1TY Or SOUTHLAI<E Department of Planning & Development Services STAFF REPORT June 13, 2016 CASE NO: ZA16-037 PROJECT: Specific Use Permit for Temporary Construction Facilities for TD Ameritrade EXECUTIVE SUMMARY: Adolfson and Peterson, is requesting approval of a Specific Use Permit for Temporary Construction Facilities for TD Ameritrade on property described as Lot 1 R1 R1, Block 1, Sabre Group Campus Addition, an addition to the City of Southlake, Tarrant County, Texas and located at 1051 W. Kirkwood Blvd., Southlake, Texas. Current Zoning: "NR-PUD" Non-Residential Planned Unit Development District. SPIN Neighborhood # 1. REQUEST DETAILS: Adolfson and Peterson, is requesting approval of a Specific Use Permit for seven (7) temporary construction trailers on the TD Ameritrade site for a period of two (2) years. The construction trailers will be located in the south area of the property with an access drive onto W. Kirkwood Boulevard. The construction trailers will include one (1) office at 2,688 square feet, four (4) offices at 1,444 square feet each and two (2) offices at 722 square feet each for a total of 9,908 square feet of office space. Fourteen (14) concrete paved parking spaces will provided for the trailers (two parking spaces are required for each construction trailer). Each trailer (office) will have landscape plantings consisting of one (1) five-gallon shrub per four (4) linear feet around the required skirting (excluding entrances). The plan also identifies the approximate area for storage containers. Additional information for the site provided by the applicant: 1. The construction trailers will be partially screened from W. Kirkwood Boulevard by several tree preservation areas. 2. A gravel construction entrance and drive will be installed to the trailer parking lot. 3. The construction fence with fabric screening and gate will be installed along W. Kirkwood Boulevard at the construction staging area. 4. The applicant has provided a construction traffic plan for the project. This item was tabled until the June 7, 2016 City Council meeting. The applicant has provided a revised layout of the construction trailers within the site as shown in Attachment C, pages 6 and 7. The construction trailer compound has been revised to move west approximately 847 feet from the 6-foot screening fence along W. Kirkwood Boulevard. The construction trailers have been grouped together and include the required perimeter shrubs around the construction trailers. An 8-foot wood interior fence is located behind the construction entrance off W. Kirkwood Boulevard. A sight line diagram showing the location of the construction trailers, fencing and trees is provided in Attachment C, page 8. (ZA16-012) PLANNING AND ZONING COMMISSION: May 5, 2016; Approved (5-0) subject to the Staff Report dated April 27, 2016; specifically noting within the staff report a date change on Attachment C, page 1, relating to the completion of TW King access road to be changed to August 2017; and specifically noting the applicant's willingness to strictly maintain the quality of construction fencing and screening and repair as needed; specifically noting the applicant's willingness to meet with the Kirkwood Hollow neighborhood regarding additional screening and fencing alternatives along the Kirkwood Blvd. side of the site; and in regards to the Specific Use Permit, time would be up to two years and/or within 90 days of the Certificate of Occupancy. CITY COUNCIL: May 17, 2016; Approved (6-0) a motion to table until the June 7, 2016 City Council meeting. June 7, 2016; A motion was made to approve Resolution No. 16-022, (ZA16-037), Specific Use Permit for Temporary Construction Facilities for TD Ameritrade subject to Staff Report dated May 31, 2016, noting the following: • Noting the approval of this Specific Use Permit will expire December 31, 2016; • Noting the construction entrance will be a right-in / left-out only entrance; • Noting the site will be accessed from the west or southbound lanes of Kirkwood Boulevard; • Noting the secondary screening fence will be located at the top of the hill at a height that would adequately screen the trailers from Kirkwood Boulevard; • Noting that the screening fence will be constructed of wood; • Noting all traffic control devices represented by the applicant will be installed and utilized for the duration of the SUP; • Council is approving the relocation of the shrubs that are required and depicted on tonight's presentation from surrounding the Case No. Attachment A ZA16-037 Page 2 construction trailers and placing those instead at the construction entry area along the screening fence; • Noting the applicant's agreement to relocate the concrete washout stations and noting that none of those concrete washout stations will be located north of the northern most construction trailer; • Noting the applicant's agreement to move the casting beds to the north side of the parking garage; • Requiring the applicant to