18-013RESOLUTION NO. 18-013 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS, GRANTING A SPECIFIC USE PERMIT FOR A CHURCH ON PROPERTY DESCRIBED AS LOT 1R, BREWER INDUSTRIAL DISTRICT, AN ADDITION TO THE CITY OF SOUTHLAKE, TARRANT COUNTY, TEXAS, LOCATED AT 1800 E. STATE HIGHWAY 114, SOUTHLAKE, TEXAS. MORE FULLY AND COMPLETELY DESCRIBED IN EXHIBIT "A", AND AS DEPICTED ON THE APPROVED PLAN ATTACHED HERETO AND INCORPORATED HEREIN AS EXHIBIT "B" AND PROVIDING AN EFFECTIVE DATE. WHEREAS, a Specific Use Permit for church has been requested by a person or corporation having a proprietary interest in the property zoned as "13-1" Light Industrial District; and, WHEREAS, in accordance with the requirements of Sections 45.1(2) of the City's Comprehensive Zoning Ordinance, the Planning and Zoning Commission and the City Council have given the requisite notices by publication and otherwise, and have afforded the persons interested and situated in the affected area and in the vicinity thereof; and, WHEREAS, the City Council does hereby find and determine that the granting of such Specific Use Permit is in the best interest of the public health, safety, morals and general welfare of the City. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS: SECTION 1. A Specific Use Permit is hereby granted to allow a church on property within the City Of Southlake, Texas, more fully and completely described in Exhibit "A", and as depicted on the approved plan attached hereto and incorporated herein as Exhibit "B" and providing an effective date, subject to the provisions contained in the comprehensive zoning ordinance and the restrictions set forth herein. The following specific requirements and special conditions shall be applicable to the granting of this Specific Use Permit: Resolution No. 18-013 City Council motion: May 1, 2018; Approved (7-0) subject to the Staff Report dated April 26, 2018 and the Specific Use Permit Review Summary No. 2 dated April 13, 2018; noting that the time period of this specific use permit is approved for a period of 5 -years with the option to extend this as long as it is with this specific tenant and that all Fire Department requirements will be addressed; also, noting the applicant will stagger service dismissal times as necessary to minimize conflict with the Gateway Church dismissal times. Currently, our church administrative offices are located at 878 S. Denton Tap Rd, Ste. 100, Coppell, TX 75019 Our Ministry Center (where we hold church services) is located at 5486 Pool Rd, Colleyville, TX 76034 Flourish City Church is at the end of Phase One of a Three Phase Vision Plan. To Replicate — Reproducing a life of Flourishing in others. Flourish City Church had their first church service in November of 2017. Since then it has grown into a vibrant fellowship of over 90 attendees. Our space is maxed out at our current building. In orderto facilitate continued growth and in accordance with our Vision Plan, we require a larger building. We are asking for a Specific Use Permit for the building and property located at 1800 E. Highway 114, #102, Southlake, TX 76092 Phase Two, of our Vision Pian calls for the development of a larger building/space to facilitate our Flourish Young Life (kids/student ministries — 0+29 yrs old); our Flourish Family (adult ministries); our Flourish Finite (specialized ministries); and our Flourish Gather (traditionally, small groups ministries). Whereas, the conversion of the typical commercial building can at times be challenging to re - purpose for the use of a church, the building at 1800 E. Highway 114, #102, Southlake, TX 76092, is an ideal building/space for the use of a church due to it's previous tenant's uncommon use for the building as a food equipment supplier. The current interior configuration has a large area for a 225 to 250 seat sanctuary/auditorium; another space which has an unusual area, having divided smaller rooms next to each other; which we would use for Children's ministries, a large coffee room, which we would use a fellowship area; and administrative offices. Though not a precise physical fit for a church, it has more features than what is usually found. Hours of Operation Currently, we have one service time at our current location, Sunday, at 10:30a—12:00p. At the new building, at 1800 E. Highway 114, #102, Southlake, TX 76092, we will begin with that same day and time. With expected growth, there may be a need to have more than one service. Should that occur, we might decide to add a 9:I5a—10:45a service, change our existing 10:300 —12:00p to 11:00a —12:30, and add another time of, 12:45p — 2:15p, on Sunday. After that, if growth necessitates, then we would add a 4:15p — 5:45p and a 5:00p — 7:30p service on Saturdays. The times we are choosing, should growth necessitate are intentional, as to off -set the adjacent Gateway Church Service Times by 15 minutes after their services begin. Gateway Church's Service Times are Saturdays: 4:00 pm, 5:45 pm, Sundays: 9:00 am, 10:45 am, 12:30 pm. Traffic Flaw and Parking Considerations There are two other tenants occupying a portion of the 1800 E. Hwy 114 building, all of which have a shared parking agreement for the 136 parking spaces. Driven Elite Fitness & Health, the tenant on the west side of the building (approx.13,000 sq. ft.), is a private sports training gym catering to individuals and small groups of sports teams, (M -F, 5:30 am to 8:30 pm, Sat., 8:30 am to 12 pm., closed Sun.). Southlake Sports and Spine is the tenant in the front part of the building, (approx. 2,000 sp. ft.), and sees clients by appointment (M -F, 8 am to 5 pm, closed Sat. and Sun.) Since our operating hours are outside those of other building tenants, as well as adjacent businesses, Laser Care Eye Center (M -F, 8 am to 5:30 pm, closed Sat. and Sun.), and Low T Center (M -F, 8:30 am to 5:00 pm, Sat, 8:30am —12pm, closed Sun.), we anticipate no parking issues. (Adjacent business have 58 additional parking spaces which could be utilized. One business has already approached the owners to negotiate a shared parking agreement.) Highway 114, #102, Southlake, TX 76092. To free up the traffic flow at the intersection of E. Hwy 114 service road and N. Carroll Ave, Gateway Church was involved with the construction an inside lane turnaround bridge leading from the northwest bound service road to the southeast bound service road, which eased congestion. It is expected, at least initially, that Flourish City Church will benefit from Gateway's current traffic flow operation along with their off duty police officers contracted to control traffic. Part of our Vision Plan is to increase development of our existing Flourish City Church Parking and Traffic Flow ministry, which we already have in place at our current building.
