SB Item 4- SV17-005 DemonstrationDemonstration Please demonstrate that the following conditions are applicable to the requested sign variance: That a literal enforcement of the sign regulation will create an unnecessary hardship or practical difficulty on the applicant. The sign itself is in compliance with the city's codes. The only variance we are looking for is in the location of the sign. All other signs on this particular building fall under section 5.1 of the sign ordinance as they were in existence prior to the adoption of this ordinance. Due to the design of the front of the building it does not easily allow for first -floor signs. The building has floor to ceiling windows and, therefore, the logical location for our sign as new tenants is also the second -floor. By placing our sign on the second floor it will offer uniformity to the building. 2. That the situation causing the unnecessary hardship or practical difficulty is unique to the affected property and is not self imposed. The design of this particular building inadvertently leads to placing the signs on the second floor due to the floor to ceiling windows leaving little to no room for first -floor signage. See attached rendering of the sign. 3. That the variance will not injure and will be wholly compatible with the use and permitted development of adjacent properties. The sign will be wholly compatible with the ordinance other than section 5.2.24 and will not affect the use and permitted development of the adjacent properties. 4. That the variance will be in harmony with the spirit and purpose of the sign ordinance. We acknowledge that our case could potentially be a difficult decision due to our tenant space being on the first floor and we're asking for our sign to be placed on the second floor of the building. We recognize that there are two options we could pursue — Master Sign Plan and Variance; so by applying for a variance we are following the ordinance's processes of exception (5.2.24) and still designing the sign to uphold the goal of the ordinance which is to maintain a certain look within the city of Southlake.