immediately work towards obtaining Corps of Engineer approval necessary to complete the T.W King project and is committed to closing the current construction entrance by December 31, 2016 and noting that if the applicant is unable to construct T.W. King to a construction-useable state by December 31, 2016, they will be required to come back to Council for an extension of the SUP, but noting they can come directly to Council rather than through the normal process through the Planning and Zoning Commission; • Subject to the traffic pattern exhibits demonstrated tonight as part of the presentation; • Noting the applicant will have a designated communication liaison to work directly with the Kirkwood Hollow Homeowner's Association (HOA) representative and will be available to address concerns as necessary and will provide an update to the HOA representative no less than every two weeks; and, • Noting the construction work hours will be in compliance with the Southlake Noise Ordinance and limiting heavy equipment movement in and out of the site to 7:00 a.m.-7:00 p.m. STAFF COMMENTS: Due to the limited scope of this request, there are no staff review comments. The City Council shall consider the following in determining whether to grant a Specific Use Permit for a temporary construction and/or sales facility according to the Comprehensive Zoning Ordinance No. 480, Section 45.18, as amended: 1) The City Council may grant a specific use permit to increase the maximum parameters set forth for temporary construction facilities by Section 34 of this ordinance and may grant a specific use permit to allow temporary sales facilities subject to the following standards: (a) Temporary facilities must be at least two hundred (200) feet from any occupied residence. (b) Temporary facilities must be skirted on the front and sides. (c) Temporary facilities must provide foundation landscape planting consisting of one (1) five-gallon shrub per four (4) linear feet around skirting (excluding entrances). (d) Each temporary facility shall have at least two (2) paved parking places (two (2) deep, tandem parking is not permitted). Case No. Attachment A ZA16-037 Page 3 (e) Temporary facilities may also be subject to other requirements as deemed necessary in order to promote public health, safety, welfare and aesthetics. Additionally, in granting or denying an application for a specific use permit, the City Council shall take into consideration the following factors: a. Safety of the motoring public and of pedestrians using the facility and the area immediately surrounding the site. b. Safety from fire hazard, and measures for fire control. c. Protection of adjacent property from flood or water damage. d. Noise producing elements; and glare of vehicular and stationary lights and effect of such lights on established character of the neighborhood. e. Location, lighting and type of signs; and relation of signs to traffic control and adverse effect on adjacent properties. f. Street size and adequacy of pavement width for traffic and reasonably expected to be generated by the proposed use around the site and in the immediate neighborhood. g. Adequacy of parking, as determined by requirements of this chapter for off-street parking facilities for similar uses; location of ingress and egress points for parking and off-street loading spaces; and protection of the public health by all-weather surfacing on all parking areas to control dust. h. Such other measures as will secure and protect the public health, safety, morals and general welfare. i. City Council may grant variances to specific regulations associated with a specific use set forth in Sections 45. To receive a variance, the applicant must demonstrate one of the following (As amended by Ordinance No. 480-MMMM): (a) A variance will reduce the impact of the project on surrounding residential properties; or (b) Compliance with this ordinance would impair the architectural design or creativity of the project; or (c) A variance is necessary to assure compatibility with surrounding developed properties; or (d) The proposed construction is an addition to an existing project that does not meet the requirements of this ordinance. My home is located at 2816 Tyler which is on the corner of Tyler and Round Hollow. As such,my house is one of the closest homes to this project and will be significantly impacted. Last night(June 1) I attended an informational meeting that was hosted by Adolfson&Peterson who are the general contractors for this project. The purpose of this meeting was to review the proposed plan for the initial construction phase and to discuss potential mitigation efforts for the Kirkwood Hollow homeowners. In my professional career I have attended and hosted many of these meetings with homeowners. I know that they are not easy to host. However,I walked away from last night's meeting concluding that this was one of the poorest planned and least informative presentations that I have ever attended. I