Item 6DCase No. ZA18-035 S T A F F R E P O R T April 10, 2018 CASE NO: ZA18-035 PROJECT: Specific Use Permit for Commercial School, including Trade School at 2820 Market Loop EXECUTIVE SUMMARY: Susan Sampson is requesting approval of a Specific Use Permit for a Commercial school, including trade school to allow the continuation of an existing martial arts academy at this location on property located at 2820 Market Loop, Suite 100, Southlake, Texas. The current zoning is “I -1” Light Industrial District. SPIN Neighborhood #8. REQUEST DETAILS: The applicant is requesting approval of a Specific Use Permit for a Commercial school, including trade school to allow the continuation of an existing martial arts academy located at 2820 Market Loop, Suite 100 in Commerce Business Park. The applicant had previously been approved for a specific use permit for the martial arts academy under Planning Case ZA16 - 019. The applicant has requested that the proposed specific use permit would be tied to the tenant’s lease of 2 years and any additional extensions of the lease. The tenant’s new lease will begin on May 1, 2018. The tenant space is approximately 2,400 square feet of useable space / 2,600 square feet of rentable space. The parking spaces at this site are shared by two approximately 5,900 square foot buildings with multiple tenants. There have not been any issues with the parking associated with this business. The applicant has modified the class size under this specific use permit from 5-10 students per class to 2-15 students per class. Based on 15 students at peak time the school would require 5 spaces . There is a 30 minute overlap for classes two nights a week in the evening at 8:00 pm (not during regular business hours). Based on the current tenant mix, the site has enough available parking for the 45 students at the peak time of day. 45.19 IN CONSIDERING WHETHER TO GRANT A SPECIFIC USE PERMIT FOR COMMERCIAL SCHOOL, INCLUDING TRADE SCHOOL, THE CITY COUNCIL SHALL CONSIDER THE FOLLOWING: 1) Safe access for the ingress and egress of students, pedestrian, parking and vehicular traffic, including the identification of student drop-off areas. 2) Adequate illumination will be provided at night to protect the safety of those persons entering and exiting the site. LAND USE CATEGORY: Industrial CURRENT ZONING: “I-1” Light Industrial District HISTORY: Commerce Business Park was annexed into the City of Southlake in 1986, with the Light Industrial Zoning (Ordinance No. 333). September 2, 1986; a Final Plat for Commerce Business Park was approved by City Council on. September 5, 1989; the property was given the “I-1” Light Industrial Zoning with the adoption of the Zoning Ordinance No. 480 . According to TAD, the building located at 2820 Market Loop was constructed in 1996. April 19, 2016; City Council approved a Specific Use Permit for a Commercial school, including trade school for a proposed martial arts academy for a period of two years. (ZA16-019) CITIZEN INPUT: A SPIN Town Hall Forum was not requested for this proposal TRANSPORTATION ASSESSMENT: Parking Analysis Two approximately 5,900 square foot buildings share the parking spaces at this site. There are 38 spaces, including 2 handicap spaces and 3 no parking spaces for the entire building site. T he narrative mentions that the parking spaces at the front doors of each building have been designated “No Parking” in order to assist handicap van parking, along with drop off and pick up. The proposed martial arts academy is parked according to the ratio for Business, Trade or Craft School, which requires 1 space per each 3 students in attendance at peak time of day. The applicant has indicat ed that there will be only 1 class at a time with 2-15 students (previously 5-10 students) per class. Based on 15 students at peak time of day, this tenant requires 5 spaces. There is a 30 minute overlap for classes two nights a week in the evening at 8:00 pm (not during regular business hours). Based on the current tenant mix, the site has enough available parking for 45 studen ts at peak time of day. MORE FULLY AND COMPLETELY DESCRIBED IN EXHIBIT “A”, AND AS DEPICTED ON THE APPROVED PLAN ATTACHED HERETO AND INCORPORATED HEREIN AS EXHIBIT “B” AND PROVIDING AN EFFECTIVE DATE. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS: SECTION 1. A Specific Use Permit is hereby granted to allow commercial school, including trade school on property within the City Of Southlake, Texas, more fully and completely described in Exhibit “A”, and as depicted on the approved plan attached hereto and incorporated herein as Exhibit “B” and providing an effective date, subject to the provisions contained in the comprehensive zoning ordinance and the restrictions set forth herein.
