17-042RESOLUTION NO. 17-042 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS, GRANTING A SPECIFIC USE PERMIT FOR TELECOMMUNICATIONS TOWERS, ANTENNAS, AND ANCILLARY STRUCTURES ON PROPERTY DESCRIBED AS LOT 1, BLOCK 1, FINA ADDITION, CITY OF SOUTHLAKE, TARRANT COUNTY, TEXAS; AND LOCATED AT 2400 MUSTANG COURT, SOUTHLAKE, TEXAS, MORE FULLY AND COMPLETELY DESCRIBED IN EXHIBIT "A", AND AS DEPICTED ON THE APPROVED PLAN ATTACHED HERETO AND INCORPORATED HEREIN AS EXHIBIT "B" AND PROVIDING AN EFFECTIVE DATE. WHEREAS, a Specific Use Permit for temporary construction and/or sales facilities has been requested b a person or corporation having a proprietary interest in the property zoned as ""1-2" q Y p P 9 P p rY p p Y Heavy Industrial District; and, WHEREAS, in accordance with the requirements of Sections 45.1(30) and 45.7 of the City's Comprehensive Zoning Ordinance, the Planning and Zoning Commission and the City Council have given the requisite notices by publication and otherwise, and have afforded the persons interested and situated in the affected area and in the vicinity thereof; and, WHEREAS, the City Council does hereby find and determine that the granting of such Specific Use Permit is in the best interest of the public health, safety, morals and general welfare of the City. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS: SECTION 1. A Specific Use Permit is hereby granted to allow an antenna tower on property within the City of Southlake, Texas, located at 2400 Mustang Court, location being described as Lot 1, Block 1, Fina Addition, an addition to the City of Southlake, Tarrant County, Texas, more fully and completely described in Exhibit "A", and as depicted on the approved plan attached hereto and incorporated herein as Exhibit "B" and providing an effective date, subject to the provisions contained in the comprehensive zoning ordinance and the restrictions set forth herein. Development Details: • Requesting approval for a Specific Use Permit at the Southlake and Grapevine terminals located off SH 26 in Southlake for building additions of a wireless communication system between both terminals, for commercial use only • System will be comprised of two (2) towers, one at Southlake and the other at Grapevine • The towers will have a small antenna mounted at the top of the structure • According to the applicant, NuStar studied the best locations within the industrial terminals to be as inconspicuous as possible to the public eye • NuStar determined these tower locations to be the least visible from SH 26 and Brumlow Ave. • Need to be able to communicate between Southlake and Grapevine terminals through a wireless antenna. Some of this information provides control for the gates NuStar allows the trucking companies to access their facility and also transmits information that gets reported to the DOT • NuStar did a needs analysis on current re -activation needs.
