2016-08-25 CITY OF SOUTHLAKE TEXAS ZONING BOARD OF ADJUSTMENT MEETING: August 25, 2016 LOCATION: 1400 Main Street, Southlake, Texas Executive Session-Executive Conference Room, Suite 268 of City Hall Regular Session-City Council Chambers Regular Session: Members Present: Chair Kourosh Panahy, Vice Chair Ronell Smith, Board members Rob Baker, Robert Kemins, and Gina Phalen, Jeff Medici, David Treichler. Members Absent: Board members Brett Nickel. Staff Present: Dennis Killough, Deputy Director of Planning & Development Services, Richard Schell, Principal Planner, and Karen Heistand, Board Secretary. Agenda Item No. 1 -Call to Order: Chair Panahy called the meeting to order at 6:30 p.m. Agenda Item No. 2 - Approval of the Minutes: Chair Panahy opened the discussion of the minutes of the Zoning Board of Adjustment meeting held on August 11, 2016. A motion was made to approve the minutes of the Zoning Board of Adjustment meeting held on August 11, 2016. Motion: Kemins Second: Phalen Ayes: Treichler, Smith, Baker, Kemins, Phalen and Panahy Nays: None Abstain: Medici Vote: 6-0-1 Motion: Carried Agenda Item No. 3-Administrative Comments: Richard Schell, Principal Planner welcomed two new board members, David Treichler and Michael Quinones and announced new Chair -positions-appointed-to-Kourosh-Panahy as Chair and-Ronell-Smith-as-Vice-Chair--The-next Z-BA meeting is scheduled for September 15, 2016. Agenda Item No. 4- ZBA-711, Special Exception Use Permit per Ordinance No. 480, Section 44.12 (2), for the construction of accessory buildings or structures of a size or aggregate size greater than permitted on property described as Lot 8, J. Thornhill No. 1505 Addition, an addition to the City of Southlake, Tan-ant County, Texas and located at 801 S. Peytonville Ave., Southlake, Texas. Current Zoning: "SF-1A" - Single Family Residential District. The applicant has submitted a request to formally withdraw this case. Motion: Medici Second: Baker Ayes: Baker, Phalen, Medici, Smith and Panahy Nays: None Abstain: None Vote: 5-0-0 Motion: Carried Agenda Item No. 5 — ZBA-714, Special Exception Use per Ordinance No. 480, Section 44.12(1) for a servants or family quarters on property described as Lot 16, J.J. Freshour No. 521 Addition, an addition to the City of Southlake, Tarrant County, Texas and located at 2603 Florence Road, Southlake, Texas. Current Zoning: "AG" —Agricultural District. Principal Planner Schell presented details of the case to the Board, explaining the request is for a Variance to Ordinance No. 480, Section 44.12(1), which the applicant is requesting approval to allow an approximately 1,606 square foot family or servants quarters on the second floor of a garage addition to the principal structure. The new home under construction since 2015 is approximately 15,629 square feet of livable area. An existing home of 1,777 square feet will remain as a second dwelling unit for employees on the property. Chair Panahy opened the public hearing and called upon the applicant or the applicant's representative to make such comments and present evidence as the applicant should desire. Candace Vogt, 2825 Mona Vale Rd., Trophy Club, TX, a daughter representing the applicants, and Jimmy Lambert, PO Box 1802, Springtown, TX, contractor of the project of new addition, once sworn in, presented testimony and were available to answer questions of the Board. Chair Panahy asked if there were those in the audience who wished to speak in favor of the request. There being none, Vice Chair Panahy asked if there were those in the audience who wished to speak in opposition of the request. Henry Kleespies, 1613 Pheasant Lane, Southlake, TX, commented that drainage would become an issue on his property with new addition. Chair Panahy asked if there were those in the audience who wished to speak in rebuttal of the request. Jimmy Lambert, PO Box 1802, Springtown, TX, contractor of the project of new addition responded to the issues regarding drainage. Chair Panahy asked if there was anyone else in the audience who wished to speak in opposition or rebuttal of the request. There being none, Chair Panahy closed the public hearing and opened the item for discussion.
