Item 6G Presentation 2017 STANDARDS OF CARE Item 6G Item 6G is the consideration of the annual approval of a Standards of Care by Ordinance. Annual approval of a Standards of Care ordinance is required by Texas State Law. 1 Requested Action City Council approval of 2017 STANDARDS OF CARE presented in Ordinance No. 1164, 2nd Reading and Public Hearing Standards for elementary-age recreation programs, including Camp Mania, offered by the Community Services Department This item is seeking City Council’s approval of the proposed 2017 Standards of Care for the City’s elementary-age recreation programs, including Camp Mania, offered by the Community Services Department. The Standards of Care is presented in Ordinance No. 1164, 2nd Reading and Public Hearing. 2 Texas Human Resources Code Section 42.041(b)(14) “… an elementary-age recreation program operated by a municipality is not required to obtain a license from the state provided that the governing body of the municipality annually adopts standards of care for such programs by ordinance after a public hearing.” Annual adoption of an ordinance for the Standards of Care is required for the City’s elementary-age recreation programs in compliance with Section 42.041 of the Texas Human Resources Code. 3 Staff responsibilities Participant enrollment requirements Staffing ratios Staff qualifications and training Facility standards Health and safety standards Mechanisms for inspecting, monitoring and enforcing care standards Standards of Care Provisions The proposed 2017 Standards of Care are intended to be the minimum standard by which the City of Southlake and Community Services Department operates the City’s youth programs. The Standards of Care includes staff responsibilities, enrollment requirements, staffing ratios, staff qualifications and training, facility standards, health and safety standards and mechanisms for inspecting, monitoring and enforcing care standards. Please refer to the complete Standards of Care document provided in your packet for details of the specific provisions. 4 Youth programs operated by the City are Recreational in nature Not licensed by the State of Texas as day care programs City Youth programs have received an “exemption determination certificate” from Texas Department of Family & Protective Services Community Services Department As a requirement by the State, the programs operated by the City are recreational in nature and are not licensed by the state of Texas as day care programs. The item also delivers on the Corporate Objective to Achieve the highest standards of safety & security 6 2017 Standards of Care (Ord. No. 1164): Requires no additional funding Financial Considerations Approval of the proposed Ordinance No. 1164, 2017 Standards of Care, will require no additional funding by the City. 7 Board / Council Review Park Board recommended approval (6-0) Sept 12, 2016 City Council, 1st Reading (6-0) Sept 20, 2016 City Council, 2nd Reading & Public Hearing Oct 4, 2016 Parks and Recreation Board recommended approval with a vote of 6-0 at their Sept 12, 2016 meeting.   City Council approved (6-0) 1st Reading of the Ordinance at the September 20, 2016 meeting. The Ordinance consideration for the 2nd Reading and Public Hearing by City Council is October 4, 2016. 8 Questions?
