EXECUTIVE
SUMMARY: Scott E. Kasden, MD is requesting approval of a variance to Sign Ordinance
No. 704, as amended, to allow an attached building sign with a non-permitted
letter type located at 2813 W. Southlake Blvd., Suite 130, Southlake, Texas.
REQUEST
DETAILS: Dr. Kasden's office is located in Watermere Medical Plaza which is located on
the southwest corner of W. Southlake Blvd. and Watermere Drive.
The applicant is requesting a variance to allow a non-illuminated plastic formed
letter type that does not meet the 2-inch thickness standard. The proposed sign
is for the north elevation of Building `A' which faces Southlake Boulevard. Dr.
Kasden stated the proposed letter type is uniform with existing signs on that
side of the building. The existing signs installed on the north elevation of the
building are considered flat panel signs due to the depth of the letters being
less than 2 inches; these signs were installed prior to the amendment to the
Sign Ordinance which prohibits flat panel signage.

• February 7, 2012; City Council approved the Zoning Change and Site
Plan from "SF-1A" Single Family Residential District to "0-1" Office
District for Watermere Medical Plaza. (ZA11-060)
• June 3, 2014; City Council approved a Zoning Change and Site Plan
from "0-1" Office District to "S-P-1" Detailed Site Plan District to allow up
to an 8,000 square foot ambulatory surgery center; compounding
pharmacy; and to allow the addition of the covered drop off and
generator enclosure Building `A'. (ZA14-035)
• December 2, 2014; City Council approved a Zoning Change and Site
Plan; removing the ambulatory surgery center from Building `A' and
moving it to Building `B'. (ZA14-125)
• September 1, 2015; City Council approved a Zoning Change and Site
Plan; adjusting parking and generator enclosure. (ZA15-063)
Sign Variance-
• August 6, 2013; City Council approved a Sign Variance allowing the two
attached signs on the facades to not correlate with the respective
tenants; allowing a maximum letter height of 15 inches for the third sign
on the eastern fagade (where it is shown as Watermere Medical Plaza);
approving the third additional sign on the eastern fagade. (SV13-015)
SIGN BOARD: September 7, 2017; Denied (6-0).
It was the general consensus of the Sign Board that new signs on the
building should adhere to the new sign regulations in Ordinance No.
704-1.
STAFF COMMENTS: The application exhibits are hyper-linked to this report. City Council
approval of the request does not eliminate the requirement for an
appropriate sign application submittal prior to sign installation. Please

Variance Criteria:
9.6.2 VARIANCES
a. Variance Authorized. The City Council may authorize variances to
any restriction set forth in this ordinance, including but not limited
to the number, type, area, height, or setback of signs, or any other
aspect involved in the sign permitting process.
b. Approval Standards. In granting any variance, City Council shall
consider the following criteria:
(i) Special conditions exist which are peculiar to the land,
structure or building involved and are not applicable to other
lands, buildings or structures in the same zone. The City may
attach such conditions to granting all or a portion of any
variance necessary to achieve the purpose of this ordinance,
and;
(ii) The strict interpretation of the provisions of the ordinance
would deprive the applicant of rights commonly enjoyed by
other properties in the same zone under the terms of the
ordinance, and;
(iii) The special conditions and circumstances do not result from
the actions of the applicant and such conditions and
circumstances do not merely constitute pecuniary hardship
or inconveniences, and;
(iv) Granting the variance will meet the objectives of the
ordinance and not be injurious to the adjoining property
owners or otherwise detrimental to the public welfare, and;
(v) The request will be the minimum variance necessary to
alleviate the special hardship or practical difficulties faced by
the applicant in meeting the requirements of this ordinance;
and;
(vi) Granting of the variance will be in harmony with the spirit and
purpose of this sign ordinance.
(vii) Granting of a variance shall be specific to the subject sign(s).
Any modification of the signage approved by the variance or
the installation of new or replacement signage that does not
meet the specific requirements of the City Council variance
approval is prohibited and will be deemed non-compliant.
Application Process. Any request for a variance shall be made to
the Administrative Official and be accompanied by a completed
application and a non-refundable filing fee in the amount specified
in the current fee schedule adopted by City Council. The sign
variance will be considered by the City Council following a
recommendation by the Sign Board. The Sign Board's
recommendation will be forwarded to the City Council for their
consideration.
