EXISTING TREE NOTES
1. Existing trees to remain shall be protected during construction from tree
structure damage and compaction of soil under and around dripline (canopy)
of tree.
2. If any root structure is damaged during adjacent excavation/construction,
notify the Architect immediately. It is recommended that a licensed Arborist
be secured for the treatment of any possible tree wounds.
3. No disturbance of the soil greater than 4" shall be located closer to the tree
trunk than 1/2 the distance of the drip line to the tree trunk. A minimum of
75% of the drip line and root zone shall be preserved at natural grade.
4. Any fine grading done within the critical root zones of the protected trees must
be done with light machinery such as a bobcat or light tractor. No earth
moving equipment with tracks is allowed within the critical root zone of the
trees.
5. Material Storage: No materials intended for use in construction or waste
materials accumulated due to excavation or demolition shall be placed within
the limits of the dripline of any tree.
6. Equipment Cleaning/Liquid Disposal: No equipment may be cleaned, toxic
solutions, or other liquid chemicals shall be deposited within the limits of the
dripline of a tree. This would include but not be limited to paint, oil, solvents,
asphalt, concrete, mortar, primers, etc.
7. Tree Attachments: No signs, wires or other attachments, other than those of
a protective nature shall be attached to any tree.
8. Vehicular Traffic: No vehicular and construction equipment traffic or parking is
allowed within the limits of the dripline of trees.
9. Boring of Utilities: May be permitted under protected trees in certain
circumstances. The minimum length of the bore shall be the width of the
tree's canopy and shall be a minimum depth of forty-eight (48') inches.
10. Trenching: Any irrigation trenching which must be done within the critical root
zone of a tree shall be dug by hand and enter the area in a radial manner.
11. Tree Flagging: All trees to be removed from the site shall be flagged by the
Contractor with bright red vinyl tape (3" width) wrapped around the main trunk
at a height of four (4) feet above grade. Flagging shall be approved by
Landscape Architect prior to any tree removal. Contractor shall contact
Landscape Architect with 72 hour notice to schedule on -site meeting.
12. Protective Fencing: All trees to remain, as noted on drawings, shall have
protective fencing located at the tree's dripline. The protective fencing may be
comprised of snow fencing, orange vinyl construction fencing, chain link fence
or other similar fencing with a four (4) foot approximate height. The protective
fencing will be located as indicated on the Tree Protection Detail(s).
13. Bark Protection: In situations where a tree remains in the immediate area of
intended construction, the tree shall be protected by enclosing the entire
circumference of the tree's trunk with lumber encircled with wire or other
means that does not damage the tree. Refer to Tree Protection Detail(s).
14. Construction Pruning: In a case where a low hanging limb is broken during
the course of construction, the Contractor shall notify the Landscape Architect
immediately. In no instance shall the Contractor prune any portion of the
damaged tree without the prior approval by the Landscape Architect.

