Item 9A 13 CITY OF SOUTHLAKE Department of Planning & Development Services STAFF REPORT June 13, 2017 CASE NO: SV17-002 PROJECT: Sign Variance for 7-Eleven EXECUTIVE SUMMARY: On behalf of 7-Eleven, Barnett Signs is requesting approval of variances to Sign Ordinance No. 704, as amended, to allow attached business signs, gas canopy signage, a monument sign and gas pump signage that does not meet current Sign Ordinance criteria. The existing 7-Eleven is located at 1600 W. Southlake Boulevard, Southlake, Texas. REQUEST DETAILS: The existing 7-Eleven convenience store is located on the northeast corner of West Southlake Blvd. and North Peytonville Ave. The purpose of this request is to improve the appearance of the site, incorporate new Exxon/Synergy signage, and increase visibility for the 7-Eleven brand. The original Tetco/Mobil convenience store, gas station and car wash were built in the Summer of 1997. In November of 2000, 7-Eleven Incorporated bought the existing business and the site was transformed into a 7-Eleven/Citgo convenience store, gas station and car wash. The monument sign was modified and new attached building signs were installed, to include the orange, green and red striping. In January 2017, the site came under new ownership and by mid February, applications were submitted to the City regarding proposed building exterior upgrades and new signage. The proposed signage was not consistent with current sign ordinance regulations which resulted in the new owner and applicant requesting multiple variances. As part of the site upgrade project, all of the orange, green and red striping will be removed from the buildings and canopy. Existing building fascias will also be repaired and painted. The applicant is proposing to rebuild the monument sign in the same location, however, exceeding maximum total height, sign structure height, sign face height and sign face/sign structure square footage. The request also includes two (2) new attached building signs and two (2) new attached gas canopy signs that exceed maximum letter and/or logo height and do not meet current illumination/color requirements. The addition of the gas canopy signage will also result in exceeding the maximum allowed attached signs per street front. In addition, with the incorporation of Exxon/Synergy, the applicant is also requesting a variety of gas pump signage. On June 8, 2017, the Sign Board recommended approval of the requested variances (2-2) limiting the approval to the number of attached signs requested (4) and only allowing the pump identification number signs for the gas pump area. It was also recommended that the applicant provide City Council with Case No. SV17-002 renderings showing all requested signs as they would look in compliance with ordinance criteria. The applicant has submitted a revised sign package for City Council consideration that contains only three (3) variance requests; all other intended signage will comply with ordinance regulations. The three (3) variances remaining (highlighted below) are for the maximum letter height and area on the south elevation and for the maximum number of attached signs. Southlake Blvd., Southlake, Texas. LEGAL DESCRIPTION: Lot 6R, Block 6, Southridge Lakes Addition CURRENT ZONING: "C-3" General Commercial District HISTORY: - In 1995, a Final Plat for Lots 4-6, Block 6, Southridge Lakes Addition was approved and recorded. (ZA95-035) - In 1997, an Amended Plat for Lots 4R and 6R, Block 6, Southridge Lakes Addition was approved and recorded. (ZA97-082) - May 20, 1997, City Council approved a Site Plan for a Mobil gas station/convenience store with car wash. (ZA97-032) - According to City records, in August 1998, signage was permitted for: • South elevation car wash — 18" max. illuminated Car Wash • South elevation store —24" max illuminated Tetco • South elevation gas canopy—24" max illuminated Mobil • West elevation gas canopy—24" max illuminated Mobil • West elevation store — 25 square foot illuminated Pegasus logo • Gas pricing monument — 52 square feet / 5'4" overall height (variance approved by City Council) - In November 2000, a Re-occupancy permit was issued for new owner, 7-Eleven. According to City records, the following changes occurred: • South elevation store — 12" max illuminated 7-Eleven • Store, car wash and gas canopy — wrapped with orange, green and red striping. All other previously attached signage was removed. • Gas pricing monument — Mobil signs removed; new illuminated 7-Eleven signs installed using the existing base and 6 inch masonry frame constructed • In 2003, illuminated gas pricing was replaced with LED type - In January 2017, a Re-occupancy permit was issued for new owner, SEJ Asset Management — 7-Eleven. Sign permit applications were submitted in conjunction with an exterior site modification plan and it was determined that the proposed signage would require City Council variance approvals. SIGN BOARD: June 8, 2017; Recommended to Approve (2-2) subject