SD 3 --,S- -76 --� Ra ZA17-015 Comments by Paige and Lori Kester 116 Londonberry Terrace 3/8/2017 We appreciate the City of Southlake trying to accommodate any land owner's application to rezone their property however this is a clear case where the city should deny the request. When a zoning plan has been in place as long as this one has (30 years!), the land on all sides of the property have been developed to that zoning plan, where the zoning change requested would eliminate 60+% of the city's designed transition buffer, where the site plan application significantly changes the land use, and the adjacent family neighborhood is unanimously opposed, it is incumbent upon the city to only to allow the change for a compelling reason that benefits the city at large (hospital/fire/police, school, safety, traffic, or such) or to deny the change. In this case the change is not for a compelling city reason but for a drive thru Starbucks. If the site plan changed the land use from "General Day Use Offices" to "Light Commercial — no restaurants" I could understand the city's action to approve the change over the adjacent families objections. If the application was for light use restaurants (like Subway) or even high end dine -in restaurants I would hope the city would see this as too large a change from the current land use. But it would a blatant disregard of the citizens for the city to approve a site plan for a drive thru restaurant next to an established residential neighborhood under these circumstances. Our concerns are quality of life: noise, smells, and safety while we live here, and alternatively, being harmed financially by loss of property value if we chose to move from this neighborhood after the city allowed the site plan. Noise is a significant concern as the current zoning would only result in Mon -Sat day use. Light commercial turns into 7day a week 8AM-9PM with medium traffic (25minute visits). But a drive thru restaurant will be 6AM to 11PM 7 days a week with 3 minute visits, several cars idling in line constantly and an outside ordering box, garbage and delivery trucks, etc. Smell is a concern with the restaurants and patio seating. Safety is a concern with restaurant sanitation (i.e. rodents), increased traffic, and the types of businesses. Traffic on White's Chapel heading north is already a problem; a drive thru Starbucks is going to greatly worsen that situation especially in the mornings. As the HOA President, I represent the 23 families that have built their lives in this community which was planned over 15 years ago! I and most (if not all) of my neighbors checked the zoning of the undeveloped land as part of our due diligence in purchasing our homes. We relied on the city's zoning and trust you will keep the zoning to an appropriate use. We are unanimous against this site plan! This site plan was before the City Council on November 15Y, 2016. The applicant was directed by the mayor to seriously consider not proceeding after hearing from the council and after hearing from a large and vocal public opposed to the site plan. The application was withdrawn but now has returned. I think it is important to point out that the land developer has not reached out to the residents. They have not asked for concerns or recommendations that would make their site plan more acceptable. Please consider this. If you asked every citizen in Southlake, "If you lived next to this undeveloped property, and under these circumstances, would you support or oppose the site plan application?" I am certain you would expect nearly unanimous opposition. If you asked every citizen in Southlake, "You don't live next to this property, but knowing the circumstances, would you support or oppose the site plan being changed next to your fellow citizens?" I put forth you would still expect a large majority of opposition. Please let our representative form of government work and oppose the site plan on behalf of the citizens you represent. Attached is a petition of all 23 home owners that oppose the site plan. I am willing to discuss site plan modifications that might bring the sides closer together. We certainly would not support a drive thru restaurant in any scenario but perhaps a stone wall like our HOA built on our east boundary being built on the north side would address some quality of life concerns. I was compelled to pull over and take this quick video to show you what our families see regularly (and this is before the traffic a Starbuck's would bring). In a weird sense I felt fortunate that I had the opportunity to record what we were trying to communicate last night. You will see that the traffic is backed up past the dentist office in both lanes. (Often this traffic backs up to our neighborhood entrance at the peak of the morning but for most of the morning it does back up past the dentist office.) In the middle of the video you will see a black car signalling to turn left on to White's Chapel from the dentist's office and you will see that car quickly gives up and is seen making a daring U -turning in front of our neighborhood entrance. When traffic is bad they use our neighborhood for this u - turn. Please do not think I camped out here all morning waiting for the worst 30 seconds to show you. Although traffic is a major safety and quality of life issue with this significant land use change, there are several others impacts. To name a few: • Hours of operation (0-1 typically 9AM-6PM Mon -Sat vs Site Plan 6AM-11 PM 7 days a week) • Increased Sanitation volume and type of sanitation (with rodents and other issues) • Alcohol sales at restaurants and the issues that brings over 0-1 businesses (drunk driving, increased crime, domestic disputes, etc) • Odor from restaurants is significant vs 0-1 (Remember the city manager made clear that there is no ordinance the city can enforce to protect the residence from odor once this site plan is approved) • Noise! - I heard the statement that the ordering board will only be a whisper by the time it reaches the back yards of Startfort Parc. And although I don't want whispers of "Did you say a double-latte with that?" who is going to regulate the engine noise of the 8-12 cars in line with their motors running (diesel engines and other loud pipes), at times radios blaring, and horns honking to to have the person ahead of them to pull forward • Light - Car traffic pulling through during dark hours will be many orders of magnitude higher with the proposed site plan • Property value - The homes that back against the property line will certainly be harmed and as they are used for comps for the rest of the neighbors it will hurt them. At best one can argue "Maybe you won't lose to much or even not lose" but that is not a reasonable risk to place on families with their single biggest investment. Thank you. I live at 104 Londonberry Terrace in Stratfort Parc. I attended the meeting the last time the developer wanted to change the zoning. He has made no effort to