PROJECT: Specific Use Permit for Electric Vehicle Charging Spaces
EXECUTIVE
SUMMARY: Black and Veatch, on behalf of Tesla Motors, is requesting approval of a Specific
Use Permit for electric vehicle charging spaces on property described as Lot 4R,
Block 2R1, Southlake Town Square Addition, City of Southlake, Tarrant County,
Texas and located at 1240 Main Street, Southlake, Texas on approximately 4.06
acres. Current Zoning: "DT" Downtown District. SPIN Neighborhood #8.
DETAILS: Black and Veatch is requesting approval of a Specific Use Permit for electric
vehicle charging spaces consisting of 10 electric vehicle charging stations to be
utilized by Tesla vehicles and installed at 10 dedicated parking spaces.The electric
vehicle charging spaces will be located at the west end of the existing parking lot
located between the Container Store and Charming Charlies adjacent to N. Carroll
Avenue and Prospect Street. The charging station will be utilized as public super
charger electric vehicle charging spaces for Tesla vehicles only and will have
designated and signed parking spaces for Tesla electric vehicles only. The super
charger electric charging stations will charge a vehicle quicker than the standard
charging stations. Eleven existing parking spaces will be utilized for the proposed
10 parking spaces with two accessible spaces. Twenty percent (20%) of the
parking spaces are required to be accessible, but not designated for accessible
vehicles only. Pavement striping will use up one of the eleven spaces. Signage for
the electric vehicle charging stations will be included with this Specific Use Permit
request. The applicant has provided additional information for the electric vehicle
charging spaces specific use permit regulations in the Narrative.
According to the applicant's narrative, there are approximately 5,283 parking
spaces in Southlake Town Square. The electric vehicle charging spaces are
allowed with an approved Specific Use Permit and limited to a maximum utilization
of 10% of required parking spaces. There are recent approvals for electric vehicle
charging spaces within Town Square for the west (2 spaces) and east (4 spaces)
parking garages and the Tesla retail store (6), totaling 12 electric vehicle charging
spaces. The tesla retail store spaces are utilized by the Tesla retail store only.
At the August 17, 2017 Planning and Zoning Commission meeting, the applicant
tabled their request to respond to the Planning and Zoning Commission's requests
to provide taller shrubs along the west parking lot,change the equipment enclosure
material to split faced block, and to explore other potential locations for the Tesla
charging stations within Town Square. The applicant has made revisions to the
equipment enclosure material and shrubs, and has noted in their narrative that the
Town Square management prefers the currently proposed location. The enclosure
for proposed dedicated electric transformer and Tesla supercharger cabinets has

been revised from the Trex seclusion composition fence enclosure to a split-faced
block and is still proposed to be located south of the proposed dedicated parking
spaces.
The landscaping has been revised to remove all the existing Indian Hawthorn
shrubs along the entire length of the west side of the parking lot for the installation
of the electric vehicle charger stations and underground electric cables. The
applicant is proposing Dwarf Burford Holly shrubs along the parking lot and
equipment enclosure and transformer area to insure the shrub height will be the
continuous along the parking lot edge. The height of the Dwarf Burford Holly
shrubs will be taller than the existing shrubs to screen the electric vehicle charging
stations and cars. The landscape plan includes adding two Chinese Pistache trees
on the west side of the proposed equipment enclosure.

SOUTHLAKE 2030: This initiative aligns with Southlake's 2030 Mobility Master Plan
recommends adding non-residential charging stations as a use in Tier 1.
The Sustainability Master Plan Energy Resources recommends policies
that encourage private investment in alternative energy technologies within
the City in Tier 2.
HISTORY: September 20, 2016; City Council approved a Specific Use Permit for two
electric vehicle charging spaces with a dual charging station for the
Southlake Town Square west parking garage. (ZA16-064)
February 7, 2017; City Council approved a Specific Use Permit for up to six
Tesla electric vehicle charging stations at the location in the parking lot
behind the Tesla store in Southlake Town Square; approved signage in
conjunction with the electrical vehicle charging stations consistent with the
exhibits presented this evening; allowed the electric charging stations to be
utilized by the general public;the SUP will be valid for the term of the lease
for the specific tenant and any subsequent options and extensions; and all
wiring for electrical charging stations must be below ground. (ZA16-105)
June 6, 2017; City Council approved a Specific Use Permit the location of
four parking spaces in the Southlake Town Square east parking garage as
electric vehicle charging parking spaces(2 electric vehicle charging parking
spaces installed immediately and 2 electric vehicle charging parking spaces
installed in the future). (ZA17-033)

applicant's willingness, at the City Council meeting, to show an alternate
revised plan that only includes five (5) spaces versus 10 spaces; however
noting that the Planning and Zoning Commission is approving the full
request in the staff report with 10 spaces.

