Mayor Hill announced the City Council would go into Executive Session pursuant to the
Open Meetings Act, Chapter 551, Texas Government Code, Sections 551.071
consultation with city attorney. City Council adjourned at 5:45pm.
Executive Session was not called to order. Council took a short break.

Due to the time being prior to the 7:00pm Public Forum posting, agenda items
were taken out of order. Mayor proceeded to Items 6A, 6B, and 6C, then back to
Public Forum at 7:40pm. After Public Forum, Mayor Hill continued items in order,

5. PUBLIC FORUM –
Mr Daniel Bennett, resident of White Settlement, thanked Councilmembers for their
votes cast for his appointment to the Tarrant County Appraisal District Board of
Directors and appreciated comments made at the December 5th City Council meeting.
Mr Horn addressed Council regarding the growth and future of the City of Southlake in
preparing for the needs and wants of the next gene ration.

to the City’s impact fee ordinance, subject to the Staff Report dated February 20, 2018,
noting that there is no change to the City’s current land use assumption report; the
roadway projects presented this evening which include the State Highway 114 frontage
road between Dove Road and Kirkwood Blvd. and the roadway intersection capacity
improvements will be included as listed projects in the 10-year impact fee capital
improvements program; and maintaining the current roadway impact fee rates.

Motion was made to approve Item 6C, Resolution No. 18-005, ZA18-003, Specific Use
Permit Outdoor Sales or Services for the Drunken Cow, subject to the Staff Report
dated February 13, 2018, noting the following:
- The approval of this SUP is for a period of one (1) year; and
- With the following stipulations:
o Council is not requiring any parking signage; and
o Council is not requiring a porta potty on site; however noting that the
applicant’s agreement with Yates Corner Grocery for employees to use
restroom facilities at the grocery store; and
o Council is not approving the requested advertising banner; and
o Council is approving Option 1, noting the applicant has agreed to move the
trailer to Option 2 at the City’s request; and
o The applicant is committed to appropriately servicing the trash receptacles
per an agreement with Yates Corner Grocery; and
o Noting the applicant has access to the property seven days per week;
however open for business and sales between Wednesdays and Sundays,

No. 3 dated February 6, 2018, and noting the following:
- Council is approving the variance to Driveway Ordinance No. 634, as amended,
Section 5.1 requires a minimum spacing of 250 feet between driveway centerlines
on an arterial. The applicant is requesting a spacing distance of approximately 176
feet between the proposed driveway centerline and the existing driveway center line
to the north be allowed in order to align the proposed driveway with the existing
driveway across South Nolen Drive; and
- Noting with respect to the site distance to the north from the proposed driveway that
the same condition of approval from the previous rezoning request be placed on this
application which required the applicant to attempt to reach an agreement with the
property owner to the north to remove whatever vegetation is necessary to provide a
clear line of site; and
- Noting absent an agreement with the adjacent property owner to the north to provide
a clear line of sight in perpetuity, subject to the concurrence of the Public Works
Director, it is recommend that the driveway be designed as a right turn out only.
- Also noting that Public Works will work with the applicant to determine the safest
ingress/egress according to the sight line distance provided.

Motion was made to approve Item 7A, Ordinance No. 480-730, ZA17-064, 1st Reading,
Zoning Change and Development Plan for Stony Brook, subject to the Staff Report
dated February 13, 2018, and Development Plan Review Summary No. 8 dated
February 13, 2018, noting the following variance approvals and modifications to
Subdivision Ord. No. 483 as requested:
1) Subdivision Ordinance No. 483, as amended, Section 5.04 does not permit private
streets in new subdivisions in which less than 75% of the lots contain homeowner
occupied structures. The applicant is requesting a variance to allow a gated
community with private streets with the initial development of the subdivision.
Council is granting this variance.
2) Subdivision Ordinance No. 483, as amended, Section 5.03.I - Generally, a maximum
number of twenty (20) dwelling units should be permitted on a cul -de-sac street
permanently designed as such. Additionally, the length of the Cul-de-Sac should
not exceed 1,000 feet or be less than 150 feet in length. This proposed plan does
not meet the intent of the regulation; however, noting that a secondary emergency
only access to the subdivision has been provided. Council is granting this variance.
3) Subdivision Ordinance No. 483, as amended, Section 5.03.K states that dead end
streets shall be permitted only where a future extension or connection is to be made.
The applicant has removed the connection to the street stub to the Siena subdivis ion
to the south. Council is granting this variance.
- Also noting the applicant’s willingness to address the stacking distance issues on
egress and ingress as it relates to where the gate is positioned and will come to 2 nd
Reading with an option or options for City Council to consider,
- And then noting that Council would be directing staff that in order for the applicant to
obtain a first lot certificate of occupancy, they’ll be required to have completed the open
space and water features prior to that issuance of a CO.
