Retail/Restaurant, which includes an approximately
9,222 square foot, one-story building on approximately
1.27 acres within the approximately 15.5 acre Kimball
Park development.
Location: 2112 E. State Hwy. 114 and generally located
approximately 850 feet northwest of the intersection of
E. State Hwy. 114 and N. Kimball Ave.

Permitted Uses
Lot 1: “HC” Hotel District to also include
•Restaurant and Bar, which are accessed from interior lobby
•Conference Center totaling 8,738 sq. ft. of meeting and support space
Lots 2, 4 & 5: “C-2” Local Retail Commercial District Uses limited to:
•Restaurant (Bar is a permitted Accessory Use) (No fast food restaurants)
•Coffee shop with drive-through service –Lot 4 only
•Retail
•Health and Well Being Businesses, Spa
Lot 3: “O-2” Office District Uses to include:
•Multi-story office buildings up to 4 above grade floors
•Allow for a single level parking deck
Lot 6: Open Space lot with natural vegetation, existing creek channel, new plantings and existing creek
channel, new plantings and detention area

•Parking is allowed as shown on the Concept and Site Plans with parking agreements
•Bufferyards are not required along internal lot lines
•Deliveries are limited to 7:00 a.m, to 7:00 p.m.
•Trash pick-up is limited to 7:00 a.m. to 7:00 p.m. Mon –Sat
•Property line adjacent to MF properties will have minimum 8’ vegetative screen
•Loading zones are provided as shown on the concept and site plans
•Building lines are as shown on the concept and site plans
•Overall impervious coverage for the site as a whole shall be a maximum of 70%
•Articulation will be permitted as shown on the elevations for the hotel, office building and
parking deck.
•Allow for a teller drive-up lane and window on the west elevation of the office building on
Lot 3 to facilitate a banking tenant and also allow a reduction of 12 provided parking spaces
in that area.
•Vary from the additional landscape requirements for a parking garage as this development
proposes a single deck constructed internal to the ground level parking perimeter.
S-P-2 Regulations for Lot 5
C-2 Local Retail Commercial District regulations with the following
exceptions:
•Single story 9,222 footprint building and 54 parking spaces with outdoor
dining and plaza space
•Multi-tenant structure with restaurant, retail and/or health and well being
uses (massage therapy, fitness, spa, health related products and services)
•Comply with Zoning Ordinance, but conform to Concept Plan
•Majority of parking requirements on-site and the remaining subject to a
combined parking agreement with other lots

and horizontal articulation on all facades visible from State Hwy. 114 to allow vertical and
horizontal articulation as shown on the proposed elevations and Site Plan.
2)Variance to Zoning Ordinance No. 480, as amended, Section 43.9.c.1.e requiring
exposed columns to be constructed of or clad in the same masonry material as the
principal structure to allow concrete stucco columns with painted metal at the top.
3)Variance to Landscape Ordinance No. 544-B, as amended, Section 3.4 requiring parking
lot landscape islands to have a minimum width of 12’ to allow the parking islands south of
the proposed building to have a width of approximately 9’ as was depicted on the
approved Concept Plan.
