SB Item 5 -SV17-013 DemonstrationDemonstration Please demonstrate that the following conditions are applicable to the requested sign variance: That a literal enforcement of the sign regulation will create an unnecessary hardship or practical difficulty on the applicant. The literal enforcement of the sign regulation will result in font sizes too small to be safely read from the passing motorists resulting in potentially hazardous motorist wayfinding. This is a result of the frontage being obscured by the landscape surrounding the parcel as well as the length of the legal name of the business. 2. That the situation causing the unnecessary hardship or practical difficulty is unique to the affected property and is not self imposed. The situation is caused by the landscape surrounding the parcel and the code putting businesses with longer legal names at a competitve disadvantage. 3. That the variance will not injure and will be wholly compatible with the use and permitted development of adjacent properties. The requested variance is the minimum amount of relief necessary to provide safe motorist wayfinding. The proposed sign is in proportion to the signage for the other tenants in the development and fits the scale of the wall sign area. The larger font sizes will in no way injure the adjacent properties. 4. That the variance will be in harmony with the spirit and purpose of the sign ordinance. The proposed sign will be in harmony with the spirit and purpose of the sign ordinance because we are requesting the minimum relief necessary to install a sign that is legible for the general public and passing motorists. The intent of the ordinance is to set a standard for sign reasonableness however it does sometimes fall short where businesses with longer legal names are at a competitive disadvantage when it comes to fitting their name and logo into the restrictions set forth in the sign ordinance.
