PROJECT: Specific Use Permit for Portable Buildings at Carroll Elementary School EXECUTIVE
SUMMARY: On behalf of Carroll I.S.D., Hart, Gaugler & Associates is requesting approval of
a Specific Use Permit for Portable Buildings for Carroll Elementary School on
property described as Lot 1, S.H. Thompson No. 1504 Addition, an addition to
the City of Southlake, Tarrant County, Texas and located at 1705 W.
Continental Blvd., Southlake, Texas. SPIN Neighborhood #10.
DETAILS: Carroll Elementary School is generally located on the south side of W.
Continental Blvd. directly south of the intersection at S. Peytonville Ave.
On May 1, 2018, City Council approved a specific use permit allowing two (2)
portable classroom buildings on the school site to accommodate construction of
additions and renovations to the school campus. During the process of applying
for building permits, modifications to the plan became necessary that include
relocation of two (2) previously approved portable classroom buildings; one (1)
additional portable classroom building; and, two (2) covered walkways. The
purpose of this request is to approve a specific use permit allowing the
modifications as described and as shown on the submitted plans. The school
construction is anticipated to occur from June 2018 to September 2019.
VARIANCE: Ordinance No. 480, as amended, Section 45.20 requires all portable buildings
provide foundation landscape planting consisting of one (1) five-gallon shrub
per four (4) linear feet around skirting (excluding entrances). The applicant is
requesting a waiver regarding this requirement.

BACKGROUND INFORMATION

CURRENT ZONING: “CS” – Community Service District
HISTORY: -A Special Exception Use (ZBA-206) for a portable building was
approved July 28, 1994.
-A Special Exception Use (ZBA-316) to allow up eight (8) to ten (10)
portable buildings was approved March 25, 1999 to expire October 1,
2001.
-A Site Plan for a 600 square foot building addition to the kitchen area
was approved by City Council on March 5, 2002.
-A Site Plan (ZA10-040) for an expansion to the school consisting of
additional library, administration, security, gym and cafeteria space was
approved by City Council on July 20, 2010.
-A Site Plan (ZA10-045) to allow the addition of two playground shade
structures was approved by City Council on August 17, 2010.
-A Plat Showing (ZA10-064) was filed with Tarrant County March 15,
2012.
-A Special Exception Use (ZBA-705) for a portable building was
approved April 14, 2016 to expire at the end of the 2018-2019 school
year. This existing portable building is proposed to be relocated on the
site and fall under the associated request for a Specific Use Permit
under ZA18-034.
-Ordinance No. 480-XXXX, regulations for Portable Buildings under
Section 45 – Specific Use Permit was adopted by City Council in
October 2017.
-A Site Plan (ZA18-033) to allow additions and renovations to the
existing buildings/campus was approved May 1, 2018.
-A Specific Use Permit (ZA18-034) to allow 2 temporary portable
buildings was approved May 1, 2018.
SOUTHLAKE 2030 PLAN: Consolidated Future Land Use Plan
The 2030 future land use designation
for the site is Public/Semi-public and
100-Year Flood Plain.

religious uses, such as government
offices and facilities, public and
private schools, churches and related
facilities (including parsonage and
parochial schools), cemeteries, and

Public Parks/Open Space uses in conjunction with these developments.
The Floodplain category illustrates areas designated by the August
1995 Federal Emergency Management Agency (FEMA) maps as being
in the 100-year floodplain. The “floodplain” is an expanse of natural
vegetation and wildlife, and should be preserved as natural open area.
Within the floodplain is “floodway” that must be kept free of
encroachment in order that the 100-year flood may be carried without
harmful increases in the height of flood waters. Although it is not to be
encouraged, the portion of the floodplain not in the floodway may be
reclaimed for development under certain circumstances if in accordance
with FEMA regulations. The designated land use for areas of reclaimed
floodplain is that of the immediately adjacent land use category. This
designation may also include environmentally sensitive areas, habitats,
or wetlands that may not be in FEMA identified floodplains.
CITIZEN INPUT: A SPIN meeting was held for the previously approved project March 27,
2018. An additional SPIN meeting was not held regarding the proposed
changes.
STAFF COMMENTS: Attached is Specific Use Permit Review Summary No. 1, dated May 25,
2018.
Section 45 Specific Use Permits:
51. Portable buildings not otherwise permitted under this ordinance, subject to the requirements of
45.20.
GENERAL REQUIREMENTS
a. Any use permitted hereunder shall meet the minimum requirements provided in the
district in which it is located.
b. A specific use permit shall automatically expire if a building permit is not issued and
construction begun within six (6) months of the granting of the specific use permit or if the
use shall cease for a period of six (6) months.
45.5 FACTORS TO BE CONSIDERED - In granting or denying an application for a specific use
permit, the City Council shall take into consideration the following factors:
a. Safety of the motoring public and of pedestrians using the facility and the area immediately
surrounding the site.
b. Safety from fire hazard, and measures for fire control.
c. Protection of adjacent property from flood or water damage.
d. Noise producing elements; and glare of vehicular and stationary lights and effect of such
lights on established character of the neighborhood.
e. Location, lighting and type of signs; and relation of signs to traffic control and adverse effect
on adjacent properties.
f. Street size and adequacy of pavement width for traffic and reasonably expected to be

