limited to 30 members per class. The proposed workouts are scheduled for Monday through Friday from 5 – 7 am. Hobby Lobby is not open during the proposed training sessions. Dunkin Donuts
and Starbucks are open as noted. The workout area and parking are located out of the main traffic flow and fire lane. In the case of rain, an alternate training site is proposed near
the east building located at 2001 W. Southlake Blvd. as shown. The nearest residential property is located approximately 425 ft. from the training site.

There will be two locations at the St. John’s Baptist church site for training. The south parking lot will be for morning workouts held on Monday, Wednesday, and Friday from 5 to 9
am, Tuesday and Thursday from 9:15 to 11:15 am and Saturday 7-9 am. The applicant has indicated that the morning training area south lot is located away from residential properties.
The nearest residential property is approximately 280 feet from the workout area.
The north parking lot will be utilized for the evening workouts on Monday and Wednesday 5:30- 7:30
pm and Tuesday and Thursday 4:45-8 pm. The nearest residential property is approximately 110 feet from the workout area. Both locations will be limited to 40 members per session.

Section 45.12 Specific Use Permit
45.12 Specific Regulations for outdoor sales OR services
a. Approval of a specific use permit for outdoor sales or services shall be based upon an analysis of the location, the site
layout and design features, the assurance that the adjoining streets can handle higher volumes of traffic during peak hours of traffic loading without a requirement to divert traffic
onto traditional residential streets and the compatibility of the proposed use with adjacent land uses.
b. A fixed time period (specific dates) for the outdoor sale or service activity
to commence shall be established in the specific use permit. The permit for the sale or service activity shall be established and unless otherwise stated in the permit, shall be valid
one year from the date of approval by the City Council.
c. Regulations for any structure used to conduct the outdoor sale or services activity including but not limited to, size,
color, location of equipment, lighting and signage shall be established in the specific use permit.
d. The location of outdoor sale or service activity shall not reduce the parking
requirements or effectiveness of landscaped or buffer areas and the areas for the display of merchandise shall not adversely impact the ability of pedestrians or vehicles to move about
the lot.
e. The site must provide adequate ingress and egress.
f. Provisions for waste collection, recycling and/or disposal may be established in the specific use permit.
g.
Each sidewalk or pedestrian way on the approved site plan shall be a minimum of forty-four inches (44”) in width. Additional width may be required and pedestrian ways shall be subject
to the Americans with Disability Act Accessibility Guidelines for Building and Facilities.

Article III.- Noise Nuisances
Sec. 11-61. - Offenses.
(b) Noise nuisance. A person shall not create, assist in creating, permit or continue any excessive or unnecessary noise of a
volume, intensity, repetitiveness or duration that is clearly audible and disturbs, annoys, or endangers the calm, comfort, quiet, repose, health, peace or safety of persons of ordinary
sensibilities beyond the immediate vicinity of the noise. Such noise shall be a violation of this article.
(c) Prima facie violation. The following acts of noise are prima facie evidence
of a violation of this article:
(1)Permitting an unreasonably loud, harsh, or prolonged sounding of any horn, alarm, or other signal device on any vehicle, unless: (i) necessary to
ensure safe operation as authorized by state law, or (ii) caused by mechanical failure beyond the operator's control and the operator takes all reasonable measures to stop the noise
made by the horn, alarm, or other device.
(2)Playing or use of any sound producing or amplifying device, speaker, radio, tape player, compact disc player, loud speaker, or electronic
"boom-box" or other similar instrument, including a musical instrument, in such a manner or in such loud volume or intensity, at any time or place, so as to disturb, destroy, or endanger
the peace, comfort, repose, or rest of persons of ordinary sensibilities beyond the immediate vicinity of the noise or disturbance, or in such a manner that the sound is clearly audible
or generates perceptible base tone vibrations more than 50 feet from a vehicle, or when such noise exceeds the dBA levels shown in Table 1 hereinbelow.
