REGULAR SESSION: Members Present: Chairman Jeff Medici, Board members: Gina Phalen — Place 1, Sabreena Hakemy — Place 3, Brett Nickel — Place 4, Kenny Cotten — Alternate 1, David Treichler — Alternate 3, and Michael Quinones — Alternate 4. Members Absent: Board members: Vice Chair Ronell Smith and Robert Kemins — Alternate 2 Staff Present: Dennis Killough, Deputy Director of Planning & Development Services, Richard Schell, Principal Planner, and Karen Heistand, Board Secretary. Agenda Item No. 1 Call to Order: Chair Medici called the meeting to order at 6:30 P.M. Agenda Item No. 2 Executive Session: No Executive Session was held. Agenda Item No. 3 — Approval of the Minutes: Chair Medici opened the discussion of the minutes of the Zoning Board of Adjustment meeting held on September 14, 2017. A motion was made to approve the minutes of the Zoning Board of Adjustment meeting held on September 14, 2017. Motion: Treichler Second: Nickel Ayes: Medici, Hakemy, Nickel, Cotton, and Treichler Nays: None Abstain: Quinones, Phalen Vote: 5-0-2 Motion: Approved Agenda Item No. 4 — Administrative Comments: Richard Schell, Principal Planner, announced that the next scheduled ZBA meeting is November 30, 2017. REGULAR AGENDA: Agenda Item No. 5 - ZBA-734, Variance to Ordinance No. 480, Section 33.14, requiring a minimum lot size of one acre for an on -site sewage facility (OSSF) on property described as Tracts 2A3A, 2A3A1, 2A3B, 2A3 and 2A5, William H. Martin Survey, Abstract No. 1068, City of Southlake, Tarrant County, Texas and located at 208 Randol Mill Ave. and 1719 and 1825 Maranatha Way, southlake, Texas. Current Zoning: "SF-1 B" — Single Family Residential District Zoning Board of Adjustment Meeting Minutes — November 16, 2017 Page 1 of 4 and "AG" — Agricultural District. The applicant has requested to table this item to the November 30, 2017 meeting. Planner Richard Schell announced that the applicant has submitted a request to table this item to the November 30, 2017 meeting. A motion was made to table Case ZBA-734 to the November 30, 2017 meeting as requested by the applicant. Motion: Nickel Second: Treichler Ayes: Medici, Cotten, Hakemy, Nickel and Phalen Nays: None Abstain: None Vote: 5-0-0 Motion: Motion to table was approved Agenda Item No. 6 - ZBA-744, Variance to Ordinance No. 480, Section 34.2(a), requiring accessory buildings on a permanent foundation to be located no closer than 10' to a property line located in the rear yard on property described as Lot 40, Block 1, Carillon Phase 5B, an addition to the City of Southlake, Tarrant County, Texas and located at 1112 Lake Carillon Lane, Southlake, Texas. Current Zoning: "ECZ" — Employment Center Zoning District. Planner Richard Schell presented details of the case with a slide presentation to the Board, explaining the request for approval of Variance to Ordinance No. 480, Section 34.2(a), requiring accessory buildings on a permanent foundation to be located no closer than 10' to a property line located in the rear yard to allow an approximately 17' x 20' pool shade structure to be located approximately 41" from the rear property line. The property is designated as a Lake Lot on the Carillon development plan, which requires a front yard setback of 45' and a rear yard setback of 25' for the principal residence. Chair Medici opened the public hearing and called upon the applicant or the applicant's representative to make such comments and present evidence as the applicant should desire. Shelly Claffey, 1625 Brumlow Avenue, Southlake, Texas, General Contractor for the request, once sworn in, presented testimony and answered questions from the Board. Chair Medici asked if there were those in the audience who wished to speak in favor of the request. There being none, Chair Medici asked if there were those in the audience who wished to speak in opposition of the request. There being none, Chair Medici closed the public hearing and opened the item for discussion with the Board. Shelly Claffey was recalled for further testimony and questioning. A motion was made to deny case ZBA-744 as the request did not meet the Variance requirements or criteria. Current Zoning: "SF-IIX — Single Family Residential District. Planner Richard Schell presented details of the case with a slide presentation to the Board, explaining the request for approval of Special Exception Use to allow an approximately 900 square foot family quarters in a second floor addition to the principal residence. Chair Medici opened the public hearing and called upon the applicant or the applicant's representative to make such comments and present evidence as the applicant should desire. Victor Huhem, 361 S.