generated by the proposed use around the site and in the immediate neighborhood.
g. Adequacy of parking, as determined by requirements of this chapter for off -street parking
facilities for similar uses; location of ingress and egress points for parking and off -street
loading spaces; and protection of the public health by all-weather surfacing on all parking
areas to control dust.
h. Such other measures as will secure and protect the public health, safety, morals and general
welfare.
i. City Council may grant variances to specific regulations associated with a specific use set forth
in Sections 45. To receive a variance, the applicant must demonstrate one of the following (As
amended by Ordinance No. 480-MMMM):
(a) A variance will reduce the impact of the project on surrounding residential properties; or
(b) Compliance with this ordinance would impair the architectural design or creativity of the
project; or
(c) A variance is necessary to assure compatibility with surrounding developed properties;
or
(d) The proposed construction is an addition to an existing project that does not meet the
requirements of this ordinance.
45.20 SPECIFIC REGULATIONS FOR PORTABLE BUILDINGS NOT OTHERWISE PERMITTED
UNDER THIS ORDINANCE
a. Approval of a portable building shall be on a temporary basis only. Any permit
granted hereunder shall be for a maximum period of three (3) years, unless otherwise
approved by the City Council.
b. All portable buildings shall be constructed in accordance with the appropriate state or
federal code which regulates their construction or shall meet all requirements of the
City's building code.
c. Portable buildings shall:
1) Provide parking in accordance with use of the portable buildings as prescribed
in Section 35 of this ordinance;
2) Be skirted on the front and sides;
3) Provide foundation landscape planting consisting of one (1) five-gallon shrub
per four (4) linear feet around skirting (excluding entrances);
d. Portable buildings shall be maintained in a neat and presentable condition at all
times. Upon expiration of the specific use permit, the portable building shall be
immediately removed and the premises shall be restored to their previous condition.

e. The site plan submitted with the application shall contain a narrative explanation
describing the applicant's plans to transition the portable building to a permanent
structure.
f. Portable buildings may also be subject to other requirements as deemed necessary
in order to promote public health, safety, welfare and aesthetics.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SOUTHLAKE, TEXAS, GRANTING A SPECIFIC USE PERMIT FOR
PORTABLE BUILDINGS FOR CARROLL ELEMENTARY SCHOOL
ON PROPERTY DESCRIBED AS LOT 1, S.H. THOMPSON NO. 1504
ADDITION, AN ADDITION TO THE CITY OF SOUTHLAKE, TARRANT
COUNTY, TEXAS, LOCATED AT 1705 W. CONTINENTAL BLVD.,
SOUTHLAKE, TEXAS. MORE FULLY AND COMPLETELY
DESCRIBED IN EXHIBIT “A”, AND AS DEPICTED ON THE
APPROVED PLAN ATTACHED HERETO AND INCORPORATED
HEREIN AS EXHIBIT “B” AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, a Specific Use Permit for portable buildings has been requested by a person or
corporation having a proprietary interest in the property zoned as “CS” Community Service District;
and,
WHEREAS, in accordance with the requirements of Sections 45.20 of the City’s
Comprehensive Zoning Ordinance, the Planning and Zoning Commission and the City Council have
given the requisite notices by publication and otherwise, and have afforded the persons interested
and situated in the affected area and in the vicinity thereof; and,
WHEREAS, the City Council does hereby find and determine that the granting of such Specific
Use Permit is in the best interest of the public health, safety, morals and general welfare of the City.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
SOUTHLAKE, TEXAS:
SECTION 1.
A Specific Use Permit is hereby granted to allow a church on property within the City Of Southlake,
Texas, more fully and completely described in Exhibit “A”, and as depicted on the approved plan
attached hereto and incorporated herein as Exhibit “B” and providing an effective date, subject to the
provisions contained in the comprehensive zoning ordinance and the restrictions set forth herein. The
following specific requirements and special conditions shall be applicable to the granting of this
Specific Use Permit:
