EXECUTIVE SESSION Chairman Forman called for an Executive Session at 6:32 p.m. Chairman Forman called the meeting back to order at 7:05 p.m., no action taken. 3. APPROVAL OF THE MINUTES A motion was made to approve the minutes from the November 17, 2016 meeting. ADMINISTRATIVE COMMENTS Dennis Killough, Deputy Director, announced an event "Corridor Planning Committee Meeting" located at the Marq, January 10th 2017 at 6:00 P.M. Dennis Killough, Deputy Director, announced a second event "Meet the Mayor" located at the Durham Intermediate School, 801 Shady Oaks Drive on January 11th 2017 at 5:30 P.M. Chairman Forman announced that the agenda items would be taken out of order and would be starting with Item No. 7. REGULAR AGENDA: 7. ZA16-100, SITE PLAN FOR VERIZON WIRELESS ON PROPERTY DESCRIBED AS LOT 1, BLOCK 1, SOLANA ADDITION, AN ADDITION TO THE CITY OF SOUTHLAKE, TARRANT COUNTY, TEXAS AND LOCATED AT 500 W. DOVE RD. CURRENT ZONING: "NR -PUD" NON-RESIDENTIAL PLANNED UNIT DEVELOPMENT DISTRICT. SPIN # 1. PUBLIC HEARING Richard Schell, Principal Planner, gave a brief presentation of Item ZA16-100. Opened for questions. Applicant, Kathy Zibilich 8144 Walnut Hill Ln. Dallas TX- gave a brief presentation regarding the modifications of the existing loading dock. She spoke in details that the existing dock is a safety hazard for all deliveries due to the slop of the ramp. She also stated that the reason why this particular facility accepts such large cargo is because it's the only equipped location that can withstand such large size cargo. Applicant opened for questions. Commission asked if the delivery trucks made day time or night time deliveries. Applicant stated that the vast majority of the deliveries are made during work hours. Commission asked about the amount of deliveries per week. Applicant stated that she spoke with the Office Manager and explained that 90 to 95 percent of the deliveries are made during the day a few times a week. Commission asked the applicants willingness to add both a buffer yard and a screen wall. Chairman Forman opended the public hearing. Doug Harsy, 2804 Tyler Street, Southlake, TX- spoke in opposition stating disagreement with the applicant and the request for the Site Plan change. Concerned about the noise and how it would interfere with the neighboring residents. He was also concerned about the original plans and how they were altered with out any notification to the public. He would like to see either a buffer yard or screen wall to create a barrier between the facility and the residents. Commission asked what his preferences are regarding the barrier. Doug Harsy- stated that he would prefer a screen wall. Applicant returned to podium for further questions. Commission asked if there have been any city complaints concerning the operating dock. Applicant explained that she spoke with the Operations Manager and was told that there have not been any city complaints regarding the loading dock. The Commission discussed the Site Plan and agreed that the loading dock should have a screen wall, considering that the delivery trucks deliver large equipment. Stated that the dock should be modified to make it safer for all deliveries. Commission asked the applicant if she could provide the rendering of the wall and the architectural drawings of a lowered dock. Applicant agreed to provide additional information. The applicant requested to table Item No. 7, agreeing to provide additional information for the next scheduled meeting. A motion was made to table Item No. 7, ZA16-100, at the request of the applicant, for the next scheduled meeting for January 19, 2017. PUBLIC HEARING David Jones, Principal Planner, gave a brief presentation of the proposed site plan. Applicant, Brad Williams, representing Jenkins Organization, opend for questions. Commission asked about the trees that were there before but are now removed. Applicant stated that the landowner removed the trees not his client. Commission asked if the previous plans for additional landscape are still being considered. Applicant continued to explain that there will be no additional landscape changes and the Site Plan will remain the same as presented. Applicant Rob Dijon- Jenkins Organization, came forward and spoke of the proposed Site Plan and clarified that there will not be any additional landscape. Chairman Forman opened the public hearing. Applicant, Justin Lansdowne, G&A Consultants, 144 Oldstown Blvd. Argyle, TX - presented their plans and stated that the neighbors had concerns about the drainage; he provided information regarding those concerns and presented the onsite storm sewer system that will direct any run off around the house into the retention pond. Chairman Forman opened the public hearing. Jason Parker, 1604 Pheasant Lane, Southlake, TX- spoke in opposition stating the disagreement with the architect and the drainage issues with the water flowing to the rentention pond. Chairman Forman closed the public hearing. Applicant Justin Landsdowne returned the podium to discuss issues that were presented; stated that the pond outfall is located 30 feet from the property line and is not erosive. Commission recommended that the applicant speak with the neighbors regarding the Proposed Plan. Staff concluded that the location of the awning is only suitable for drop off. Commission asked if the whole building will be the ambulatory center. Staff clarified that the whole building will be used by the ambulatory surgery center only. Applicant, Konstanine Bakintas, 4550 Hwy 360, Grapevine, TX- came forward and opened for questions. Commission asked if the canopy will match the building. Applicant stated that the canopy will have the same material nd roof tile to match the building. Chairman Forman opened the public hearing. Staff discussion of the Ordinance Amendment, questions if the Amedment is permitted or not permitted. Staff continued to discuss how the property can be approved due to the Ordinance. Applicant Jason Casell, representing RPAI, 1560 Southlake Blvd. opened for questions. Commisison asked the applicant why he chose those particular parking spots. Applicant implied that those were the only parking spots approved by everyone surrounding that area. Commission asked about the test driving cars. Applicant clarified that only a few displayed cars will be available for test driving. Commission asked about the space of the building for the vehicles. Applicant stated that there is adequate space for all vehicles. Applicant stated that they woud take full responsibility of any articular modifications they make; stated that they would also take full responsibility to any part of the building they alter. Commission asked for some clarification regardinf the Specific Use permit. Applicant clarified that there is a lease term following the Specific Use Permit, but would also consider expanding once the lease is over. Commission asked the applicant if they would be servicing any vehicles as far as oil changes etc. Applicant stated that the plan is to not promote any vehicle maintanence but too assist drivers with any minor vehicle updates. Applicant, Curtis Young- opened for questions and gave a brief presentation of the proposed Site Plan and Plat Showing. Commission asked about the additional lots in that area and if any future plans are being considered. Applicant stated that he is not aware of future plans for those lots. Commission talked about the existing fence and asked the applicant ifthey would maintain it. Appliant clarified that they will not maintain he existing fence because the fence does not belong to them. He also stated that the existing fence belongs to the residents and they will maintain it.
