Worth, opened for questions and commented on the requested variances. The Commission discussed the variances and offered some alternatives regarding the proposed lot configuration. Chairman Forman opened the public hearing: Mitch Hagee, 225 Sam Bass Ridge Road, Southlake, Tx — spoke in opposition. Stated concerns regarding the land being sold to homes and property where the traffic will increase. He stated there is no room for sidewalks but if homes and traffic increase, there would be safety concerns regarding the children at play. An additional concern is Mr. Hagee stated that the owner talked to him about being interested in purchasing the property that is east of the subject property and the assumption is that multiple homes would be built. Chairman Forman closed the public hearing. Clarification was stated regarding further subdivision, land use and re -zoning. The Commission continued to discuss the sidewalk requirement; an escrow was suggested. The applicant requested to modify the variance requests by excluding the pan -handle configuration on the northern portion and offered to escrow funds for sidewalk. A motion was made to approve ZA16-062 subject to the Staff Report dated September 2, 2016 and Plat Review Summary No. 2, dated September 2, 2016; specifically granting the two variances requested within the application. However, with respect to the first variance requested, related to perpendicular lot lines we would note and include on that the applicant's request to exclude the panhandle portion of the line at the northern end of lot 10-R-1, and continue to extend the lines straight north. And, with respect to the second variance requested, grant that variance, however, at the request of the applicant, the commission would ask that it be subject to the appropriate amount of funds escrowed with the City related to the cost of construction of the subject sidewalk. The question was posed why it needed to be indoors. Om stated it was because of the proximity of the electric service. Chairman Forman opened the public hearing. No one came forward to speak. Applicant David Morris, 3400 Brushcreek Drive, Weatherford, opened for questions and talked about the materials and colors proposed. Discussion was held regarding the materials and colors proposed. It was recommended that the applicant provide photos of other store locations in order to get a better idea of what the colors will look like. Chairman Forman opened the public hearing. Brandon Brown, 129 James, Aledo (with the applicant) answered the questions regarding the brick. Chairman Forman closed the public hearing. A motion was made to approve ZA16-067, subject to the Staff Report dated September 2, 2016; however, noting the following change at the request of the applicant that the existing fagade will remain unchanged from its current condition; however, the existing door will be replaced by a wooden door that was shown in the staff report. DOVE ROAD, SOUTHLAKE, TEXAS. CURRENT ZONING: "NR -PUD" NOW RESIDENTIAL PLANNED UNIT DEVELOPMENT DISTRICT. SPIN NEIGHBORHOOD #1. Patty Moos, Planner I, presented ZA16-068. Planning & Zoning Commission Meeting Minutes — September 8, 2016 Page 5 of 7 Applicant Kathy Zibilich, 8144 Walnut Hill, Dallas, came forward to present and discuss the proposal. Discussion was held regarding the proposed duel handicapped and EVC space. The applicant proposed an optional landscape plan. Chairman Forman opened the public hearing: Doug Harsy, 2804 Tyler Street, Southlake, Tx — spoke on behalf of Kirkwood Hollow HOA. Stated concerns regarding screening of the EVC spaces. He talked about how the City will see an increase of these charging spaces. He suggested a time limit on the permit. Chairman Forman closed the public hearing. The applicant answered additional questions. The Commission discussed the impracticality of having the applicant install landscaping. A motion was made to approve Resolution No. 16-042, ZA16-068, as presented; subject to the Staff Report dated September 2, 2016; also subject to the Specific Use Permit Review Summary No. 2 dated September 2, 2016; also subject to the applicant's willingness to display an alternative landscape plan at City Council that provides additional landscape screening along the W. Dove Road entrance to the property relative to the electric vehicle charging stations; also subject to the applicant's willingness to paint the parking bollards from a bright yellow color to some type of neutral, grey or white - blended color; also allowing the applicant the option to sign and allocate the four electric vehicle charging spaces as needed relative to total handicap space designations. A question was posed regarding the existing awnings in place on the adjacent Sweet & Sassy store. Deputy Director Dennis Killough explained the non -conforming condition.
