Item 7 - ZA17-045 SUP OktoberfestCase No. ZA17-045 STAFF REPORT June 2, 2017 CASE NO: ZA17-045 PROJECT: Specific Use Permit for a Mass Gathering Event – Oktoberfest EXECUTIVE SUMMARY: The Southlake Chamber of Commerce is requesting approval of a Specific Use Permit for a Mass Gathering Event for Oktoberfest on property described as Phases I-IV, Southlake Town Square, City of Southlake, Tarrant County, Texas and being located between E. Southlake Boulevard, E. S.H. 114 and N. Carroll Avenue, Southlake, Texas. Current Zoning: “DT” Downtown District. SPIN # 8. REQUEST: The Southlake Chamber of Commerce is requesting approval of an amendment to the currently approved Specific Use Permit (SUP) for Oktoberfest in order to allow for an admission fee. This year will mark the 16th anniversary of this event hosted by Southlake's Chamber of Commerce. An estimated 100,000 people visited throughout the weekend festival in 2016. The 2017 Event Schedule is as follows: Friday, October 6 5 p.m. – 11 p.m. Saturday, October 7 10 a.m. – 11 p.m. Sunday, October 8 12 p.m. – 5 p.m. All activities, entertainment and event signage proposed for 2017 are consistent with the 2016 event. The applicant is requesting to continue to have the ability to access the park property on the Thursday prior to the event at 9 a.m. in order to load in and set up the large tent in the middle of the park, stating the tent set-up will not impact general parking or traffic flow. The applicant anticipates that the entire set up will be complete before midnight on that Thursday. In addition, the applicant requests to continue having police presence until 6:30 p.m. on Sunday, to assist with move out. On June 3, 2014, the City Council granted a five year approval period for the Oktoberfest SUP with the condition that the Senior Director of Planning & Development Services have the ability to review conditions and provide revocability at his/her discretion. The applicant respectfully requests that circumstance to continue and the expiration date of June 3, 2019 remain valid. LEGAL DESCRIPTION: Southlake Town Square Phase I-IV LAND USE CATEGORY: Town Center CURRENT ZONING: “DT” Downtown District HISTORY: The Oktoberfest event has been successfully held annually in the Town Square for the past fifteen years. The event is typically held the first Friday, Saturday, and Sunday of October. August 20, 2002 – City Council approved (7-0) SUP’s for Special Events (Southlake Town Square NRPUD) and the Sale of Alcoholic Beverages for Oktoberfest for a period of one (1) year (ZA02-069 & ZA02-072). August 5, 2003 – City Council approved (5-0) SUP’s for Special Events (Southlake Town Square NRPUD) and the Sale of Alcoholic Beverages for Oktoberfest for a period of one (1) year (ZA03-046 & ZA03-047). August 3, 2004 – City Council approved (5-0) SUP’s for Mass Gathering Event (Southlake Town Square DT) and the Sale of Alcoholic Beverages for Oktoberfest for a period of three (3) years (ZA04-052 & ZA04-053). August 21, 2007 – City Council approved (7-0) SUP for Mass Gathering Event (Southlake Town Square DT) for Oktoberfest for a period of three (3) years (ZA07-096). The SUP requirement for Sale of Alcoholic Beverages had been eliminated. March 2, 2010 – City Council approved (7-0) SUP for Mass Gathering Event (Southlake Town Square DT) for Oktoberfest for a period of three (3) years (ZA10-005). June 21, 2011 – City Council approved (6-0) SUP for Mass Gathering Event (Southlake Town Square DT) for Oktoberfest for a period of three (3) years (ZA11-024). Renewal was necessary due to expansion of the event boundary for the Sport Zone, on the west side of Main Street. June 3, 2014 – City Council approved (7-0) SUP for Mass Gathering Event (Southlake Town Square DT) for Oktoberfest for a period of five (5) years (ZA14-048). Reference case number ZA13-058.  Home for the Holidays – held annually since 1999; approved in perpetuity. Reference case number ZA11-043.  Art in the Square – held annually since 2000; approved in perpetuity. Reference case number ZA11-072.  Green Fest – annual event approval since 2009; approved for 5 years. Reference case number ZA13-129. STAFF COMMENTS: Due to the limited scope of this request, a staff review report was not generated. The modified site exhibit and event narrative are hyperlinked to this report. If a multi-year approval is granted, the applicant will be required to submit a site plan and scope of the event every year for staff approval at least 30 days prior to the event. Any promotional event signs are subject to approval and permits by appropriate staff for the pavilion banner and small directional signs; the property owner for the banners hung across Main Street; and, TxDOT for and electronic message boards on S.H. 114. The applicant understands that the small directional signs cannot be placed in the public right of way. The applicant shall pursue permission from the City Engineer to place any signs in the median along Carroll Avenue at Federal Way and at Main Street. Pursuant to Section 5.2.5 of Sign Ordinance 704, as amended, permission may be granted by the City for public purposes. These signs are intended to direct traffic to parking areas. The Planning & Zoning Commission and City Council shall consider the following in determining whether to grant a Specific Use Permit for a mass gathering event according to the Comprehensive Zoning Ordinance No. 480, Section 45.14c, as amended: 1. Whether there is convenient and safe access for the ingress and egress of pedestrians and vehicular traffic; 2. Whether sufficient traffic control personnel is proposed to insure safety to all members of the traveling public, including pedestrians, along all public roadways in the proximity of the mass gathering and/or along which the public is likely to travel to reach the mass gathering areas shall be provided; 3. Whether the mass gathering area is well drained and so arranged to provide sufficient space for persons assembled, vehicles, sanitary facilities, and appurtenant equipment; 4. Whether sufficient illumination will be provided at night to Case No. Attachment A ZA17-045 Page 3 protect the safety of the persons assembled; 5. Whether adequate parking areas, including disabled persons’ parking spaces, shall be provided for persons arriving by vehicular means. If the promoter proposes to utilize temporary off-site parking, then the promoter the mass gathering event the off-site temporary parking area will not be utilized for purposes other than the mass gathering event; and 6. Whether adequate provisions have been made for food supply, medical assistance, garbage disposal, water supply, parking, sanitation and toilet facilities, vermin control, and safety. The City Council may establish specific conditions depending upon the nature of the proposed event and traffic, health and safety issues according to Ordinance 480, Section 45.14.a, as amended.
