SB Item 6 - SV17-016 Eye TrendsCase No. SV17-016 S T A F F R E P O R T November 3, 2017 CASE NO: SV17-016 PROJECT: Eye Trends EXECUTIVE SUMMARY: On behalf of Eye Trends Southlake, Chandler Signs is requesting approval of a variance to the Master Sign Plan for Park Village for Eye Trends located at 1021 E. Southlake Blvd., Southlake, TX. REQUEST: The Park Village retail development is generally located at the southwest corner of E. Southlake Blvd. and S. Carroll Avenue. Eye Trends is located in Building ‘C’. The applicant’s lease space is situated on the corner of Building ‘C’ which dictates two different letter heights. The east façade (A1) allows for a maximum letter height of 24 inches and the south façade (A2) allows for a maximum letter height of 18 inches. The applicant is requesting a variance to allow the south façade the same letter height as the east in order to look balanced. The sign for the east façade has been permitted, however, installation is currently pending. The proposed sign meets all other sign regulation criteria. Southlake Blvd. LEGAL DESCRIPTION: Lot 1, Block 1, Park Village, City of Southlake, Tarrant County, Texas HISTORY: August 19, 2014; City Council approved the Master Sign Plan for Park Village. (MSP14-002) April 21, 2015; City Council approved a request for an amendment to the Master Sign Plan for Park Village to reduce the size of the Park Village Tower Feature. (MSP15-001) June 16, 2015; City Council approved a sign variance request for Modmarket to allow for attached fascia signs to exceed maximum sign area, letter and logo height; to include a cabinet tagline sign; and, to allow the logo to be duel lit (halo and internally illuminated). (SV15-004) November 3, 2015; City Council approved sign variance requests for Gloria’s Latin Cuisine to allow signage with unique illumination and tag line. (SV15-007) January 19, 2016; City Council approved sign variance request for The Juice Bar noting a 24” J and all other letters not to exceed 18”. (SV15-010) September 20, 2016; City Council denied a sign variance request for The Pretty Kitty. (SV16-013) May 8, 2017; following a denial from the Sign Board on May 4, 2017, ShopCore Properties withdrew their application to amend the Park Village Master Sign Plan. The proposed amendment to the Master Sign Plan for Park Village was to allow the addition of two (2) awareness signs and six (6) promotional sign holders. The amendment also proposed to remove the specific criteria approved for The Fresh Market and set that tenant space under the general sign criteria for Rim Buildings that are ≥20,000 square feet. STAFF COMMENTS: City Council approval of the proposed sign does not eliminate the requirement for appropriate sign application submittal prior to the installation of the sign. VARIANCE CRITERIA: 9.6.2 VARIANCES a. Variance Authorized. The City Council may authorize variances to any restriction set forth in this ordinance, including but not limited to the number, type, area, height, or setback of signs, or any other aspect involved in the sign permitting process. b. Approval Standards. In granting any variance, City Council shall consider the following criteria: (i) Special conditions exist which are peculiar to the land, structure or building involved and are not applicable to other lands, buildings or structures in the same zone. The City may attach such conditions to granting all or a portion of any variance necessary to achieve the purpose of this ordinance, and; (ii) The strict interpretation of the provisions of the ordinance would deprive the applicant of rights commonly enjoyed by other properties in the same zone under the terms of the ordinance, and; (iii) The special conditions and circumstances do not result from the actions of the applicant and such conditions and circumstances do not merely constitute pecuniary hardship or inconveniences, and; (iv) Granting the variance will meet the objectives of the ordinance and not be injurious to the adjoining property owners or otherwise detrimental to the public welfare, and; (v) The request will be the minimum variance necessary to alleviate the special hardship or practical difficulties faced by the applicant in meeting the requirements of this ordinance; and; (vi) Granting of the variance will be in harmony with the spirit and purpose of this sign ordinance. (vii) Granting of a variance shall be specific to the subject sign(s). Any modification of the signage approved by the variance or the installation of new or replacement signage that does not meet the specific requirements of the City Council variance approval is prohibited and will be deemed non-compliant. Application Process. Any request for a variance shall be made to the Administrative Official and be accompanied by a completed application and a non-refundable filing fee in the amount specified in the current fee schedule adopted by City Council. The sign variance will be considered by the City Council following a recommendation by the Sign Board. The Sign Board’s recommendation will be forwarded to the City Council for their consideration.
