PROJECT: Sign Variance for Southlake Professional Park
EXECUTIVE
SUMMARY: Southlake Professional Park, LLC is requesting approval of variance to Sign
Ordinance No. 704-1 to allow a business monument sign that exceeds the
maximum allowed number of sign panels in order to serve all three sites within
the development. The monument sign is proposed to be located at 1825 E.
Southlake Blvd., Southlake, Texas.
REQUEST
DETAILS: The newly constructed Southlake Professional Park development is generally
located on the southeast corner of East Southlake Blvd. and Westwood Drive
and consists of three (3) individually platted lots (sites).
Sign Ordinance No. 704-1 allows a maximum number of six (6) sign panels for
any business monument sign located along a Regional Boulevard (FM 1709
and FM 1938). The applicant is requesting one (1) business monument sign
with eight (8) sign panels that will serve all three (3) sites; forgoing the ability to
have any monument signage on the remaining lots.

BACKGROUND INFORMATION
OWNER: Southlake Professional Park, LLC —John Lee
PROPERTY SITUATION: 1825, 1835 & 1845 E. Southlake Blvd.
LEGAL DESCRIPTION: Lots 25R-1A, 25R-1B and 25R-1C, Block 1, Woodland Heights
Addition
CURRENT ZONING: "S-P-1" Detailed Site Plan District
HISTORY: -A zoning change for the northern portion of Lot 25, Block 1 was
approved by City Council March 27, 1990, for C-1 Neighborhood
Commercial District (ZA90-003).
-A plat revision for Lots 25R1 and 25R2, Block 1, Woodland
Heights Addition was approved by City Council September 21,
1993 (ZA93-068);
-A site plan was approved December 16, 1997 for two two-story
buildings having approximately 9,900 square feet of floor area
each (ZA97-149).
- A zoning change and site plan for Southlake Professional Park
from "C-1" Office District to "S-P-1" Detailed Site Plan District that
includes three (3) general medical office buildings totaling
approximately 17,922 square feet was approved by City Council
on August 19, 2014. (ZA14-070)
- A plat revision dividing one existing lot into three lots was
approved by City Council on February 17, 2015. (ZA14-154)
- A business monument sign permit was approved by city staff for
this location in June 2016, however, the sign was not built.

SIGN BOARD: January 5, 2017; Approved (6-0) as presented, subject to the Staff
Report dated December 30, 2016, and specifically granting the
requested variance related to the maximum number of sign
panels.
STAFF COMMENTS: The application exhibits are attached and/or hyper-linked to this
report. City Council approval of the proposed signage does not
eliminate the requirement for appropriate sign application
submittals prior to installation of signs. Please contact Seantay

Variance Criteria:
9.6.2 VARIANCES
a. Variance Authorized. The City Council may authorize
variances to any restriction set forth in this ordinance,

including but not limited to the number, type, area, height, or
setback of signs, or any other aspect involved in the sign
permitting process.
b. Approval Standards. In granting any variance, City Council
shall consider the following criteria:
(i) Special conditions exist which are peculiar to the land,
structure or building involved and are not applicable to
other lands, buildings or structures in the same zone.
The City may attach such conditions to granting all or a
portion of any variance necessary to achieve the
purpose of this ordinance, and;
(ii) The strict interpretation of the provisions of the
ordinance would deprive the applicant of rights
commonly enjoyed by other properties in the same
zone under the terms of the ordinance, and;
(iii) The special conditions and circumstances do not result
from the actions of the applicant and such conditions
and circumstances do not merely constitute pecuniary
hardship or inconveniences, and;
(iv) Granting the variance will meet the objectives of the
ordinance and not be injurious to the adjoining property
owners or otherwise detrimental to the public welfare,
and;
(v) The request will be the minimum variance necessary to
alleviate the special hardship or practical difficulties
faced by the applicant in meeting the requirements of
this ordinance; and;
(vi) Granting of the variance will be in harmony with the
spirit and purpose of this sign ordinance.
(vii) Granting of a variance shall be specific to the subject
sign(s). Any modification of the signage approved by
the variance or the installation of new or replacement
signage that does not meet the specific requirements
of the City Council variance approval is prohibited and
will be deemed non-compliant.
Application Process. Any request for a variance shall be made to
the Administrative Official and be accompanied by a completed
application and a non-refundable filing fee in the amount specified
in the current fee schedule adopted by City Council. The sign
variance will be considered by the City Council following a
recommendation by the Sign Board. The Sign Board's
recommendation will be forwarded to the City Council for their
consideration.
