SB SV18-001 Hand and Wrist InstituteCase No. SV18-001 S T A F F R E P O R T February 2, 2018 CASE NO: SV18-001 PROJECT: Sign Variance for The Hand and Wrist Institute EXECUTIVE SUMMARY: On behalf of The Hand and Wrist Institute, Priority Signs and Graphics is requesting approval of a variance to Sign Ordinance No. 704, as amended, to allow an attached building sign to be located on a façade that does not correlate with the tenant’s lease space. The Hand and Wrist Institute is located at 510 E. Southlake Blvd., Suite 140, Southlake, Texas. REQUEST DETAILS: The Hand and Wrist Institute is located in the Southlake Villas development on the north side of East Southlake Blvd., approximately 480 feet west of Diamond Blvd. The newly constructed building is occupied by two (2) tenants. The Hand and Wrist Institute is occupying the space on the north side and Southlake Family Eye Care on the south side. Southlake Family Eye Care has an existing attached sign on the southwest façade of the building. The applicant is requesting to use the southeast façade of the building for their sign in an effort to gain visibility from Southlake Blvd. The proposed sign meets all other sign ordinance criteria regarding size and letter type and these are proposed to be the only two attached signs on the building. The details of the sign variances requested are as follows: Sign Regulation Permitted by Sign Ord. Southlake Blvd., Suite 140, Southlake, Texas. LEGAL DESCRIPTION: Lot 7, Block 1, WW Hall No. 687 Addition CURRENT ZONING: S-P-1 – Detailed Site Plan District HISTORY: The Southlake Villas development was originally approved by City Council on March 18, 2008. (ZA07-129) November 3, 2009, City Council approved an amendment to the Southlake Villas zoning/site plan which allowed a change to the original approved request for the finish out of the attic space creating a 3rd floor to Building 1 at the southeast corner of the lot. (ZA09-046) January 6, 2015, City Council approved an amendment to the Southlake Villas zoning/site plan subject to the staff report dated November 24, 2014 and granting the variance to the driveway ordinance and accepting the drawings as presented for the elevations; including the revised list of uses; noting that the compounding pharmacy, if developed, will only be allowed in Building ‘B’ and will only use 50% of the square footage of that building; noting that the 8 to 10 foot reference is only pertaining to the canopy trees; and including the revised development regulations noting the hours of operation and clarifying that those hours are the hours open to conduct business and not the hours the business owner may use his/her space. (ZA14-082) A single-lot plat showing was processed and filed September 21, 2015. (ZA14-087) A zoning change and site plan proposal was withdrawn in January 2018. (ZA17-098) A sign permit was issued for Southlake Family Eye Care in April 2017. STAFF COMMENTS: City Council approval of the request does not eliminate the requirement for a sign application submittal prior to sign installation. Variance Criteria: 9.6.2 VARIANCES a. Variance Authorized. The City Council may authorize variances to any restriction set forth in this ordinance, including but not limited to the number, type, area, height, or setback of signs, or any other aspect involved in the sign permitting process. Case No. Attachment A SV18-001 Page 2 b. Approval Standards. In granting any variance, City Council shall consider the following criteria: (i) Special conditions exist which are peculiar to the land, structure or building involved and are not applicable to other lands, buildings or structures in the same zone. The City may attach such conditions to granting all or a portion of any variance necessary to achieve the purpose of this ordinance, and; (ii) The strict interpretation of the provisions of the ordinance would deprive the applicant of rights commonly enjoyed by other properties in the same zone under the terms of the ordinance, and; (iii) The special conditions and circumstances do not result from the actions of the applicant and such conditions and circumstances do not merely constitute pecuniary hardship or inconveniences, and; (iv) Granting the variance will meet the objectives of the ordinance and not be injurious to the adjoining property owners or otherwise detrimental to the public welfare, and; (v) The request will be the minimum variance necessary to alleviate the special hardship or practical difficulties faced by the applicant in meeting the requirements of this ordinance; and; (vi) Granting of the variance will be in harmony with the spirit and purpose of this sign ordinance. (vii) Granting of a variance shall be specific to the subject sign(s). Any modification of the signage approved by the variance or the installation of new or replacement signage that does not meet the specific requirements of the City Council variance approval is prohibited and will be deemed non-compliant. Application Process. Any request for a variance shall be made to the Administrative Official and be accompanied by a completed application and a non-refundable filing fee in the amount specified in the current fee schedule adopted by City Council. The sign variance will be considered by the City Council following a recommendation by the Sign Board. The Sign Board’s recommendation will be forwarded to the City Council for their consideration.