to the Staff Report dated June 2, 2017 and Sign Variance Review No. 3, dated June 2, 2017; noting the following: • The five (5) requested variances for the proposed monument sign are denied; Case No. Attachment A ZA17-002 Page 1 • The maximum letter height proposed for the 7-Eleven signs on the south and west elevations (36 inches) are denied; • The additional attached signs for Exxon on the canopy — the proposed letter/logo height is denied; • Specifically granting the request related to the maximum number of signs as four (4); (1 building and 1 canopy on the south elevation and 1 building and 1 canopy on the west elevation) • Specifically denying the request for internally illuminated channel cut letters as proposed; • And lastly, denying any variance requests regarding the gas pump signage, however, allowing the pump identification signs shown as sign #2 on the submitted sign plan. The Sign Board members who cast the dissenting vote stated the following reasons: • Commissioner Springer stated that due to the location and clear visibility, all signage should meet ordinance criteria. He also stated he did not want to set a precedent for future requests. • Commissioner Rothmeier stated that due to the pitched roof, the maximum allowed letter height of 18 inches on the south elevation does not look to scale; using the reference point of the 36 inch striping that seemed to fit that facing better. He also recommended the applicant show alternatives for the canopy background color to better accommodate halo lit letters. City Council approval of any or all of the requests does not eliminate the requirement for appropriate sign application submittals prior to sign installation. Variance Authorized. The City Council may authorize variances to any restriction set forth in this ordinance, including but not limited to the number, type, area, height, or setback of signs, or any other aspect involved in the sign permitting process. b. Approval Standards. In granting any variance, City Council shall consider the following criteria: (i) Special conditions exist which are peculiar to the land, structure or building involved and are not applicable to other lands, buildings or structures in the same zone. The City may attach such conditions to granting all or a portion of any variance necessary to achieve the purpose of this ordinance, Case No. Attachment A ZA17-002 Page 2 and; (ii) The strict interpretation of the provisions of the ordinance would deprive the applicant of rights commonly enjoyed by other properties in the same zone under the terms of the ordinance, and; (iii) The special conditions and circumstances do not result from the actions of the applicant and such conditions and circumstances do not merely constitute pecuniary hardship or inconveniences, and; (iv) Granting the variance will meet the objectives of the ordinance and not be injurious to the adjoining property owners or otherwise detrimental to the public welfare, and; (v) The request will be the minimum variance necessary to alleviate the special hardship or practical difficulties faced by the applicant in meeting the requirements of this ordinance; and; (vi) Granting of the variance will be in harmony with the spirit and purpose of this sign ordinance. (vii) Granting of a variance shall be specific to the subject sign(s). Any modification of the signage approved by the variance or the installation of new or replacement signage that does not meet the specific requirements of the City Council variance approval is prohibited and will be deemed non-compliant. Application Process. Any request for a variance shall be made to the Administrative Official and be accompanied by a completed application and a non-refundable filing fee in the amount specified in the current fee schedule adopted by City Council. The sign variance will be considered by the City Council following a recommendation by the Sign Board. The Sign Board's recommendation will be forwarded to the City Council for their consideration. The two (2) variances remaining are for the maximum letter height on the south elevation and for the maximum number of attached signs. a. Primary Attached Building Sign — 30" channel letters i. South Elevation facing Southlake Blvd. is allowed a maximum letter height of 18 inches (the south facade is less than 100' from the edge of pavement). The maximum sign area allowed is approximately 30 sf. The proposed colored letters shall be halo lit. b. Only two attached signs are allowed per site and only one per street front. The addition of the canopy signage will exceed maximum allowed attached signs. c. Car Wash signage i. The proposed car wash signage is considered as building identification signs and are typically either painted directly on the building or affixed as vinyl letters. This type sign is limited to 5 sf and is not illuminated. The submitted car wash signage appears to be compliant. Clearance and No Entry bars are exempt and utilized for safety purposes.
