Subject: Award a construction contract for Whispering Lane and
Whispering Dell Court Water Distribution System
Improvements project to Wildstone Construction, LLC in an
amount not to exceed $580,000.
Action
Requested: Award a construction contract for Whispering Lane and
Whispering Dell Court Water Distribution System Improvements
project to Wildstone Construction, LLC in an amount not to
exceed $580,000.
Background: Whispering Lane and Whispering Dell Court Water Distribution
System Improvements are located in the Whispering Dell Estates
subdivision. The improvements entail waterline replacement
including all its appurtenances as well as complete pavement
rehabilitation. Whispering Dell Estates is an older development
with an aging water system that requires frequent repair and
maintenance. The paving rehabilitation will repair existing
deficiencies and provide a clean end product so there is no
patching as a result of the waterline replacement.
Two (2) bids were received on Tuesday, February 13, 2018. The
bids have been reviewed by Baird, Hampton & Brown, Inc. and
City Staff. The BHB Opinion of Probable Construction Cost was
$546,600.00. Below are the bid tabulations:

Wildstone Construction, LLC $553,017.00
TexGlobal Contractors, Inc.** $464,009.40
**TexGlobal Contractors, Inc. did not provide the best value
criteria (key personnel, similar projects, and references) required
by the contract documents. Thus, their best value score was
substantially lower than Wildstone Construction, LLC

The recommended contract award amount for the base bid is
$580,000. This award amount is within budget. All work
associated with this project must be complete, by contract, in less
than 120 working days once notice to proceed has been given.
Financial
Considerations: Funding for this contract has been allocated through the FY 2016
and FY 2018 Water Impact Fee and General Fund Residuals.
Strategic Link: This item relates to the City’s strategy map focus areas of
Infrastructure. The specific corporate objective that is met by
this project is to (F2) Invest to provide and maintain quality public
assets.

Best Value evaluation and recommended Contractor
Mr. Flint:
Following the opening of the two proposals received for the above referenced project at 10 AM Tuesday,
February 13, 2018 with the City of Southlake, BHB tabulated bids, reviewed contractor and subcontractor
qualifications, and checked contractor and subcontractor references.
The City specified that the contractor would be selected based on Best Value,with the following weighted
criteria: 50% Purchase Price (bid price)
15% Reputation of Bidder and Key Personnel
15% Reputation of Work and Product Quality
10% Relationship with City of Southlake
10% Responsiveness
A detailed tabulation of bid prices is enclosed. Bid tabulations are summarized as follows:
BHB Opinion of Probable Construction Cost $ 546,600.00 OPCC
Wildstone Construction, LLC $ 553,017.00 101%ofOPCC
TexGlobal Contractors, Inc. $464,009.40* 85%of OPCC
*Note that a discrepancy between the unit price in words and the unit price in figures for bid item#10 in TexGlobal's bid worksheet
resulted in a$1,608.00 reduction in the bid price,compared to what was read out during the proposal opening.
To evaluate the reputation of the bidder, key personnel, work, and product quality,the Notice to Bidders
required a list of at least five similar, completed projects. Results of BHB's investigation of qualifications and
references for each contractor are as follows:
1. Wildstone provided references for more than five similar, completed projects, including two projects
that BHB designed. Feedback was universally very positive from three municipalities having experience
with Wildstone and/or its subcontractor PaveCon. The BHB engineering project manager also reported
a good experience with Wildstone. The municipalities reported that the infrastructure Wildstone and/or
PaveCon constructed 2-4 years ago is in good working order,and no issues have arisen since the
infrastructure was placed in service.

2. TexGlobal stated in its proposal that the company was formed in March 2017,described one project
that is currently in construction, and provided no contacts for references. Despite the lack of
information, I thought it was in Southlake's best interest to thoroughly evaluate the proposal with the
most favorable bid price, which might ultimately result in the best value to the City. Among my
resources, I spoke with one person with municipal oversight responsibility for the project TexGlobal
described in its proposal,from which I learned the water line portion is complete and in service. I also
spoke with two other people familiar with the key personnel listed. Half of the feedback was positive.
I understand from our conversation between myself and City of Southlake staff after the proposal opening,that
the City has not been engaged in any contract with either Wildstone or TexGlobal. Wildstone is believed to have
done other construction within city limits with no known issues.
Based on these figures and findings, and excluding the 10%factor of contractor relationship with the City, BHB's
contribution to the Best Value evaluation is summarized here:

A copy of the Best Value worksheet is enclosed for your reference. I did not attribute a final score,assuming the
City would normally perform further evaluation. However,TexGlobal's lack of similar, completed projects is a
shortcoming I believe they cannot overcome,even if they had all positive references. Further,the City would
likely be justified if it rejected TexGlobal's proposal for not meeting the requirement in the Notice to Bidders
regarding evidence of having completed similar work.
The information Wildstone included in its packet indicates completion of 12-15 projects in each of the past two
years, and 7-8 projects in each of the two years prior. Wildstone is based in Fort Worth,TX, with a bonding
capacity exceeding$10 million. Wildstone's proposed paving subcontractor PaveCon is headquartered in Grand
Prairie,TX,and provided a list of eight municipal projects with contract value up to $5 million. BHB therefore
recommends Wildstone Construction, LLC for the Water and Paving Improvements-Whispering Lane&
Whispering Dell Court construction project.
As written, the contract documents stipulate that the City is responsible for testing,for which we anticipate
$10k±in additional expenses. Furthermore, the potential for change orders is always present and we typically
suggest budgeting 5%to 10%for this possibility. BHB recommends the total construction budget be set at
minimum $590,700, up to$ 618,300, depending on the City's preference for availability of contingency funds.