Lot 1, Block 1, Kimball Crossing, an addition to the City of Southlake, Texas according to
the plot thereof recorded in Document No. 212098905, Plot Records, Tarrant County, Texas;
said tract also being a portion of a called 11.208 acre tract of land conveyed to
Greeway-17091Eleven Partners, L.P. by deed recorded in County Clerks Number D197109628
of the Deed Records of Tarrant County, Texas; said 3.287 acre tract being more
particularly described by metes and bounds as follows;
BEGINNING, at a cut "+" in concrete found for the northwest corner of said Lot 1, Kimball
Crossing, said point also being the northeast corner of Lot 1, Block 1, of Ethan Allen 1709
Addition, an addition to the City of Southiake, Texas according to the plat thereof recorded
in Cabinet A, Page I1456, Plat Records, Tarrant County, Texas; said point being also on the
south right-of-way line of Farm to Market Road No. 1709, also known of as Southlake
Boulevard,
THENCE North 89 degrees 37 minutes 14 seconds East, with said south right-of-way line
and the north line of said Lot 1, Kimball Crossing, a distance of 313.42 feet to a 5/8-inch
iron rod with yellow plastic cap stamped "GSES INC., RPLS 4804" found for corner; said
point being South 89 degrees 37 minutes 14 seconds West 42.00 feet from the northeast
corner of said 11.208 acre tract,
THENCE South 00 degrees 00 minutes 32 seconds West, parallel to and 42.00 feet
perpendicularly distant from the east line of said 11.208 acre tract, a distance of 50.00
feet to a 5/8-inch iron rod with yellow plastic cap stamped "GSES INC., RPLS 4804"
found for corner;
THENCE, North 89 degrees 37 minutes 14 seconds East, parallel to and 50.00 feet
perpendicularly distant from the south right-of-way line of said Southlake Boulevard, a
distance of 30.00 feet to a cut "+" in concrete set for corner;
THENCE, South 00 degrees 00 minutes 32 seconds West, parallel to and 12.00 feet
perpendicularly distant from the east line of said 11.208 acre tract, at a distance of 322.29
feet passing a 5/8-inch Iron rod with yellow plastic cap stamped "GSES INC., RPLS 4804"
found for the southeast corner of said Lot 1, Kimball Crossing; continuing, in all, a distance
of 372.29 feet to a 5/8-Inch iron rod with yellow plastic cap stamped "GSES INC., RPLS
4804" set for corner;
THENCE, South 89 degrees 37 minutes 38 seconds West, parallel to and 50.00 feet
perpendicularly distant from the south line of said Lot 1, Kimball Crossing, a distance of
341.93 feet to a 5/8-inch iron rod with yellow plastic cap stamped "GSES INC., RPLS
4804" set corner;
THENCE, North 00 degrees ll minutes 36 seconds West, at a distance of 50.00 feet
passing a 5/8-inch iron rod with yellow plastic cap stamped "GSES INC., RPLS 4804"
found for the southeast corner of said Lot 1, Ethan Allen 1709 Addition and the southwest
corner of said Lot 1, Kimball Crossing, continuing, with the common line between said Lots
1, in all, a distance of 422.25 feet to the POINT OF BEGINNING,

one or morel, is the owner of that certain parcel of land situated in or within the
extraterritorial jurisdiction of the City of Southlake, Tarrant County, Texas. being
more particularly described hereon for all purposes:
NOW THEREFORE, in consideration of the sum of ONE AND 00/l00 ($/.00)
DOLLAR, and other good and 'valuable consideration, the receipt and sufficiency of
which is hereby acknowledged and confessed, Owners do hereby waive, re/ease,
quitclaim, and forever hold harmless the City of Southlake, Texas, a municipal
corporation, hereinafter call "City", from any and all claims for damage of any kind
that Owners may now have or may hereinafter have In the future by reason of the
passage of all aircraft ("aircraft" being defined for the purposes of this instrument
as any contrivance now known or hereinafter, invented, used, or designed for
navigation of or flight in the air) by whomsoever owned and operated, in the air
space above Owner's property, as hereon before described, and above the surface
of Owner's property such noises, vibration, fumes, dust, fuel, and lubricant particles,
and all other effects that may be caused by the operation of aircraft landing at or
taking off from, or operating at or on the Dallas/Fort Worth International Airport,
and Owner's do hereby fully having remiss, and re/ease any right or cause of
action which it may now have or which It may in the future have against the City,
whether such claim be for injury to person or damage to property due to noises,
vibration, fumes, dust, fuel and lubricant particles, and all other effects that may be
caused or may have been caused by the operation of aircraft landing at, or taking
off from, or the operation and/or maintenance of aircraft or aircraft engine at or
on said Dallos/Fort Worth International Airport.
It Is agreed that this re/ease shall be binding upon the Owner, their heirs and
assigns, and successors in interest with regard to said property located in or on
the extraterritorial jurisdiction of the City of Southlake, Tarrant County, Texas,
running with the land, and shall be recorded in the Deed Records of Tarrant County,
Texas.