try and contact me or any of the other home adjacent to the lot. I understand he is now trying to split the lot and change the zoning on the front side of the lot as the council members said was his right. However, it is still within the power of the council to see that this is not in the best interest to the community as a whole and really only helps the developer sell his product. I am greatly opposed to the request to rezone what is affectionately called the Donkey Pasture at the corner of Southlake Blvd and White's Chapel Blvd from Office Retail to Commercial Retail. I oppose this request for many reasons including it is inappropriate to rezone a property this close to a residential neighborhood for Retail Commercial when the current land use designation has been in place for 28 years and the negative effect the zoning change will have on this already heavy intersection. In Florida, I have been involved where the exact same thing happened and now a fast food restaurant is located where the Starbucks used to be. I am concerned about the extra hours at night. I am concerned about noise, lights and smells that are associated with the change. My expectation when I purchased the property 18 months ago was that I would be surrounded by office professionals, not drive thru restaurants. If the developer had cared to contact us, I would not even be opposed to regular sit down restaurants in the front area. Going all the way from office to commercial retail seems very much uncharacteristic considering the close proximity to an established residential neighborhood. I would truly feel that the council is breaking faith with its residents if it decides to support a developer whose only skin in the game is the money he would make from the zoning change over the neighborhood who would be most affected by the change. We strongly object to developer's attempts to repackage his failed original plan by using a technicality to try to negate the adjacent neighborhood's concerns and objections. Developer's original plan failed when he faced losing a vote by the city council in his first meeting on this issue. Developer withdrew his proposal at the urging of the mayor rather than have the council record a defeat of the proposal. Following that meeting developer and his investors were overheard to say it didn't matter that the proposal failed initially because they could take the "long way" and get what they want anyway. All of the reasons the proposal failed in the first place still hold true. The constant noise, smells and dangerous traffic flows into S. White Chapel Blvd. were never intended to be allowed on that land. There is no compelling reason to change the zoning while there are many reasons not to change. I have some major concerns regarding the rezoning proposal at Southlake Blvd and White Chapel. I will be at the meeting Tuesday to further discuss, but just so you know what I'm most concerned about: The White Chapel and Southlake Blvd. intersection is not properly set up for a high-volume traffic retail/restaurant development. It is an already busy and risky intersection. Cars would have to be moving westbound to access this area safely. However, eastbound traffic will either have to turn left into oncoming traffic at White Chapel, or do a U turn into oncoming traffic at Shady Oaks. It is currently zoned office/commercial, which is more traffic -volume appropriate for this area of the very busy Southlake Blvd. Second, and my husband will be speaking to this issue further on Tuesday, we are very concerned about this developers tactics. He did not receive the majority vote in November, as was needed due to the 20% affected area of his development. Now he has split the land, so the retail development shifts the 20% affected area north and eliminates the original homes involved. Yet, it's the SAME proposal with the SAME impact on our neighborhood. I realize this move is legal, but it goes against EVERYTHING the laws are trying to protect: homeowners rights. By shifting the affected area he has removed the affected residents a voice on the issue. Red flags should be going up for all the council members, as this is a very precarious and risky door you are opening for other developers, and I hope it's not the type of underhanded business tactic you support in this town. Finally, like everyone else in our neighborhood, we did our due diligence on that undeveloped land prior to making an investment in Southlake. We weighed the benefit/risk to being adjacent to an office/commercially zoned property and we decided we were fine with that. If it had been zoned retail/restaurant we would have looked at other areas, including Colleyville, and possibly made a home investment elsewhere. "Bait and switch" is not a good look for any town council, but that is exactly what is happening. We will be coming to the meeting with a petition of collective Southlake voices who share similar concerns. I look forward to hearing and speaking with you Tuesday evening. This constant challenge does not go overlooked. I am writing to express my opposition to Case Number ZA17-015, the proposed zoning change for Southlake Commons. I know many of my neighbors have already voiced their opposition to this zoning change as well as thousands of other Southlake residents who have signed a petition as such. I am particularly concerned about the prospect of a drive-thru facility being a part of the proposed building plan. The intersection of White's Chapel Boulevard and Southlake Boulevard is already a highly traveled one. I have seen countless accidents at this intersection without the addition of 500-900 cars the new drive-thru is expected to bring. These were not just bumper -tap type accidents, either. My family and I regularly take walks in and around our neighborhood. I have seen accidents where cars have managed to jump the curb in front of White's Chapel on the 1709 side. This is disturbing to me not just as a motorist but as a pedestrian. Every time I see this kind of accident I think to myself, "We could have been hit by that car." I have seen a car jump the curb on White's Chapel Boulevard just next to First Financial Bank and uproot a tree. If you drive along White's Chapel in this area you will notice a plant in the parkway that does not match the other trees. Again, I take pause thinking we could have been hit if we were walking at the wrong time. I have been on my way home numerous times only to find a Southlake DPS Officer directing traffic through that intersection thanks to another accident. I can only imagine the kind of danger that will be created at that intersection as well as the adjacent area if we add hundreds of cars into the mix. These will obviously be drivers in a hurry to get a cup of coffee and be on their way. Why do I say that they are obviously in a hurry? Houses are put on lots where there is barely 15 feet between house. There are very small yards, that you could not even put a pull in the back.