feel that Adolfson&Peterson was only conducting this meeting at the request of the City and that they had no intention to interact with the neighborhood. At this point my conclusion is the Adolfson&Peterson already has"Informal" approval of the City to proceed with project based on the plan they presented last night. There was no intent on their behalf to listen to concerns of the homeowners and to adapt to any of the suggested changes (and their were some good suggestions). The homeowner approach was not an approach to simply oppose everything about the project,rather there were some good suggestions. However Adolfson&Peterson had nothing but push back to all suggestions (many of which were extremely lame excuses). After a brief period of time Adolfson&Peterson concluded the meeting and said they would take the project to the City Council as it is currently planned and discontinued any discussion with the attendees from the neighborhood. My conclusion that Adolfson&Peterson is already prepared to proceed is based on their attitude but also on the site preparation they have already started(which is consistent with their construction plan). I also believe that the City has already started to cooperate with them based on their current plan based on the current plan to adjust the traffic flow on Kirkwood in the construction area. TX 76092 Case No. Attachment E ZA16-037 Page 50 RESOLUTION NO. 16-022 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS, GRANTING A SPECIFIC USE PERMIT FOR TEMPORARY CONSTRUCTION FACILITIES ON PROPERTY DESCRIBED LOT 1 R1 R1, BLOCK 1, SABRE GROUP CAMPUS, CITY OF SOUTHLAKE, TARRANT COUNTY, TEXAS; AND LOCATED AT 500 WEST DOVE ROAD, SOUTHLAKE, TEXAS, MORE FULLY AND COMPLETELY DESCRIBED IN EXHIBIT "A", AND AS DEPICTED ON THE APPROVED PLAN ATTACHED HERETO AND INCORPORATED HEREIN AS EXHIBIT "B" AND PROVIDING AN EFFECTIVE DATE. Kirkwood Blvd, location being described as Lot 1 R1 R1, Block 1, Sabre Group Campus, an addition to the City of Southlake, Tarrant County, Texas, more fully and completely described in Exhibit "A", and as depicted on the approved plan attached hereto and incorporated herein as Exhibit "B" and providing an effective date, subject to the provisions contained in the comprehensive zoning ordinance and the restrictions set forth herein. The following specific requirements and special conditions shall be applicable to the granting of this Specific Use Case No. Attachment F ZA16-037 Pagel Permit: City Council motion for approval: June 7, 2016; Approved a motion for Resolution No. 16-022, (ZA16-037), Specific Use Permit for Temporary Construction Facilities for TD Ameritrade subject to Staff Report dated May 31, 2016, noting the following: • Noting the approval of this Specific Use Permit will expire December 31, 2016; • Noting the construction entrance will be a right-in / left-out only entrance; • Noting access to the site will be from the west bound lanes of Kirkwood Boulevard; • Noting the secondary screening fence will be located at the top of the hill at a height that would adequately screen the trailers from Kirkwood Boulevard; • Noting that the screening fence will be constructed of wood; • Noting all traffic control devices represented by the applicant will be installed and utilized for the duration of the SUP; • Council is approving the relocation of the shrubs that are required and depicted on tonight's presentation from surrounding the construction trailers and placing those instead at the construction entry area along the screening fence; • Noting the applicant's agreement to relocate the concrete washout stations and noting that none of those concrete washout stations will be located north of the northern most construction trailer; • Noting the applicant's agreement to move the casting beds to the north side of the parking garage; • Requiring the applicant to immediately work towards obtaining Corps of Engineer approval necessary to complete the T.W King project and is committed to closing the current construction entrance by December 31, 2016 and noting that if the applicant is unable to construct T.W. King to a construction-useable state by December 31, 2016, they will be required to come back to Council for an extension of the SUP, but noting they can come directly to Council rather than through the normal process through the Planning and Zoning Commission; • Referencing the traffic pattern exhibits demonstrated tonight as part of the presentation; • Noting the applicant will have a designated communication liaison to work directly with the Kirkwood Hollow Homeowner's Association (HOA) representative and will be available to address concerns as necessary and will provide an update to the HOA representative no less than every two weeks; and, Case No. Attachment F ZA16-037 Page 2 • Noting the construction work hours will be in compliance with the Southlake Noise Ordinance and limiting heavy equipment movement in and out of the site to 7:00 a.m.-7:00 p.m. SECTION 2.
