2018-03-29 ZBA MinutesCITY OF SOUTHLAKE TEXAS ZONING BOARD OF ADJUSTMENT MEETING: March 29, 2018 LOCATION: 1400 Main Street, Southlake, Texas Executive Session -Executive Conference Room, Suite 268 of Town Hall Regular Session -City Council Chambers Time 6:30 P.M. REGULAR SESSION: Members Present: Chairman Jeff Medici, Vice Chairman Ronell Smith Board members: Sabreena Hakemy— Place 3, Brett Nickel— Place 4, Kenny Cotten— Alternate 1, Robert Kemins— Alternate 3 and Michael Quinones— Alternate 4. Members Absent: Gina Phalen— Place 1 and David Treichler— Alternate 3. Staff Present: Richard Schell, Principal Planner, Miranda Aldaco Picklesimer, Board Secretary and Julia Lyon, Board Secretary. Agenda Item No. 1 Call to Order: Chair Medici called the meeting to order at 6:30 P.M. Agenda Item No. 2 Executive Session: No Executive Session was held. Agenda Item No. 3 Approval of the Minutes: Chair Medici opened the discussion of the minutes of the Zoning Board of Adjustment meeting held on February 15, 2018. A motion was made to approve the minutes of the Zoning Board of Adjustment meeting held on February 15, 2018. Motion: Nickel Second: Smith Ayes: Medici, Smith, Hakemy, Nickel, Cotten, Kemins, and Quinones Nays: None Abstain: Vote: 7-0-0 Motion: Approved Agenda Item No. 4 — Administrative Comments: Richard Schell, Principal Planner, announced that the next scheduled ZBA meeting will be on April 12, 2018. REGULAR AGENDA: Agenda Item No. 5 - Consider: ZBA-749, Special Exception Use per Ordinance No. 480, Section 44.12(2) for the construction of accessory buildings or structures of a size or aggregate size greater than that permitted on property described as Lot 5, John Childress No. 254 Addition, an addition to the City of Southlake, Tarrant County, Texas and located at 1501 Burney Ln., Southlake, Texas. Current Zoning: "SF-1A" — Single Family Residential District. This Zoning Board of Adjustment Meeting Minutes — March 29, 2018 Page 1 of 3 item is being administratively tabled to the April 12, 2018 meeting in order to send out corrected public hearing notification letters and a corrected public notice with the correct street address A motion was made to table case ZBA-749 Motion: Kemins Second: Hakemy Ayes: Medici, Smith, Hakemy, Nickel, Cotten Nays: None Abstain: None Vote: 5-0-0 Motion: Case tabled to next meeting, April 12, 2018. Agenda Item No. 6 — ZBA-750, Special Exception Use per Ordinance No. 480, Section 44.12(1) for a domestic employee or family quarters on property described as Lot 4, Block 1, Harrell Place, an addition to the City of Southlake, Tarrant County, Texas and located at 220 Harrell Dr., Southlake, Texas. Current Zoning: "SF-1K — Single Family Residential District. Planner Richard Schell presented details of the case with a slide show presentation to the Board. The applicant is requesting approval of a Special Exception Use per Ordinance No. 480, Section 44.12(1) to allow the construction of an approximately 1,571 square foot domestic employee or family quarters in an addition to the principal residence. Chair Medici opened the public hearing and called upon the applicant or the applicant's representative to make such comments and present evidence as the applicant should desire. Jeff McClasky, a representative of the owner, once sworn in, presented testimony and answered questions from the board. Chair Medici asked if there were those in the audience who wished to speak in favor of the request. There being none, Chair Medici asked if there were those in the audience who wished to speak in opposition of the request. There being none, Chair Medici closed the public hearing and opened the item for discussion from the Board. Chair Medici called the applicant and property owner, Craig Poole, 220 Harrell Dr. to come forward, and once sworn in, Mr. Poole presented testimony and answered questions from the board. A motion was made to approve case ZBA-750 Zoning Board of Adjustment Meeting Minutes — March 29, 2018 Page 2 of 3 Motion: Kemins Second: Smith Ayes: Smith and Cotten Nays: Medici, Hakemy, and Nickel Abstain: None Vote: 2-3-0 Motion: The motion failed to receive the four (4) affirmative votes required for approval and was therefore denied.
