Item 4H 13 S0UTHLA1<.,..E Department of Planning & Development Services STAFF REPORT September 27, 2016 CASE NO: ZA16-037, Resolution No. 16-022 PROJECT: Extension of the Specific Use Permit for Temporary Construction Facilities for TD Ameritrade EXECUTIVE SUMMARY: TD Ameritrade is requesting approval of an extension of the expiration date and modifications of the Specific Use Permit for Temporary Construction Facilities for TD Ameritrade on property described as Lot 1 R1 R1, Block 1, Sabre Group Campus Addition, an addition to the City of Southlake, Tarrant County, Texas and located at 1051 W. Kirkwood Blvd. (also addressed as 1801), Southlake, Texas. Current Zoning: "NR-PUD" Non-Residential Planned Unit Development District. SPIN Neighborhood # 1. REQUEST DETAILS: TD Ameritrade received approval of a Specific Use Permit on June 7, 2016 that allowed additional construction trailers exceeding the minimum single 2,000 square foot trailer permitted as an accessory use under the Zoning Ordinance. A condition of the SUP approval was that the applicant would need to return directly to City Council for an extension if the access drive connecting to W. Kirkwood Boulevard at T.W. King was not completed by December 31, 2016, otherwise the SUP would expire. Due to delays in receiving a permit from the Corp of Engineers to construct the bridge across the floodplain, flowage easement and drainage channel, the applicant will need to request the extension. As a part of the extension request, the applicant is proposing an alternate temporary construction access that can be completed earlier than the permanent access in order to help divert the majority of construction traffic further away from the Kirkwood Hollow neighborhood. To accomplish this, some additional trees will need to be removed that were not shown on the original Tree Conservation Plan. The applicant is processing a revised Tree Conservation Plan and Tree Removal permit concurrently to address the temporary construction access drive as well as some changes needed to the bridge location to address permit requirements of the Corp of Engineers and slope grading along the permanent driveway. The applicant proposes having the temporary construction access driveway open and complete by January 31, 2017 and is requesting to allow the temporary construction trailers for a period of 90 days after the final certificate of occupancy is received but not to exceed two years from original approval date of June 7, 2016. Except as noted herein, it is intended that all conditions of the approval for Case ZA16-037, Resolution No. 16-022, remain in effect unless specifically approved otherwise by City Council as part of this extension request. July 20, 1999; A Zoning Change and Concept Plan for NR-PUD allowing a variety of non-residential uses and development to include "High-Tech" uses, "0-2 Office", "Parking Structures", "Hotel", "Restaurant" was approved for approximately 155 acre under Case ZA99- 056 (Ordinance 480-313). The area included portions of the above described "NR-PUD" west of the alignment of Kirkwood Boulevard and a northern portion of the "R-PUD" area east of the alignment of Kirkwood Boulevard. March 20, 2007; A Plat Revision for Lots 1R1, 1R2, 2R, 4R1, 4R2 and 4R3, Block 1, Sabre Group Campus was approved under case ZA07-025. September 15, 2015; A Plat Revision for Lots 1 R1 R1 and 1 R1 R2, Block 1, Sabre Group Campus was approved under case ZA15-085. April 19, 2016; City Council approved a site plan for TD Ameritrade under Case ZA16-012 June 7, 2016 an SUP for Temporary Construction Facilities was approved under Case ZA16-037 with the conditions of approval as follows: PLANNING AND ZONING COMMISSION: May 5, 2016; Approved (5-0) subject to the Staff Report dated April 27, 2016; specifically noting within the staff report a date change on Attachment C, page 1, relating to the completion of TW King access road to be changed to August 2017; and specifically noting the applicant's willingness to strictly maintain the quality of construction fencing and screening and repair as needed; specifically noting the applicant's willingness to meet with the Kirkwood Hollow neighborhood regarding additional screening and fencing alternatives along the Kirkwood Blvd. side of the site; and in regards to the Specific Use Permit, time would be up to two years and/or within 90 days of the Certificate of Occupancy. CITY COUNCIL: May 17, 2016; Approved (6-0) a motion to table until the June 7, 2016 City Council meeting. June 7, 2016; A motion was made to approve Resolution No. 16-022, (ZA16-037), Specific Use Permit for Temporary Construction Facilities for TD Ameritrade subject to Staff Report dated May 31, 2016, noting the following: • Noting the approval of this Specific Use Permit will expire December 31, 2016; • Noting the construction entrance will be a right-in / left-out only entrance; • Noting the site will be accessed from the west or southbound lanes of Kirkwood Boulevard; Case No. Attachment A ZA16-037 Extension Page 2 • Noting the secondary screening fence will be located at the top of the hill at a height that would adequately screen the trailers from Kirkwood Boulevard; • Noting that the screening fence will be constructed of wood; • Noting all traffic control devices represented by the applicant will be installed and utilized for the duration of the SUP; • Council is approving the relocation of the shrubs that are required and depicted on tonight's presentation from surrounding the construction trailers and placing those instead at the construction entry area along the screening fence; • Noting the applicant's agreement to relocate the concrete washout stations and noting that none of those concrete washout stations will be located north of the northern most construction trailer; • Noting the applicant's agreement to move the casting beds to the north side of the parking garage; • Requiring the applicant to immediately work towards obtaining Corps of Engineer approval necessary to complete the T.W King project and is committed to closing the current construction entrance by December 31, 2016 and noting that if the applicant is unable to construct T.W. King to a construction-useable state by December 31, 2016, they will be required to come back to Council for an extension of the SUP, but noting they can come directly to Council rather than through the normal process through the Planning and Zoning Commission; • Subject to the traffic pattern exhibits demonstrated tonight as part of the presentation; • Noting the applicant will have a designated communication liaison to work directly with the Kirkwood Hollow Homeowner's Association (HOA) representative and will be available to address concerns as necessary and will provide an update to the HOA representative no less than every two weeks; and, • Noting the construction work hours will be in compliance with the Southlake Noise Ordinance and limiting heavy equipment movement in and out of the site to 7:00 a.m.-7:00 p.m. STAFF COMMENTS: Due to the limited scope of this request, there are no staff review comments.