Note: A specific use permit shall automatically expire if a building permit is
not issued and construction begun within six (6) months of the
granting of the specific use permit or if the use shall cease for a
period of six (6) months.
45.20 SPECIFIC REGULATIONS FOR ELECTRIC VEHICLE CHARGING SPACES
1) Electric vehicle charging equipment may only be installed when accessoryto the primary permitted
use.
2) No more than 10% of the total number of required parking spaces may be designated as electric
vehicle charging spaces.
3) Each charging space shall be posted with signage indicating the space is only for electric vehicle
charging purposes. Days and hours of operations shall be included if time limits or tow away
provisions are to be enforced by the owner. Information identifying voltage and amperage levels or
safety information must be posted.
4) Design should be appropriate to the location and use. Facilities should be able to be readily
identified by electric vehicle drivers but blend into the surrounding landscape/architecture for
compatibility with the character and use of the site.
5) Equipment shall be located so as not to impede pedestrian travel, create trip hazards on
sidewalks, or interfere with accessibility requirements.
6) Regulations for the electric vehicle charging equipment and spaces shall be established in the
specific use permit. These regulations may include but are not limited to location; size of
equipment; signage, including directional signage (if any); and lighting (if any).
45.5 FACTORS TO BE CONSIDERED - In granting or denying an application for a specific use permit, the
City Council shall take into consideration the following factors:
a. Safety of the motoring public and of pedestrians using the facility and the area immediately surrounding the
site.
b. Safety from fire hazard, and measures for fire control.
c. Protection of adjacent property from flood or water damage.
d. Noise producing elements; and glare of vehicular and stationary lights and effect of such lights on
established character of the neighborhood.
e. Location, lighting and type of signs; and relation of signs to traffic control and adverse effect on adjacent
properties.
f. Street size and adequacy of pavement width for traffic and reasonably expected to be generated by the
proposed use around the site and in the immediate neighborhood.

g. Adequacy of parking, as determined by requirements of this chapter for off-street parking facilities for
similar uses; location of ingress and egress points for parking and off-street loading spaces;and protection
of the public health by all-weather surfacing on all parking areas to control dust.
h. Such other measures as will secure and protect the public health, safety, morals and general welfare.
i.City Council may grant variances to specific regulations associated with a specific use set forth in
Sections 45.To receive a variance,the applicant must demonstrate one of the following (As amended by
Ordinance No. 480-MMMM):
(a) A variance will reduce the impact of the project on surrounding residential properties; or
(b) Compliance with this ordinance would impair the architectural design or creativity of the project; or
(c) A variance is necessary to assure compatibility with surrounding developed properties; or
(d) The proposed construction is an addition to an existing project that does not meet the requirements
of this ordinance.

TREE CONSERVATION COMMENTS:
No existing trees are proposed to be altered for the installation of the electrical charging stations.
LANDSCAPE COMMENTS:
1. The existing hedgerow of shrubs is proposed to be relocated in back of the charging stations and
look to be directly on top of the charging station's electrical supply lines. Will the proposed
placement pose a problem being over the electric supply lines?
2. The relocated hedgerow is proposed to be Green Velvet Boxwood, which is not the type of shrub
that now exists.The existing shrubs are Indian Hawthorn. It is recommended the shrubs in back of
the charging stations be the same as what currently exists so they match the existing shrubs that
will remain, and that a taller growing shrub species be provided around the proposed utility
compound.
The Botanical Name for the Green Velvet Boxwood is spelled incorrectly. The correct genus
spelling is Buxus. Buxus x `Green Velvet'

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SOUTHLAKE, TEXAS, GRANTING A SPECIFIC USE PERMIT FOR
ELECTRIC VEHICLE CHARGING SPACES ON COMMMERCIAL
PROPERTY WITHIN THE CITY OF SOUTHLAKE, TEXAS,
LOCATED AT 1420 MAIN STREET, BEING DESCRIBED AS LOT
4R, BLOCK 2R1, SOUTHLAKE TOWN SQUARE ADDITION AS
DEPICTED ON THE APPROVED SITE EXHIBIT ATTACHED
HERETO AND INCORPORATED HEREIN AS EXHIBIT "A" AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, a Specific Use Permit for Electric Vehicle Charging Spaces on commercial
property has been requested by a person or corporation having a proprietary interest in the
property zoned as "DT" Downtown District; and,
WHEREAS, in accordance with the requirements of Section 45.1 (50) and 45.20 of the
City's Comprehensive Zoning Ordinance, the Planning and Zoning Commission and the City
Council have given the requisite notices by publication and otherwise, and have afforded the
persons interested and situated in the affected area and in the vicinity thereof; and,
WHEREAS, the City Council does hereby find and determine that the granting of such
Specific Use Permit is in the best interest of the public health, safety, morals and general welfare
of the City.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
SOUTHLAKE, TEXAS:
SECTION 1.
A Specific Use Permit is hereby granted for Electric Vehicle Charging Spaces on
commercial property at 1420 Main Street being described as Lot 4R, Block 2R1 , Southlake
Town Square Addition as depicted on the approved Site Exhibit attached hereto and
incorporated herein as Exhibit "A" and providing an effective date, subject to the provisions
