2016-10-27 CITY OF SOUTHLAKE TEXAS ZONING BOARD OF ADJUSTMENT MEETING: October 27. 2016 LOCATION: 1400 Main Street, Southlake, Texas Executive Session-Executive Conference Room, Suite 268 of Town Hall Regular Session-City Council Chambers Regular Session: Members Present: Chair Kourosh Panahy, Board members: Gina Phalen, Jeff Medici, Brett Nickel, David Treichler and Michael Quinones Members Absent: Vice Chair Ronell Smith, Board members Rob Baker and Robert Kemins. Staff Present: Dennis Killough, Deputy Director of Planning & Development Services, Richard Schell, Principal Planner, and Karen Heistand, Board Secretary. Agenda Item No. 1 —Call to Order: Chair Panahy called the meeting to order at 6:30 p.m. Agenda Item No. 2 — Approval of the Minutes: Chair Panahy opened the discussion of the minutes of the Zoning Board of Adjustment meeting held on October 13, 2016 A motion was made to approve the minutes of the Zoning Board of Adjustment meeting held on October 13, 2016. Motion: Medici Second: Phalen Ayes: Treichler, Quinones, Phalen, Panahy, Nickel and Medici Nays: None Abstain: Vote: 6-0-0 Motion: Carried Agenda Item No. 3 — Administrative Comments: Richard Schell, Principal Planner announced that the next ZBA meeting is scheduled for November 10, 2016 Agenda Item No. 4 — ZBA-716, Variance to Ordinance No. 480, Section 34.2(a), requiring accessory buildings on a permanent foundation to be located no closer than 10' to a property line in the rear yard on property described as Lot 9, Block 2, Palomar Estates, an addition to the City of Southlake, Tarrant County, Texas, located at 920 Palos Verdes Trail, Southlake, Texas 76092. Current Zoning "R-PUD" — Residential Planned Unit Development District. Planner Schell presented details of the case with slide presentation to the Board, explaining the request for a Variance to Ordinance No 480, Section 34.2 (a), requiring accessory buildings on a permanent foundation to be located no closer than ten feet (10)' to a property line in the rear yard to allow an approximately 475 square foot cabana to be located approximately nine feet (9') from the rear property line. William Palmer, 920 Palos Verdes Trail, the applicant and property owner, once sworn in, presented testimony and was available to answer questions of the Board. Chair Panahy asked if there were those in the audience who wished to speak in favor of the request. There being none, Chair Panahy asked if there were those in the audience who wished to speak in opposition of the request. There being none, Chair Panahy closed the public hearing and opened the item for discussion. A motion was made to approve case ZBA-716 Motion: Medici Second: Nickel Ayes: Treichler, Phalen, Medici, Nickel and Panahy Nays: None Abstain: None Vote: 5-0-0 Motion: Carried Agenda Item No. 5 - ZBA-717, Variance to Ordinance No 480, Section 33 14, requiring a minimum lot size of one acre for an on-site sewage facility (OSSF) on property described as Tract 28, I.G Belcher Survey, Abstract No 30A, City of Southlake, Denton County, Texas and located at 1051 Westpark Circle, Southlake, Texas 76092. Current Zoning: "MH" — Manufactured Housing District. Planner Schell presented details of the case with slide presentation to the Board, explaining the request for a Variance to Ordinance No. 480, Section 33.14, requiring a minimum lot size of one acre for the use of an on-site sewage facility (OSSF) to allow an OSSF on an approximately 0.34 acre lot. Chair Panahy opened the public hearing and called upon the applicant or the applicant's representative to make such comments and present evidence as the applicant should desire. Binish Kalani, 1051 Westpark Circle, Southlake, Texas, the applicant and property owner, and James M. Sims, P. E., 6935 Craig Street, Fort Worth, Texas, Geotechnical Engineer and representative of the property owner, once sworn in, presented testimony and were available to answer questions of the Board Chair Panahy asked if there were those in the audience who wished to speak in favor of the request.
