No. 480, Section 37, "DT" Downtown District to allow Vehicle Sales and Demonstrations as a permitted use with approval of an SUP (ZA16-103) 6F) Approval of a Specific Use Permit for Vehicle Sales and Demonstrations to allow an approximately 4,565 square foot Tesla store in the “DT” Downtown District (ZA16-104) 6G) Approval of a Specific Use Permit for six electric charging spaces behind the proposed Tesla store (ZA16-105) Location: 1401 Federal Way and 257 Grand Ave., also addressed as 251 and 291 Grand Ave. ZA16-103, ZA16-104, ZA16-105 2 Aerial View 3 4 5 January 17, 2016; Approved at 1st reading (6-0) subject to the staff report dated January 10, 2016 noting that we are amending Section 37.2 of the Zoning Ordinance under Schedule of Uses to allow Vehicle Sales and Demonstrations as a permitted use by Specific Use Permit and also amending Section 37.3 of the Zoning Ordinance under the definition section to include the following.   Vehicle Sales and Demonstrations - A display of 10 or less vehicles for the purposes of demonstrations, test drives, service and new or pre-owned sales. No more than 2 vehicles on site may be pre-owned. Noting that the applicant has agreed to meet with City staff to craft a more comprehensive understanding of the definition of the word “service” and what would be allowed and not allowed as a part of this ordinance. 6E. City Council Action (ZA16-103) 6 Council discussion of “service” language at 1st reading: No exterior work on vehicles related to body work or repair No engine or motor work or repair including tune ups, oil changes, transmission or air conditioning service No changing of fluids or oil No lifting of a vehicle with a jack or car lift No detailing work including the washing, waxing, vacuuming and shampooing of the vehicle No tire maintenance such as installing new tires, rotating tires or tire repair     Staff – more exclusionary approach 7 ZA16-103 Owner requests that the Zoning Ordinance be amended as follows:  (Changes in red added since 1st reading) SECTION 37 “DT” DOWNTOWN DISTRICT   37.2 SCHEDULE OF USES Under Land Use Category Commercial Uses – Retail Sales or Service Vehicle sales and demonstrations are permitted with a Specific Use Permit   8 ZA16-103 Owner requests that the Zoning Ordinance be amended as follows: (Changes in red added since 1st reading)   37.3 DEFINITIONS Vehicle Sales and Demonstrations - A display of 10 or less vehicles for the purposes of demonstrations, test drives, service and new or pre-owned sales subject to the following criteria:   Lease space and parking areas are limited to the specified geographical area as illustrated in Attachment A. No more than 2 vehicles on site may be pre-owned. A maximum of 6,000 square feet of floor area within a building can be allocated to vehicle sales and demonstrations for each individual permitted use. No more than 20,000 square feet of vehicle showcase area within buildings are permitted within the specific “DT” Downtown zoning district. Service shall not be performed on more than one vehicle at a time. The term “Service” is limited to specifically exclude the following. a. No exterior work on vehicles related to body work or repair b. No engine or motor work or repair including tune ups, oil changes, transmission or air conditioning service c. No changing of fluids or oil d. No lifting of a vehicle with a jack or car lift e. No detailing work including the washing, waxing, vacuuming and shampooing of the vehicle f.
