Subject: Resolution No. 17-012, Certify unopposed candidates for the May
6, 2017 General Election
Action
Requested: Approve Resolution No. 17-012, receive City Secretary certification
of unopposed candidates for the General Election for May 6, 2017.
Background
Information: On February 7, 2017, the Council approved Resolution No. 17-005
to call the May 6, 2017 General Election to determine the positions
of City Council for Places 1 and 6.
The filing period for the 2017 General Election began January 18,
2017 and ended February 17, 2017. The City Secretary received
one application for each place. The filing deadline for write-in
candidates of February 21, 2017 has also passed.
As the authority responsible for having the official ballot prepared,
the City Secretary shall certify in writing that the candidates are
unopposed for the election scheduled to be held on May 6, 2017.
The certification has been incorporated into Resolution No. 17-012
(Item 4E). The unopposed candidates are:
City Council, Place 1 Shahid Shafi
City Council, Place 6 Gary Fawks
Following receipt of certification and pursuant to Subchapter C of
Chapter 2 of the Election Code, the Council may declare each
unopposed candidate elected to office. A companion item, Item 4F,
is the official order canceling the May 6, 2017 General Election.
Also pursuant to Subchapter C of Chapter 2 of the Election Code,
the unopposed candidates will be issued their certificates of
election and will be sworn into office on May 16, 2017.

RESOLUTION NO. 17-012
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SOUTHLAKE, TEXAS, RECEIVING CITY SECRETARY’S
CERTIFICATION OF UNOPPOSED CANDIDATES FOR THE MAY 6,
2017 GENERAL ELECTION AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City of Southlake, Texas (“City”) is a home rule city acting under
its charter adopted by the electorate pursuant to Article XI, Section 5 of the Texas
Constitution and Chapter 9 of the Local Government Code; and,
WHEREAS, the City of Southlake Charter provides that City Elections shall be
held in accordance with the laws of the State of Texas; and
WHEREAS, Section 3.004(b) of the Texas Election Code provides that the
governing body of a municipality shall be the authority to order a General Election for
the purposes of electing members to the governing body; and
WHEREAS, the Council approved Resolution No. 17-005, calling the May 6,
2017 General Election; and
WHEREAS, the authority responsible for having the official ballot prepared shall
certify in writing that a candidate is unopposed for election to an office if, were the
election held, only the votes cast for that candidate in the election for that office may be
counted.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SOUTHLAKE, TEXAS, THAT:
Section 1. Certification of the City Secretary. As the authority responsible for
having the official ballot prepared, the City Secretary hereby certifies that the following
candidates are unopposed for election to office for the election that was scheduled to be
held on May 6, 2017:

City Council, Place 6 Gary Fawks Three years
Section 2. Posting of Canceled Election. Notice of the canceled election shall be
posted as required by Chapter 2 of the Election Code.
Section 3. Necessary Actions. The Mayor and the City Secretary of the City, in
consultation with the City Attorney, are hereby authorized and directed to take any and
all actions necessary to comply with the provisions of the Code in carrying out and
conducting the election, whether or not expressly authorized herein.
Section 4. Effective Date. This resolution shall be effective upon its adoption.
PASSED AND APPROVED this 7th day of March, 2017.
