ZA13-037 and ZA15-145 S T A F F R E P O R T January 30, 2018 CASE NO: ZA13-037 and ZA15-145 PROJECT: Variance to extend plat validity – Preliminary Plat for Southlake Meadows (formerly Savannah Estates) and Plat Revision for Southlake Meadows (formerly Savannah Estates) Phase II EXECUTIVE SUMMARY: G&A Consultants, LLC is requesting approval of a Variance to the Subdivision Ordinance No. 483, Section 4.01(l), as amended, regarding plat expiration, requesting to extend the validity of cases ZA13 -037, Preliminary Plat for Southlake Meadows (formerly Savannah Estates) and ZA15-145, Plat Revision for Southlake Meadows (formerly Savannah Estates) Phase II on property generally located at the northwest corner of W. Dove Rd. and W. S.H. 114, Southlake, Tarrant County, Texas. Current Zoning: R-PUD – Residential Planned Unit Development. SPIN Neighborhood #5. DETAILS: The property is generally located at the northwest corner of W. Dove Rd. and W. S.H. 114 and it includes the previously platted properties in Southlak e Meadows Phase I and the property to the north of Phase I that comprises the area to be platted in Phase II. G&A Consultants, LLC is requesting approval of a Variance to extend the validity of the Preliminary Plat for Southlake Meadows (formerly Savannah Estates) and a Plat Revision for Southlake Meadows (formerly Savannah Estates) Phase II. The current expiration date for the Preliminary Plat and the Plat Revision for Phase II is January 19, 2018. The applicant is requesting to extend the validity of the plats for an additional three (3) months to April 19, 2018 to finish construction of the sidewalks and accessibility ramps and other minor improvements and to file the Plat Revision for Phase II with Tarrant County. Subdivision Ordinance No. 483, as a mended, Section 4.01(I)(1) states that a Preliminary Plat shall expire two years from the date of approval. Said expiration date shall be extended one year from the latest date of of filing a Final Plat on a portion of said Preliminary Plat in the County Plat Records. In this case, a Plat Revision is required in place of a Final Plat since a portion of the property was previously platted as the R.P Estes Addition in 1947 prior to annexation by the City of Southlake. The Preliminay Plat was approved June 4, 2013 and a Plat Revision for a portion of the property was not filed within a two years of that date, so the Preliminay Plat expired on June 4, 2015. On January 19, 2016, City Council approved a Variance to extend the validity of the plat for one year to January 19, 2017. The Plat Revision for Southlake Meadows Phase I was filed on September 2, 2016, which extended the expiration date of the Preliminary Plat for one additional year to January 19, 2018. The Plat Department of Planning & Development Services Case Nos. ZA13-037 and ZA15-145 Revision for Southlake Meadows Phase II has n ot been filed with the County and the Preliminary Plat has expired. Subdivision Ordinance No. 483, as amended, Section 4.01(I)(2) states that a Plat Revision which has not been recorded in the County Plat Records within one year of the date of approval shall expire. The Plat Revision for Southlake Meadows Phase II, which includes thirty-six (36) residential lots on approximately 19.804 acres, was approved by the City Council on February 16, 2016 and it was set to expire February 16, 2017, which was one year after the date of approval. On January 19, 2017, City Council approved a Plat Extension to extend the validity of the plat for one year to January 19, 2018. The Plat Revision for the second phase of this development has not been recorded due to continuing construction of the development and it has thus expired. Plat Revisions for subdivisions requiring the installation of streets and utilities are typically not recorded until these improvements have been installed and are ready to be accepted by the City. This ensures that street rights-of-way and easements are correctly shown based on as-built conditions and also ensures that all the new lots of record are properly served by streets and utilities. To summarize, a Variance is requested to extend the validity of the Preliminary Plat and the Plat Revision for three (3) months to April 19, 2018. The applicant has indicated that construction will be completed on Phase II and that the Plat Revision for Phase II will be filed with the County within the three (3) month time period requested. The filing of the Phase II plat will close out both phases included in the original Preliminary Plat. A separate Preliminary Plat was approved for Southlake Meadows Phase III. LAND USE CATEGORY: Medium Density Residential CURRENT ZONING: “R-PUD” Residential Planned Unit Development District HISTORY: A plat for RP Estes Subdivision was filed with Tarrant County prior to annexation on a portion of the property; A portion of the property was annexed into the City of Southlake in 1985 and another portion of the property was annexed in 1987 ; A portion of the property was zoned “NR -PUD” with the adoption of Ordinances 334 and 480; A Zoning Change and Site Plan (ZA09 -062) from “AG” – Agricultural District to “S-P-1” – Detailed Site Plan District with limited O-1 and limited I-1 uses was approved by the City Council on one of the subject properties (2411 Sam School Road) on May 10, 2011. A Land Use Plan Amendment from Low Density Residential and Mixed Use to Medium Density Residential was approved by City Council March 5, 2013. A Zoning Change and Development Plan (ZA12-088) for Southlake Meadows from “NR-PUD” Non Residential Planned Unit Development, “AG” Agricultural District and “S-P-1” Detailed Site Plan District to “R-PUD” Residential Planned Unit Development District was approved by City Council on March 5, 2013. A Preliminary Plat (ZA13-037) for Southlake Meadows was approved June 4, 2013. The plat expired two years later on June 4, 2015.
