Southlake Blvd., Southlake, Texas. Current Zoning: “DT” Downtown District. SPIN Neighborhood #8. DETAILS: The subject property is located adjacent to Jared’s Jewelry store and Which Wich on the northeast corner of E. Southlake Blvd. and Central Avenue. The purpose of this item is obtain approval for a renewal of the existing specific use permit for The Ginger Man to continue operating as a bar or tavern at its current location. No other changes to the operation and/or building are proposed. The current specific use permit is due to expire March 31, 2018. Southlake Blvd., Southlake, Texas LEGAL DESCRIPTION: Lot 3R, Block 22, Southlake Town Square Addition LAND USE CATEGORY: Town Center CURRENT ZONING: DT – Downtown District HISTORY: January 15, 2008, (ZA07-161) Specific Use Permit approved by City Council for The Wine Loft. May 1, 2012; City Council approved Specific Use Permit for The Ginger Man pursuant to the staff report dated April 25, 2012 and the Planning & Zoning Commission’s recommendation for approval tied to the term of the lease which is seven (7) years. (ZA12-024) Expiration date – March 31, 2018. COMMUNITY INPUT: A SPIN meeting is scheduled for February 27, 2018. STAFF COMMENTS: The Planning & Zoning Commission and City Council shall consider the following in determining whether to grant a Specific Use Permit for a Bar or Tavern according to the Comprehensive Zoning Ordinance No. 480, Sections 4, 45.1 and 45.5, as amended: BAR OR TAVERN - An establishment that derives 75 percent or more of the establishment’s gross revenue from the on-premise sale of alcoholic beverages. (As amended by Ordinance No. 480-OOO) is required to operate under a City Council approved Specific Use Permit. 45.5 FACTORS TO BE CONSIDERED - In granting or denying an application for a specific use permit, the City Council shall take into consideration the following factors: a. Safety of the motoring public and of pedestrians using the facility and the area immediately surrounding the site. b. Safety from fire hazard, and measures for fire control. c. Protection of adjacent property from flood or water damage. d. Noise producing elements; and glare of vehicular and stationary lights and effect of such lights on established character of the neighborhood. e. Location, lighting and type of signs; and relation of signs to traffic control and adverse effect on adjacent properties. f. Street size and adequacy of pavement width for traffic and reasonably expected to be generated by the proposed use around the site and in the immediate neighborhood. Adequacy of parking, as determined by requirements of this chapter for off-street parking facilities for similar uses; location of ingress and egress points for parking and off-street loading spaces; and protection of the public health by all weather surfacing on all parking areas to control dust. h. Such other measures as will secure and protect the public health, safety, morals and general welfare. i. City Council may grant variances to specific regulations associated with a specific use set forth in Sections 45. To receive a variance, the applicant must demonstrate one of the following (As amended by Ordinance No. 480-MMMM): a. A variance will reduce the impact of the project on surrounding residential properties; or b. Compliance with this ordinance would impair the architectural design or creativity of the project; or c. A variance is necessary to assure compatibility with surrounding developed properties; or d. The proposed construction is an addition to an existing project that does not meet the requirements of this ordinance.
