of an approximately 535 square foot pergola to be used by employees and guests of the existing ISIS Papyrus facility. All proposed work will not encroach upon or change any of the property’s previously approved site plan details. All conditions and elements will remain as previously approved by City Council under City case ZA00-004. VARIANCE REQUESTED: Variance to Corridor Overlay Zone standards under Zoning Ordinance No. 480, Section 43.9.c.1.e: Exposed Columns: Exposed structural columns shall be constructed of, or clad in, the same masonry material as the principal structure. The proposed pergola and columns are constructed of cedar. PROPERTY SITUATION: The property is located at 301 Bank Street LEGAL DESCRIPTION: Lot 10, Block A, Southlake Bank Place Addition LAND USE CATEGORY: Retail Commercial CURRENT ZONING: “C-3” – General Commercial District HISTORY: - A Final Plat was approved March 20, 1984 under Planning Case ZA84-006. - A Plat Revision was approved by City Council on June 16, 1998 under Planning Case ZA98-053. - A Site Plan for ISIS Papyrus was approved by City Council on April 4, 2000 under Planning Case ZA00-004. SOUTHLAKE 2035 PLAN: Consolidated Future Land Use Plan The Southlake 2035 Consolidated Future Land Use Plan designates the subject property as Retail Commercial. The Future Land Use Plan defines Retail Commercial category is a lower- to medium- intensity commercial category providing for neighborhood-type retail shopping facilities and general commercial support activities. It is intended to provide limited local retail and/or office uses which serve neighborhoods in close proximity. It is intended that all uses in this category will be compatible with adjacent single family uses, thereby maintaining the character and integrity of existing neighborhoods. This category is intended to encourage comprehensively planned developments. In areas where the Retail Commercial designation is adjacent to residentially zoned properties or areas with a residential designation on the Land Use Plan, lower intensity activities such as office or office-related uses should be planned adjacent to the residential uses. Other suitable activities are those permitted in the Public Parks/Open Space, Public/Semi-Public, and Office Commercial categories. Mobility Master Plan The proposed project is accessed by Bank Street – a local street. TRANSPORTATION ASSESSMENT: Area Road Network and Conditions There are no additional impacts to traffic with the proposed Case No. Attachment A ZA18-0009 Page 2 development. A traffic impact analysis was not required. TREE PRESERVATION: There are no existing trees proposed to be affected by this project. LANDSCAPE & BUFFERYARDS: Upon recent review, the site was found to be in good condition. The ISIS Papyrus development is required to maintain its approved development landscaping in perpetuity. The Owner shall be responsible for replacing all required plant material which shows dead branching over 75% or more of the normal branching pattern during the time of a normal growing season and repair of irrigation system requirements set herein in perpetuity. Plant materials which die shall be replaced with plant material of similar variety and similar initial size. Upon notification by the City of such replacements, the Owner shall have thirty (30) days to comply with these requirements. CITIZEN INPUT: A SPIN meeting was not held for this project. PLANNING AND ZONING COMMISSION ACTION: June 7, 2018; Approved (6-0) subject to the staff report dated June 1, 2018 and Site Plan Review Summary No. 2, dated May 30, 2018 and granting the variance requested in the staff report. Variance Approval Criteria for Zoning Ordinance No. 480, as amended, Section 43: Variances - At the time of review of any required Concept Plan or Site Plan, the City Council may grant variances to the development regulations set forth in this Section and to Section 35.6, “Number of Off-Street Parking Spaces Required.” A parking space variance can only be at the request of the Owner/Applicant and cannot be required by the City Council as a part of their approval of any Concept Plan, Site Plan, Developer’s Agreement or by any other means. The City Council shall be limited to granting a variance to no more than fifteen percent (15%) of the required number of off-street parking spaces. (As amended by Ordinance No. 480-OOO) 1. To receive a variance, the applicant must demonstrate one of the following: (a) A variance will reduce the impact of the project on surrounding residential properties; or (b) Compliance with this ordinance would impair the architectural design or creativity of the project; or (c) A variance is necessary to assure compatibility with surrounding developed properties; or (d) The proposed construction is an addition to an Case No. Attachment A ZA18-0009 Page 3 existing project that does not meet the requirements of this ordinance.
