Item 8 -ZA17-058 SUPCase No. ZA17-058 S T A F F R E P O R T September 1, 2017 CASE NO: ZA17-058 PROJECT: Specific Use Permit for a Commercial School for D4L Fitness, LLC EXECUTIVE SUMMARY: D4L Fitness, LLC is requesting approval of a Specific Use Permit to allow a Commercial School on property described as Lot 5R1, Block D, Commerce Business Park Addition, City of Southlake, Tarrant County, Texas and located at 2845 Exchange Blvd., Southlake, Texas on approximately .74 acres. Current Zoning: “I-1” Light Industrial District. SPIN Neighborhood #8. DETAILS: This site is generally located on the south side of Exchange Blvd. between Commerce Street and S. Nolen Avenue. A specific use permit is required to allow a commercial school in the “I-1” Light Industrial District (not allowed by right in the “I- 1” district). The proposed business will occupy approximately 8,720 sf of an 11,720 sf building. The remaining 3,000 sf of the building will remain occupied by a catering business. The request is subject to the requirements outlined in the Specific Use Permit, Section 45.19 of the Zoning Ordinance: In considering whether to grant a specific use permit for commercial school, including trade school, the City Council shall consider the following: 1) Safe access for the ingress and egress of students, pedestrian, parking and vehicular traffic, including the identification of student drop-off areas. 2) Adequate illumination will be provided at night to protect the safety of those persons entering and exiting the site. The indoor facility will be utilized for fitness, health, and nutrition. The applicant has provided additional information in the narrative to address the specific use permit regulations. HISTORY: The property was annexed into the City in 1986 and given the “LI” Li ght Industrial District zoning designation. September 2, 1986; a Final Plat for Commerce Business Park with 34 lots was approved and a corrected plat was filed March 30, 1988. (ZA86 - 048) The “I-1” – Light Industrial District zoning was placed on the property with the adoption of Comprehensive Zoning Ordinance No. 480 and the Official Zoning Map on September 19, 1989. A Site plan was approved by City Council (ZA96 -010) October 6, 1998; a plat revision was approved for lots 5R1 and 5R2. (ZA98- 100) The existing buildings on the properties were constructed in 1997 and 1999. TRANSPORTATION ASSESSMENT: The existing building has direct access to Exchange Avenue via three driveways for two commercial buildings with a common parking lot. T he 2845 Exchange Blvd. property currently has 24 parking spaces and the 2835 Exchange Blvd. property has 2 1 parking spaces. The 2845 Exchange Blvd. building parking requirements are 4 parking spaces catering business requires and 14 parking spaces for the proposed fitness facility. This is a total of 18 required parking spaces for the building. The 2835 Exchange Blvd. building has parking requirements for 11 parking spaces and has 21 parking spaces. The properties are owned by the same owner and the applicant has stated that there is cross access/shared parking arrangement, if needed, for after business hour uses for special events or evening/weekend uses. The applicant has noted in his narrative that the facility is a fitness, health, and nutrition facility set up specifically by scheduled class time and by appointment only. Industrial and business service development that is relatively free of unwanted side effects, such as unsightliness, noise, odor, glare, vibrations, etc., is permitted in the Industrial category. If meeting the qualification of relatively free of unwanted side effects, suitable types of development in the Industrial category can be characterized by the manufacturing, processing, packaging, assembly, storage, warehousing and/or distribution of products. Ancillary commercial and retail activities associated with these uses are permitted. Public Parks/Open Space and Public/Semi-Public activities as described above may be permitted if surrounding industrial uses do not pose hazards and are sufficiently buffered. The development as proposed appears to be consistent with the intent of the land use designation at this location. STAFF COMMENTS: A SPIN meeting was not held for this property.
